Motion by York, seconded by Scheuplein, to receive and file. Motion carried 4-0 C. CONTINUED PUBLIC HEARINGS (1) PRECISE PLAN NO.01-06 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Circuit City LOCATION: 2851 Eastland Center Drive Southwest corner of Barranca Street and Workman Avenue REQUEST: The applicant is requesting the approval of a precise plan to approve the design and allow the construction of a 33,471- square foot consumer electronics store (Circuit City) within the Eastland Shopping Center area. The project will replace the existing 21,016-square foot building (Club Disney). The site is located within the "R-C" (Regional Commercial) Zone. COMMENTS: Greg Fitchett stated his agreement with continuing this hearing until the February 12, 2002 meeting. Motion carried 3-0. NEW PUBLIC HEARINGS (2) VARIANCE NO. 02-01 CATEGORICAL EXEMPTION APPLICANT: Michael Fuerst LOCATION: 2750-2808 E. Cortez Street REQUEST: The applicant is , requesting approval of a variance to encroach into the required front yard setback of Lot 10 of Tentative Tract Map No. 51600 (revised). The home is on the property located at 2750 E.Cortez Street. No.alterations or additions are proposed for the house. The property is located within the "Single Family Residential" (R-1) Zone. COMMENTS: There was a short discussion regarding the restrictions on additions or remodeling the existing structure. Motion by Scheuplein, seconded by Warshaw, to adopt findings as recommended by staff. Motion carried 4-0. Motion by Scheuplein, seconded Warshaw, to waive further reading of the body of the resolution and adopt Resolution No. 02-4714, approving Variance No 02- 01. Motion carried 4-0. (3) PRECISE PLAN NO. 01-08 CATEGORICAL EXEMPTION APPLICANT: David Tsai LOCATION: 450 S. Glendora REQUEST: The applicant is requesting approval of a precise plan for the construction of a 2,314-square foot second story office in an existing building, relocation of the trash enclosure and remodeling of the exterior on an existing shopping center. The site is located within the "Service Commercial" (S-C) Zone. COMMENTS: David Tsai, representative for Woo Investment, Royall Brown and Herb Redholtz spoke in.favor of the project the proposed improvements and urged approval of the request. No one spoke in opposition. There was a discussion regarding parking regulations for the proposed uses. Motion by York, seconded by Tarozzi, to adopt findings as recommended by staff. Motion carried 4-0. Motion by York seconded by Tarozzi to waive further reading of the body of the Resolution and adopt Resolution No. 02-4715, approving Precise Plan No. 01-08. Motion carried 4-0. Z:\PLANCOM\SUMACTS\SumActs 2002\1 29 02 sum act.doc\lsd • C� Planning Commission Summary of Action Page 3 — January 29, 2002 (4) TENTATIVE TRACT MAP NO. 53667 CATEGORICAL EXEMPTION APPLICANT: South Hills Homes Partnership LOCATION: Inspiration Point (South Hills Subdivision) Single Family Residential (R-1) Zone, Area District V Hillside Overlay Zone REQUEST: The project proposes to realign property lines of certain lots within a 36-lot tract and convert Inspiration Point from a public street to a private street. The revision to the subdivision includes 36 lots ranging in size from 20,002 to 37,901 square feet. COMMENTS: Ziad Al -Hassan, applicant, addressed the Commission in favor of the request. Discussion regarding other gated, private streets in the area. Motion by Scheuplein, seconded by York, to adopt findings as recommended by staff. Motion carried 4-0. Motion by Scheuplein, seconded by York, to waive further reading of the body of the resolution and adopt Resolution No. 02-4716, approving Tentative Tract Map No. 53667. Motion carried 4-0. (5) CODE AMENDMENT NO. 01-05 GENERAL EXEMPTION APPLICANT: City Initiated LOCATION: Citywide REQUEST: The proposed code amendment consists of amendments to Chapter 26 (Zoning) of the West Covina Municipal Code related to regulations regarding the installation of automobile accessories in the "N C" (Neighborhood Commercial) Zone. The project proposes allowing the installation of Automobile accessories such as car stereos in the "N-C" (Neighborhood Commercial) Zone subject to the approval of a conditional use permit. COMMENTS: Discussion by the Commission regarding the notification of the property owners and the notification process for conditional use permits. Motion by Tarozzi, seconded by Scheuplein to adopt findings as recommended by staff. Motion carried 4-0. Motion by Tarozzi, seconded by Scheuplein to waive further reading of the body of the resolution and adopt Resolution No. 02-4717, recommending to the City