PUBLIC HEARINGS (1) VARIANCE NO. 01-02 CATEGORICAL EXEMPTION APPLICANT: Roy Colwick LOCATION: 1728 West Mossberg Avenue REQUEST: The applicant is requesting approval of a variance to encroach into the required front and side yard setbacks of a residential property, in order to accommodate a 630-square foot prefabricated metal -framed carport structure. The carport currently exists on the site, and encroaches 19 feet into the required 25-foot front yard setback, and 5 feet into the required 5-foot setback. Additionally, the variance requests to exceed the allowed 35 percent lot coverage ratio by approximately 2 percent. The property is located within the "Residential —Agricultural" (R-A) sZone, Area District I. The Commission agreed to add conditions requiring the structure to conform to the required side yard setback and to require the structure to be removed upon sale or transfer of the property. NEW PUBLIC HEARINGS (2) CONDITIONAL USE PERMIT NO. 01-08 PRECISE PLAN NO. 01-10 CATEGORICAL EXEMPTION APPLICANT: Cuauhtemoc Garcia & Blas Vasquez LOCATION: 1125 West Covina Parkway REQUEST: The project consists of a conditional use permit to allow the on -sale general service of beer, wine and distilled spirits, live (musical) entertainment, dancing and a DJ in conjunction with an existing 10,000 square foot restaurant. The project also consists of a Precise Plan to make changes to the exterior of the building to allow for an outdoor dining patio. The project is located in the "Regional Commercial" (R-C) Zone. There was discussion by the Commission concerning parking and notification of adjacent businesses, and Police Department recommendations for security guards. LOCATION: 3114 E. Garvey Avenue South REQUEST: The applicant is requesting the approval of a conditional use permit to permit the installation of a 50-foot high mock pine tree (monopine)antenna, with six (6) panel antennas divided into three (3) arrays. The proposed pole will be located at the southeast corner of the vacant lot. COMMENTS: Lemuel Hawkins, representing the applicant, spoke in favor. There was no terstimony in opposition. With the applicant's concurrence, the Commission allowed the monopine to be built to a height of 72 feet to allow for co -location. The Commission also agreed to approve conditions requiring the monopine to moved to the southwest portion of the site, or to provide two replacement pine trees for the pine tree that would need to be removed at the proposed location. Motion by Warshaw, Scheuplein, to adopt findings as recommended by staff as amended. Motion carried 5-0. Motion by Warshaw, Scheuplein, to waive further reading of the body -of the resolution and adopt Resolution No. 02-4710 approving Conditional Use Permit 01-15. Motion carried 5-0. (4) GENERAL PLAN AMENDMENT NO. 01-01 ZONE CHANGE NO. 670 TENTATIVE TRACT MAP NO. 53354 PRECISE PLAN NO. 885 TREE REMOVAL PERMIT NO. 32 ADMINISTRATIVE USE PERMIT NO. 56 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: CVP Homes, LLC. (Pacific Communities) LOCATION: Northeast corner of Azusa Avenue and Autumn Drive, and south of Aroma Drive. REQUEST: The project proposes to subdivide the 12.9-acre site into 46 single- family lots, three open space lots for slopes, and one recreation area lot, and to construct a 46-unit single-family detached housing development. The project requires the granting of the following entitlements: (1) a General Plan Amendment to change the land use designation on the site from "Very Low Density Residential" (0.1 to 1.0 dwelling units per acre) to "Suburban Residential" (2.1 to 4.0 dwelling units per acre); (2) a zone change to change the site's zoning classification from "Low Density Multiple Family Residential" (MF-15) to Specific Plan No. 16; (3) a tentative tract map to subdivide the 12.9-acre site into 46 single-family lots, three open space/slope lots, and one recreation area lot, for a total of 50 lots; (4) a precise plan for the site design and architecture of the site; Z:\PLANCOM\SUMACTS\SumActs 2002\1 15 02 sum act.doc\Isd d Planning Commission Summary of Action Page 4 — January 15, 2002 (5) a tree removal permit for the removal of 16 existing trees identified as significant under the City's Tree Preservation Ordinance; (6) an administrative use permit for the construction of retaining walls in excess of f our feet in height, in accordance with the tentative tract map and precise plan. COMMENTS: Nelson Chung, applicant, addressed the Commission regarding testing of methane gases in the area of the project, problems encountered with grading and land slippage. Royall Brown addressed the Commission with regard to the past history of the BKK property, his concern with landslides in the area and requested that the applicant be required to submit a grading plan for review by the Planning Commission at a public hearing. Discussion by the Commission regarding grading, geotechnical safety, methane migration, and safety due to the site's proximity to the BKK landfill site. Motion by Tarozzi, seconded by Lane, to continue this matter to schedule a study session at the January 29, 2002 meeting and continue the public hearing to February 12, 2002. Motion carried 3-2 (Warshaw, York). The Commission requested that the Environmental Management Director and the Public Works Director be present at the workshop to answer questions, and that the Waste Management and Environmental Quality Commission be notified of the project. (5) ZONE CHANGE NO. 01-05 TENTATIVE TRACT MAP NO. 51600 VARIANCE NO.01-08 TREE REMOVAL PERMIT NO. 14 NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Michael Fuerst LOCATION: 2750-2808 E. Cortez Street REQUEST: The project proposes