REVIEW OF CONDITIONAL USE'PERMIT NO.471 APPLICANT: Villa Tepeyac Restaurant LOCATION; 2200 East Garvey Avenue South REQUEST:, One-year review of operation I A meeting with representatives of Villa Tepeyac' has been scheduled for January, 29, 1997 to discuss outstanding issues. It is therefore recommended that thee. Planning Commission continue this item to February11, 1997. ACTION ON FOREGOING CONSENT CALENDAR ITEMS. Motion carried 5-0. Motion by Connolly, seconded by Zeller, to waive further reading of the body of the resolution; and adopt Resolution No. 1-97-4399, recommending to the City Council approval of Code Amendment No. 274. Motion carried 5-0. This item will be considered by the City Council at a public hearing scheduled for February 4, 1997. COMMENTS: No members of the public spoke on this item. The Commission unanimously felt that the ordinance addressed the comments they had made at previous meetings on the matter and voted unanimously to recommend approval to the City Council. NEW PUBLIC HEARING (2) CONDITIONAL USE PERMIT NO. 479 CATEGORICAL EXEMPTION APPLICANT: Dennis McConaughy LOCATION: 2646 East Garvey Avenue South, east of Citrus Street (within the Country Club Center) The applicant is requesting a conditional'use permit to allow the operation of a restaurant with alcohol service, dancing, and indoor recreational center (darts). Commissioner Zeller stepped down due to a potential conflict of interest and did not participate in the hearing. Motion by Melendez, seconded by Solinger, to adopt findings as recommended by staff. Motion by Connolly to amend the motion to delete the conditions requiring installation of planters within;the parking lot. Failed for lack of a second. Motion by Solinger to amend the -motion and delete one large planter adjacent to the street and to', delete darts, seconded by Connolly. Motion carried 3-1 (Reiner voting no). I Original motion carried 3-1 (Reiner voting no). Motion by Melendez, seconded by Solinger, to waive further reading of the body of the resolution and adopt Resolution. 1-97-4400, approving Conditional Use Permit No. 479, as amended. Motion carried 3-1 (Reiner voting no). This decision is final unless appealed to the City Council within 20 days. COMMENTS: The applicant and an attorney representing the owner of the property spoke in favor of the application. However, his application did not include live entertainment as one of the CUP requests and the meeting was not advertised to include a request for live entertainment ,so the Commission .was not able to consider this during the hearing. i The Commission was somewhat split in the level of improvements4 that should -be made to the parking lot to improve traffic safety and landscape aesthetics. Commissioner', Reiner felt all improvements to the parking lot should be made as it is part of the cost of doing business to upgrade the site. i. Commissioner, Solinger had concern with allowing darts in a bar setting as it may create a safety hazard. The Commission discussed allowing 'an additional billiard table in; consideration of deleting the darts. The applicant was twilling to agree to this change but staff noted that an increase from three billiard tables to four tables would require the matter to be renoticed as the facility would now qualify as a "billiard parlor' under the Code and require CUP approval. After much discussion the Commission voted to approve the application subject to installing several planters in the; parking lot , requiring the installation of reflective paints striping of one area recommended by staff for a planter and deleting darts from the operation of the restaurant. The applicant was encouraged to submit a revised application for a CUP as soon as possible if he desired to have live entertainment and an additional billiard table. Hills Community Association LOCATION: Aroma Drive and ,Donna Beth Avenues (East of Azusa Avenue) 1. The Governing Board of Director's for the South Hills Community Association requests that the Planning Commission consider allowing the .dissolution of the master homeowner's association to resolve slope maintenance disputes between two' secondary homeowner's associations. S U M\arp j 1 Planning Commissidoeeting - Summary of Action January 28, 1997 - Page 4 COMMENTS: Not all sub -associations that make up the South Hills Community Association were in agreement on this requests and two sub -associations submitted letters requesting that, the matter be delayed. The South Hills Community Association is a master homeowners* . association covering several separate condominium projects that were approved as part of the same originalicondom inium map. In response to the letters, the Commission voted unanimously to table the matter until the associations are in agreement on how they wish to proceed. (2) INITIATION CODE AMENDMENT NO. 277 ADMINISTRATIVE USE PERMITS With several recent code amendments, the City has been continuing, to expand the practice of using-Administrative'Review processes to reduce the time and cost of reviewing. various planning proposals. As the Zoning Code does not contain a standardizedAdministrative Use Permit Process, separate but similar permit procedures have. been established for specific issues, such as signs, retaining walls, etc. To rectify this, it now proposed to develop a single Administrative Use Permit process that would be used for the majority proposals requiring Administrative Review. Motion by Connolly, seconded by Zeller, to waive further .reading of the body of the resolution and Resolution No. 1-97-4401, initiating the procedure to amend Chapter 26 of the West Covina Municipal Code (Zoning) related to establishing an Administrative Use Permit process. Motion carried 5-0. . COMMENTS: The Commission voiced support for the spirit of this amendment and unanimously approved the initiation of this amendment. D. OTHER MATTERS OR ORAL COMMUNICATIONS None. E. COMMISSION REPORTS/COMMENTS AND MISCELLANEOUS ITEMS None. CITY COUNCIL ACTION: During the last Council meeting the Council approved an extension to the Wireless Communication Facility Interim Ordinance.
