ORDINANCE NO. 1961 RELATIVE TO HORSE
REGULATIONS
SUMMARY: Pursuant to Section .65858(d) of the Government Code, staff has
prepared this status report on the conditions which led to the adoption of
Urgency Ordinance No. 1961. The ordinance was originally adopted on
December 5, 1995 and established an administrative review and public
notification process for the keeping of horses on Residential Agriculture
(R-A) and Single -Family Residential (R-.1) `zoned properties. The
ordinance was adopted in response to the potential keeping of horses at
a residential property which is up for sale at 2527 East Cameron Avenue.
Staff has notified the realtors for this property, and the general public of
the provisions of the interim ordinance.
BACKGROUND
On December 55, 1995, the City Council adopted Urgency . Ordinance No. 1961 which
established an administrative review process for the keeping of horses on Residential
Agriculture (R-A) and Single -Family Residential (R-1) zoned lots. As an interim measure, the
keeping of horses is. no longer allowed "by right" but instead is allowed with a permit from the
Planning Director. Also, the permit process requires the property owner to submit a site plan
showing existing and proposed structures (e.g. corrals and stables) and notification to all
property owners within 100 feet of the lot where horses are proposed to be kept.
DISCUSSION
Section 65858(d) of the Government Code requires ;staff to prepare a report on the status of .the
conditions which led to the adoption of the urgency ordinance at least ten days prior to the
expiration of said ordinance, or by January 19, 1996. The ordinance was originally adopted in
response to the potential keeping of horses at a single-family residential property which' is up
for sale at 2527 East Cameron Avenue. Adjacent residents were concerned about flies and
dust, and other health impacts related to the potential keeping of five horses which was the
maximum number of horses allowed under the Code. Staff has informed the realtors who have
the Cameron Avenue listing of the adoption of the ordinance and have also mailed them a
copy. When inquiries are received about the keeping of" horses on the Cameron Avenue
property or anywhere. else within the City, staff has informed realtors and the general public
about the provisions of the ordinance.
Urgency Ordinance No. 1961 is effective for a period of 45 days and will expire on January 19,
1996. Pursuant to State Law, the measure but can be extended for 10 months and 15 days
under Section 65858(a) of the Government Code. The extension of this ordinance will be
placed on the January 16, 1996 City Council Agenda for consideration.
RECOMMENDATION
Staff recommends that the City Council receive and file this status report relating to the keeping
of horses in residential zones and Urgency Ordinance No. 1961.
