DISCUSSION: [Note: The updated changes from the November 15, 2005 report are in BOLD text] Ise W C. Interim Agreement with State The Department of Toxic Substances Control (DTSC) continues to enter into "Interim Consent Agreements" (Agreement) with a substantial number of Potentially Responsible Parties (PRPs) at the BKK site. Under these Agreements the PRPs have been paying DTSC $500,000.00 every month to cover interim costs of monitoring the landfill. Long Term Plan and Agreement with State A Consent Decree has been entered into between DTSC and the large PRP group of about 27 companies. The Consent Decree is for two years, at which time, the PRP groups signing the Consent Decree will take over the running of the entire site and develop a longer -term or permanent solution. Attached is a copy of the Consent Decree Fact Sheet also available in Spanish, Mandarin and Tagalog (Attachment A). DTSC staff will continue to oversee the landfill oversight operations and the Consent Decree information will be posted on DTSC's website which can be linked from the City's website. Proposition 65 Notices Attached is a copy of the December 21, 2005 and January 10, 2006 (address correction), Proposition 65 Vinyl Chloride Gas Emission Public Notice (Attachment B) sent out to residents within the affected area south of the Class I Landfill. Four previous notices have been sent on December 21, 2004, March 21, June 21, 2005 and September 21, 2005. Proposition 65 public notices are triggered when vinyl chloride gas emissions are greater than 0.05 ppbv (parts per billion by volume). Much of the data is showing levels at the non detect range but because of the one year rolling average Proposition 65 notices will continue every three months until the level drops below 0.05 ppbv. Attached are copies of DTSC's November 2005 Fact Sheet (Attachment C) which includes a map of air monitoring locations) in English, Tagalog, Spanish and Mandarin addressing the Proposition 65 notices. Also attached is a copy of the City's letter dated September 20, 2005 (Attachment D) requesting DTSC for a detailed response to our questions and (Attachment E) is a copy of DTSC's detailed response dated September 29, 2005. Pasmant, City Manager February 7, 2006 and City Council At the request of the City Manager, a conference call was arranged with DTSC to provide the City with an understanding of why the Proposition 65 notices continue and the number of homes impacted keeps increasing. Attached is DTSC's brief summary report (Attachment F) of the conference call. Per DTSC, overall past history of emission repair work has been temporary, not permanent. Long-term repairs are needed and costly. BKK's gas recovery system design is not the best hence needing continued maintenance and repairs. The Department of Toxic Substances Control (DTSC) is taking this warning seriously and has implemented some mitigation measures such as daily inspections, vegetation clearing for better monitoring, increasing gas control line maintenance and repair measures, etc. DTSC continues to assure the City that this warning IS NOT an immediate health threat to residents. D. Bankruptcy Status Staff continues to monitor the court filings 'as to whether BKK has actually filed bankruptcy. At the time of this report there was no bankruptcy filing. E. Interim Class III Landfill Closure and California Integrated Waste Management Board (CIWMB) Coordination The City and Community Development Commission (CDC) are continuing to work with the California Integrated Waste Management Board (CIWMB) to implement the final closure of the Class III Landfill so as to move along as efficiently as possible the 100- acre development project the City purchased from BKK. Because of BKK's poor financial status and inability to complete Final Closure construction with the remaining funds in accordance to the approved Final Closure Plan, the CIWMB, Regional Water Quality Control Board and the City of West Covina Waste Management Enforcement Agency have approved a revised Interim Final Closure Plan that will achieve a minimum closure in compliance with the State minimum standards. Interim cost reductions were obtained by reducing the 7.5-foot vegetative cover soils to 5 feet including reduced vegetation and irrigation. Per Resolution #2005-151, the CIWMB allocated $1.2 million to help fund the completion of the Final Closure. The approved revised Final Closure Plan has been sent to the City of West Covina and City of Walnut Public Library to be available for public review. There continues to be inadequate funds to complete the interim Final Closure with 5 feet of vegetative cover soil. Water Quality will consider the reduction from 5 feet to 2.5 feet of vegetative cover soil upon BKK's demonstration to the Board as to why the reduction is necessary and that it will comply with the regulations in preventing water infiltration. The State's minimum standard of vegetative cover is .1 foot. The CIWMB's main goal and objective is to complete final closure of the Landfill with the remaining available final closure funds. It is the WMEA's understanding that the CIWMB's intent is to close the Landfill with 5 feet of vegetative cover knowing that because of the lack of adequate funds, there may be some areas of the landfill's top deck with as little as .2.5 feet. The further reduction down to 2.5 feet vegetative layer has significant fiscal impacts. on the cost of the entire 100-acre development project including the Golf Course. In addition, the City's Waste Management Enforcement Agency (WMEA) has raised many environmental questions that need resolution prior to approving the vegetative soil 2 • • Andrew G. Pasmant, City Manager February 7, 2006 and City Council layer reduction to 2.5 feet such as gas emissions, protection of clay cap, water intrusion, thickness of clay cap, moisture content_ retention, Water Quality's justification for the reduction if approved, etc. Attached is a copy of