DATE January 21, 1992 SUMMARY: A mutual agreement has been reached between the.City and the West Covina Public Safety Dispatchers' Association to continue the 3/12 Work Schedule on a permanent basis. BACKGROUND In an effort to comply with the AQMD Regulation.15 requirement to reduce the number of cars.arr.iving at the worksite between the hours of 6-10 a.m., the City has implemented alternate work schedules for City employees.. All other departments with the exception of Communications have entered into permanent schedules subsequent to trial periods and meet and confer with.the affected.employees. DISCUSSION The West Covina Public Safety Dispatchers' Association has been working -a 3/12 schedule on a trial basis since March 4, 1991. The trial period was designed to assess the viability of the alternate schedule and was extended to allow the full impact of summer vacations to be assessed, as well as development of a new shift selection procedure. Both -the City and the employees have determined that the 3/12 Work " Schedule is practicable.and have entered into a permanent agreement to remain with the alternate schedule. FISCAL IMPACT There will be no financial impact as a -result of this agreement. RECOMMENDATION Staff recommends that the City Council receive and file the Letter of Agreement as submitted by the employee association. Diane F. Ure Personnel Director yh:ALTSCHED.PSD LETTER.OF AGREEMENT BETWEEN THE CITY OF WEST COVINA AND WEST COVINA PUBLIC SAFETY DISPATCHERS' ASSOCIATION 4 The City of.West Covina (City), and the West Covina Public Safety Dispatchers' Association (Association) have met and conferred regarding the established 3/12' work schedules for the employees represented by the Association in the Communications Department. The schedules were established effective March 10, 1991, with a trial period terminating December 31, 1991. By mutual agreement of the parties, the 3/12 schedule shall remain in effect on a permanent basis except as otherwise mutually agreed upon by the parties. Individual exceptions will be made in accordance with the City's Alternative Work Schedule Exception Policy. (Attachment A) This agreement is entered into'this /9 day of December,.1991. Background The City is required to reduce trips to work in accordance with the Air Quality Management Di'strict's (AQMD) Regulation 15, which was passed in 1988. In response to this mandate, the City has adopted alternative work schedules. It is recognized that some employees may have outside considerations that will interfere with or preventthem from working their department's designated work schedule, i.e., childcare/eldercare conflicts, carpool considerations, school schedule, et.c. To address this situation, the City has designated the Alternative Work Schedule Exception Committee (Committee) to review employee "hardship" requests. Ii. Poli"cy 1. Employees may file a claim of hardship on a Work Schedule Exception Form (Attachment A) and submit it to his/her Department Head. The Department Head shall then submit the claim to Personnel Services to forward to the Committee. 2. The Committee is composed of the- following. individuals: *a. Department Head *b. Representative from an employee association c. Representative from the Personnel Services Department d. Transportation Coordinator *Not from the department or the employee association to which the employee filing the claim works or is a member of. 3. The Personnel Services representative will contact the Committee and arrange for the Committee to meet within one week of receipt of the claim in Personnel Services. 4., The Committee will be convened at a time and location convenient to the parties. 5. The .Committee will first hear comments from the employee and/or the employee's association representative. Then the Committee will hear comments from the Department Head or his/her designee.. 6. Upon hearing. the comments from the employee and the Department Head, the Committee may ask questions of both parties. Attachment A CITY OF WEST COVINAe ADMINISTRATIVE POLICY Subject: ALTERNATIVE WORK SCHEDULE EXCEPTION POLICY Page 2 7. The Committee shall then excuse the parties and make their decision to approve or disapprove the request. Each member of the Committee shall cast one vote. In the event of a tie vote, the City Manager shall decide whether the claim shall be granted. 8. The decision of the Committee may be appealed to the City Manager within 5 days of the Committee's decision on the Work Schedule - Exception Form. The employee shall complete the form and submit it to his/her Department Head. The Department Head shall then complete his/her portion of the form and submit it -to the City Manager. 9. The City Manager will review the statements contained on.the form as well as the minutes and decision of the Committee. 10. The City Manager shall affirm or reverse the decision of the Committee within 5 days of receipt of the appeal. A copy of the City Manager's decision shall be forwarded to the Personnel Services Department. 11. The decision of the City Manager, is final and is not subject to the grievance procedure.