Council approval of Code Amendment No. 01=05. NON -HEARING ITEMS (1) STUDY SESSION (Taken out of order) GENERAL PLAN AMENDMENT NO. 01-01 ZONE CHANGE NO. 670 TENTATIVE TRACT MAP NO. 53354 PRECISE PLAN NO. 885 TREE REMOVAL PERMIT NO. 32 ADMINISTRATIVE USE PERMIT NO. 56 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: CVP Homes, LLC. (Pacific Communities) LOCATION: Northeast corner of Azusa Avenue and Autumn Drive, and south of Aroma Drive. REQUEST: The project proposes to subdivide the 12.9-acre site into 46 single-family lots, three open space lots for slopes, and one recreation area lot, and to construct a 46-unit single-family detached housing development. At its meeting of January 15, 2002, the Commission requested that a study session be held to further discuss issues related to the proposed project before further consideration as public hearing matter. COMMENTS: Nelson Chung and Mohan Obasni addressed the Commission regarding the geotechnical tests conducted on the subject property and the results. Royall Brown addressed the Commission regarding the close proximity to BKK and spoke in opposition to the request. The Commission discussed requesting a review by an independent engineer of all gas and soils tests conducted by the applicant's engineers, the stability of the slopes. Motion by Scheuplein, to continue this matter to February 25, 2002. Motion died for lack of a second. Motion by Scheuplein, seconded by York; to proceed with direction to staff to initiate review of the tests and results by an independent engineer and make a recommendation for continuation to a date certain at the next meeting. Motion carried 3-1 (Warshaw). (2) STATUS OF COMPLIANCE WITH CONDITIONS OF APPROVAL CONDITIONAL USE PERMIT NO. 553 APPLICANT: Tacit Communications LOCATION: 1500 S. Azusa Avenue REQUEST: To allow installation of a wireless telecommunications facility designed as a 72-foot tall mock pine tree. This application was approved by the Commission on September 25, 2001. On December 11, 2001 it was requested that this matter be agendized to discuss compliance with the conditions of approval. Commission discussed lack of maintenance of the property by Southern California Edison. It was the consensus of the Commission to receive and file the status report. Z:\PLANCOM\SUMACTS\SumActs 2002\1 29 02 sum act.doc\lsd Y Planning Commission Summary of Action Page 5 — January 29, 2002 (3) EXPANSION OF PAROLE OFFICE At the Planning Commission meeting of January 15, 2002, it was requested that an item be agendized to discuss the proposed expansion of the Parole Office located at 1837 West Badillo Avenue. COMMENTS: Royall Brown spoke in opposition of the parole office expansion. There was a discussion regarding the recommendation by the City Attorney that the Planning Commission not take action on this matter unless requested to do so by the City Council. The Commission also discussed whether or nor the parole office would require a conditional use permit for a school. Chairman Tarozzi and Commissioner Scheuplein expressed their desire to petition the City Council for permission to hold a study session to determine an appropriate zone for parole offices. Motion by Tarozzi, seconded by Scheuplein, -to request permission from the City Council to address the matter of the expansion of the parole office. The motion was withdrawn by Tarozzi and Scheuplein. Motion by Tarozzi, seconded by Scheuplein, to request permission of the City Council to take a position on the parole office and discuss.. Motion failed 2 —2. (Warshaw, York). It was the consensus of the Commission to agendize a study session to discuss the proper zoning for a parole office. Staff was directed to include a list of potential properties for rezoning and a report of how other Southern California cities handle parole offices in their jurisdictions. Staff was directed to provide the information in 4 weeks. E. OTHER MATTERS OR ORAL COMMUNICATIONS None F. COMMISSION REPORTS/COMMENTS AND MISCELLANEOUS ITEMS Commissioner York requested information on Garden Grove's internet access centers, requested that staff look into the stereo installation business and their activities and requested that staff urge the owners to apply for a precise plan in accordance with the zoning code. Scheuplein requested that data be included on the internet access center reports dealing with gang activity. (1) CITY COUNCIL ACTION: This is an oral presentation of City Council matters and actions of the listed meeting which are in the Commission's area of interest. City Council meeting, January 22, 2002: -Game Arcade Code Amendment vote deadlocked 2-2.
