SUMMARY: On December 20, 1994, the City Council adopted an ordinance that
established a new "special event permit." A fee for reviewing and
processing special event permits must now be adopted by separate
resolution of the Council.
On December 20, 1994, the City Council adopted Ordinance No. 1950 which
established more permissive regulations for promotional events and. related
signage. As part of this ordinance, a new "special event permit" was. established.
Special event permits will be specifically used for (1) approving minor promotional
events and related signage for commercial businesses, (2) approving
banners for commercial businesses, and (3) approving promotional signs and
banners for apartment complexes.
The processing of special event permits is anticipated to be a relatively simple
"over-the-counter" review to ensure compliance with adopted standards. As it is
the general policy of the City to recover costs borne by the City in reviewing
permit applications,. it is necessary to establish a fee for processing special event
permits.
The processing of special event permit applications will typically involve reviewing
applications and plans for accuracy, completeness, and compliance with adopted
standards, and associated clerical work (filing, issuing receipts, etc.). While the
time involved in performing these tasks will vary, staff has estimated that under
normal circumstances, this will involve approximately 0.4 hours (24 minutes) of
time to complete. At the current billing rate of $56.50 per* hour for staff review of.
permit applications, this would equate to $22.60 in staff time. Rounding down, a
set fee of $20.00 would represent a reasonable equivalency to the amount of
staff time expended.
Staff recommends.that the City Council adopt the following resolution:

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY 'OF - WEST COVINA, CALIFORNIA,
ESTABLISHING A FEE FOR PROCESSING
APPLICATIONS FOR SPECIAL EVENT PERMITS

WHEREAS, on December 20, 1994, the City Council adopted Ordinance
No. 1950 amending certain sections of the West Covina Municipal Code, Chapter
26 (Zoning) related to promotional events and signage (Amendment No. 259);
and
WHEREAS, said Ordinance established a new type of permit referred to
as a "special event permit", for the purposes of allowing minor promotional
events and associated signage for commercial businesses, allowing the display
of banners for commercial businesses, and allowing the display of promotional
signs and banners for multiple -family residential complexes; and
WHEREAS, the creation of the special event permit now necessitates the
establishment of an associated fee to recover the cost of reviewing and
processing applications for speciall events permits; and
WHEREAS, pursuant to Government Code Section 66018, the City may
adopt a new fee of this nature onlyi upon the holding of a public hearing as part of
a regularly. scheduled meeting, at which oral and written presentation can be
made -,and
WHEREAS, notice of the public hearing and the provision of data
available to the public has been made pursuant to the requirements of
Government Code Sections 660161 and 6062(a), and the required public hearing
was held, at which time an opportunity for oral and written presentations was
made; and
WHEREAS, the fees and charges adopted are for operating expenses and
not capital charges; and
WHEREAS, pursuant to Government Code Section 66016(a), a new fee
established by the City may not exceed the estimated amount required to provide
the service for which the fee is established; and
WHEREAS, the adoption of a new fee for operating expenses is statutorily
exempt from environmental review under the California Environmental Quality Act
(Section 15273, CEQA Guidelines).
NOW, THEREFORE, the City Council of the City of West Covina does
resolve, determine, and order as follows:
Section 1. Fee. The feelfor Special Events Permit is hereby
established as $20 per application
Section 2. Reasonable Cost Finding. The above fee is based upon an
estimation of the cumulative staff time -to be expended in the act of reviewing and
processing applications for Special, Use Permits and the. estimated cost of
supplying such staff services. The'City Council therefore finds that the adopted
fee does not exceed the reasonable cost of the service provided.

Section 3. Severability. If any portion of this resolution is found to be
unconstitutional or invalid, the City Council hereby declares that it would have
enacted the remainder of this Chapter regardless of the absence of any such
invalid part.