to subdivide a 4.83-acre site composed of two single-family residential lots into a total of eleven single-family residential lots, and the construction of a new cul-de-sac street off Cortez Street to provide access to the lots. This is a revision to a previously approved Tentative Tract Map to subdivide the site into nine lots. The two single-family residences that currently exist on the site will continue to remain and occupy two of the proposed lots. Grading will be limited to that necessary for construction of the proposed street, and the grading of driveway approaches for the new lots. Ten of the eleven lots are proposed to vary in size from 14,431 square feet to 17,188 square feet, with the tenth lot proposed to be 42,484 ± square feet. The project requires the granting of the following entitlements: (1) a zone change to change a 0.2-acre portion of a property from "Residential Agricultural" (R-A) Zone, Area District V to "Single -Family Residential" (R-1) Zone, Area District III; (2) a tentative tract map to subdivide a 4.83-acre site composed of two single-family residential lots into a total of eleven single-family residential lots, and ZAPLANCOM\SUMACTS\SumActs 2002\1 15 02 sum act.doc\Isd Planning Commission Summary of Action Page 5 — January 15, 2002 (3) a variance for the reduction in lot depth for one lot and the reduction of the lot width for two lots; (4) a tree removal permit for the removal of 16 existing trees identified as significant under the City's Tree Preservation Ordinance; COMMENTS: Mitchell Fuerst, applicant, and Hersel Zahab, project engineer, spoke in favor. Dr. Russell Rohde, Chris Graham and Van Dossy addressed the Commission regarding their concern with hours and days of construction, traffic and visibility in the area, the removal of trees from the property, and devaluation of their property. Dscussion regarding requiring an architectural review of the homes prior to issuance of building permits and the traffic in the area. The residents of the area were encouraged to petition the Traffic Committee for installation of a stop sign at the intersection. The Commission agreed to approve a condition requiring the applicant to pay reasonable cost to provide. screening for the home at 2739 E. Cortez Street that would be affected by headlights from the proposed street. The Commission also gave direction to staff to not approve homes with full second stories when plans were proposed. Motion by York, seconded by Tarozzi, to adopt findings as recommended by staff. Motion carried 5-0. NON -HEARING ITEMS (1) PLANNING COMMISSION AUTHORIZED PLANNING DIRECTOR'S MODIFICATION TO PRECISE PLAN NO. 884 CATEGORICAL EXEMPTION APPLICANT: Penske Motorcars LOCATION: Northwest corner of Hollenbeck Street and Garvey Avenue South and the southwest corner of Hollenbeck Street and Garvey Avenue North. REQUEST: The applicant is requesting approval to utilize landscaping - in -lieu of a wall for screening purposes as required pursuant to Municipal Code Section No. 26-574. COMMENTS: Dscussion by the Commission regarding the size of the plants to be planted to provide visual screening. Royall Brown addressed the Commission regarding the size of the shrubs. It was the consensus of the Commission to require the planting of plants a minimum of 18 inches in height. Motion by Warshaw, seconded by Lane to approve Planning Commission authorized Planning Director's Modification to Precise Plan No. 884, as amended to require plants a minimum of 18 inches high. Motion carried 5-0. (2) IKEA FURNITURE STORE PROJECT IN COVINA: DRAFT MITGATED NEGATIVE DECLARATION The City of Covina is currently considering a proposal to develop a new 330,000- square foot IKEA furniture store on the site of the former Montgomery Wards department store at southeast corner of Barranca Street and Workman Avenue. Covina has prepared a Draft Mitigated Negative Declaration (including a traffic report) for the project with a public comment period ending on January 25, 2002. Staff is currently preparing a report for consideration by the City Council on February 22, 2002 regarding the submission of comments on the Mitigated Negative Declaration. COMMENTS: There was a discussion regarding concern with traffic in the area. Royall Brown requested the Commission recommend a 30-day extension of the comment period on the Negative Declaration. It was the consensus of the Commission that staff be directed to make this recommendation to the City Council. Commissioner Warshaw further stated that he would like to see a traffic signal on Barranca at the driveway entrance, and also suggested that a walking ramp be constructed leading to Restaurant Row in West Covina. Staff was directed to relay the Commissioner's comments to the City Council. Commissioner York added that West Covina would like to support Covina's project and would like to help the City of Covina mitigate traffic concerns in the area. E. COMMISSION REPORTS/COMMENTS AND MISCELLANEOUS ITEMS Scheuplein reported on League of California Cities Annual Conference. Chairman Tarozzi - Tacit Communications be placed on the next agenda. Requested that the issue of the expansion of the Parole Office on Badillo Street be placed on the next agenda and directed staff to consult with the City Attorney as to whether the Commission could adopt a resolution opposing the expansion. (1) CITY COUNCIL ACTION: January 8, 2002 — Game Arcade Ordinance amendment was considered and continued to January 22, 2002 for action. January 22, 2002 — Consideration of the City of Covina Ikea project. (2) PLANNING DIRECTOR'S REPORT: Big League Dreams community meetings Wednesday, January 16, 2002 and Saturday January 19, 2002. G.
