SUBJECT: TIME EXTENSION - URGENCY ORDINANCE NO. 1967
(REVERSE VENDING MACHINE REGULATIONS)
SUMMARY: On April 2, 1996, the City Council adopted Urgency Ordinance No.
1967, extending an original urgency ordinance establishing more
stringent standards for reverse vending machines to February 17,
1997.: Pursuant to State law, this urgency ordinance may be
extended one final time for a period of one year. This extension is
needed to provide time for a permanent ordinance to be developed
and adopted.

On February 20, 1996, the City Council adopted Interim Urgency Ordinance No.
1966, establishing more stringent standards for reviewing and approving reverse
vending machine facilities. Pursuant to Section 65858(a) of the State
Government Code, this interim ordinance was .effective for an initial period of 45
days and terminated on April 2, 1996. On April 2, 1996, the Council adopted
Urgency Ordinance No. 1967 extending the urgency ordinance for an additional
10 months and 15 days to February 17, 1997. A final one year extension is
being presented to the City Council for consideration. As a reference, no
requests for reverse vending machines have been received during the
moratorium period.
DISCUSSION
Urgency Ordinance No. 1966 was originally adopted in response to Planning
Commission co i cerns about existing conditions regarding the location (sidewalk
blockage) of . vending machines, aesthetic quality, cleanliness of existing
facilities, security of the facilities, vending machine height, and vending machine
size. Following the adoption of this ordinance, Planning staff sent a letter to all
retail operators and their landlords in an effort to improve the maintenance
operations at existing facilities, and to inform those retailers contemplating the
establishment of a reverse vending machine facility about the urgency ordinance
standards.
The urgency ordinance prevents any further establishment of reverse vending
machines that may impact the public by obscuring the building architecture,
obstructing walkways,, and creating unclean conditions and clutter. The more
stringent interim standards are intended to complement the existing standards,
by making sure that commercial and retail facilities are not adversely affected by
the establishment of reverse vending machines. Areas approved for vending
machines must ,not pose health and safety hazards to the public.
In developing a permanent ordinance, the Planning Commission expressed the
desire to expand the focus to also include standards for other facilities
commonly located outside of supermarkets and other retail businesses, such as
children's rides and regular vending machines.
