Paper City Council FROM: Environmental Services December 26, 1994 Director SUBJECT: STATUS OF BKK UNCLASSIFIED USE PERMIT COMPLIANCE SUMMARY: This is a status report on the preparation of a notice of violation that will be sent to BKK regarding the lack ofi compliance to the conditions of the Unclassified Use Permit for the landfill. At the December 20, 1994 meeting, the City Council requested a status report on the preparation Qf a notice of violation to be sent to BKK, regarding the lack of compliance to the conditions of the Unclassified Use Permit for the landfill. Staff and the City Attorney are drafting the necessary document that includes specifics and appropriate time-? frames for corrective actions: It is expected this draft will be completed by the first week in January. After final review, it wi11 be sent to BKK the week of'January 9. When it is sent to BKK,.copies will be sent to the City Council. As stated in the December 20, 1994:staff report, the notice must specify the condition violated, the reason for the violation, and a period of time to correct each violation. After the notice is received by BKK, they must correct the violations. If the violations have not been corrected within the time specified or there are violations which cannot be corrected, then the City Manager may take one or more of the following actions: Request the City Council to refer the matter to the Planning Commission for a hearing on possible revocation, suspension or modification of the Unclassified Use Permit; and/or Fine BKK according to the fine schedule in the Unclassified Use Permit.. Any of these actions may be appealed to the'City Council according to the provisions.of the Unclassified Use Permit. If any City Council.member has any further input to or questions of staff, please contact staff immediately. RECOMMENDATION It is recommended that the City Council -receive and file this report.
