Pasmant, City Manager and City Council FROM: Thomas Bachman, Assistant City Manager SUBJECT: RESOLUTION WAIVING THE PERS 960-HOUR RULE FOR ONE FIRE PROTECTION SPECIALIST RECOMMENDATION: It is recommended that the City Council adopt the following resolution: RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY ' OF WEST COVINA, CALIFORNIA, WAIVING THE CALPERS 960-HOUR RULE FOR GREG ALLEN DISCUSSION: On August 25, 2008, due to staff turnover, the Fire Department re -hired retired Firefighter Paramedic Greg Allen, as a limited services (part-time/temporary) non -sworn Fire Protection Specialist (Fire Inspector). At that time, the recruitment for a regular full-time Fire Protection Specialist was put on hold to review staffing alternatives related to their budget. In addition, the Fire Chief wanted to take time to review and revise the current classification specification (class spec). Currently, CALPERS requires that a retiree work no more than 960 hours in a fiscal year (i.e. July 1, 2008 to June 30, 2009). Ca1PERS regulations also provide that a retiree may exceed the 960 hours in a fiscal year under certain circumstances. Greg Allen will reach his 960-hour limit for this fiscal year, on or about March 2, 2009 and the Fire Chief has requested this employment extension in order to meet the workload and demands of the Fire Department. The recommended action will extend the number of work hours available for retired Firefighter Paramedic Greg Allen for this fiscal year, and transmit the necessary resolution to waive the CALPERS 960-hour rule FISCAL IMPACT The Fire Protection Specialist is an authorized and budgeted full-time position in the Fire Department. Filling this position with a part-time employee results in savings to the Fire Department budget. RESOLUTION NO. - A RESOLUTION OF, THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, WAIVING THE CALPERS 960-HOUR RULE FOR GREG ALLEN WHEREAS, Government Code Section 21221 (h) provides for an extension of employment for greater than 960 hours under limited circumstances, however, the total duration of an appointment cannot exceed one year or twelve months. WHEREAS, in order to continue the operations of the Fire Department's Fire Prevention Unit, we need to staff the Fire Protection Specialist position; and WHEREAS, Greg Allen works for the City of West Covina on a temporary basis in the Fire Department while the City recruits for a new full-time Fire Protection Specialist; and WHEREAS, Greg Alleri is trained and has the skills necessary to perform the essential functions of the Fire Protection Specialist; and WHEREAS, as a PERS retiree, Greg Allen can only work 960 hours in a fiscal year; and WHEREAS, Greg Allen will have worked 960 hours for the City of West Covina on or about Monday, March 2, 2009. NOW, THEREFORE, let it be resolved by the City of West Covina that the City Council formally requests the PERS Board to waive the 960-hour rule for Greg Allen. The City Clerk shall certify to the adoption of this Resolution. APPROVED AND ADOPTED this 3rd day of February 2009.