the WMEA letter to Mr. Scott Walker of the CIWMB (Attachment G). Yeager Shanska is the contractor implementing the construction of the final cover. Final cover construction activity has begun and is expected to continue through January and February with weather permitting. Heavy construction equipment will be seen from Azusa Avenue moving.soil throughout the site. F. City's Proposed Commercial Development As reported to you on July 5, 2005, the Community Development Commission (CDC) has had to undertake the BKK obligation required by EPA to conduct an investigation and characterization of an area in the southerly 30 acres of parcel one to determine whether there exists contaminated soil. The results of the soils investigation indicate that approximately 3,000 cubic yards of contaminated soil existed within the commercial site (southern 31-acres of Parcel 1). The CDC hired Camp Dresser & McKee ("CDM") to prepare a remediation work plan for the contaminated soil to be analyzed for appropriate disposal at the BKK Class III Landfill or an off -site Hazardous Waste Landfill. The contaminated soil has been removed and disposed of at the BKK Landfill and we are now waiting for USEPA to confirm and certify that the proposed commercial site is free from contamination prior to transferring the site to the commercial developer. The only outstanding issue pending is for CDM to discharge the excess groundwater removed during the soil excavation project into BKK's million -gallon reservoir for irrigation and obtain USEPA's certification that the site is free from contamination. To date, BKK has commenced landfill closure grading on Parcel 1 (100-acre site) including substantial completion of the rough grading for the southern portion of the proposed commercial pad area. BKK plans to continue rough grading the area located north of the existing BKK access road, which is where the remainder of the commercial development pads are located. G. Landfill Underground Storm Drain Repair DTSC continues to repair the failed underground storm drain system on both the Class I and Class III landfills. The Class III project is expected to be completed by February 2006, with the remainder to be completed next summer. H. USEPA Groundwater Contamination Corrective Action In February 2000, USEPA has selected a remedy decision to contain and control the BKK Landfillfacility-wide contaminated groundwater. USEPA also approved the Corrective Measure Implementation Plan (CMIP) in June 2004. Because of BKK's financial status, BKK is unable to pursue implementation of the remedy, therefore, this project continues to be on hold until resolution is reached with respect to funding. The routine monitoring of groundwater wens will continue. CONCLUSION I will bring the City Council up-to-date with any new matters that arise between the date of this report and the City Council meeting. 3 • • Andrew G. On October 31, 2005, DTSC filed a complaint in United States District Court, Central District of California, Docket No. CV05-7746 CAS against a number of defendants under the provisions of the Comprehensive Environmental Response, Compensation, and Liability Act, 42 U.S.C. §§ 9601 et seq. and the California Health and Safety Code section 25358.3 (e). The Consent Decree is intended to resolve the liability of the defendants for: certain DTSC past and future response costs; and for oversight costs that DTSC will incur during the time that the defendants' conduct site activities. The Consent Decree obligates the defendants to conduct certain work at the BKK Landfills Facility for slightly less than two (2) years. The Consent Decree provides covenants not to sue and contribution protection for these costs and work, and provides for standstills and tolling of enforcement activity and litigation among the parties. DTSC has extended the public comment period on the Consent Decree by an additional seven (7) days from January 6, 2006 to January 13, 2006. The public comment period began November 12, 2005, and now ends on January 13, 2006. Written comments on the proposed Consent Decree must be submitted on or before 5:00 p.m. January 13, 2006. This is the fourth extension of the public comment period. On December 13, 2005, DTSC extended the end of the public comment period from December 13, 2005 to December 20, 2005. On December 20, 2005, DTSC extended the end of the comment period from December 20, 2005 to December 30, 2005. On December 30, 2005, DTSC extended the end of the comment period from December 30, 2005 to January 6, 2006. DTSC may modify or withdraw its consent to the Consent Decree if such comments disclose facts or considerations that indicate the proposed Consent Decree is inappropriate, improper or inadequate. Please make your check or money order payable to the Department of Toxic Substances Control and mail it to Ms. Aquino in DTSC headquarters at the address shown above FACT SHEET, November 2005 BKK Landfills Facility Consent Decree The BKK Corporation (BKK), owner and operator of the BKK Landfills Facility (Facility), notified the Department of Toxic Substances Control (DTSC) in October 2004 that BKK did not have sufficient funds to continue operating and maintaining the closed Class I Landfill (hazardous waste) and leachate treatment plant beyond mid -November 2004. DTSC began an emergency response action in November 2004 to ensure the continued essential day-to-day maintenance activities of the Facility. The Facility is located at 2210 South Azusa Avenue in the City of West Coving. DTSC issued an order in December 2004 to 51 companies and pubic agencies, called "responsible parties." Most of these parties disposed of hazardous waste at the Class I Landfill. Over the past year, DTSC has met with the largest group of responsible parties, composed of 27 companies and one public agency, to negotiate financial support, day-to-day operations, and maintenance and monitoring activities at the Facility. Recently, DTSC and this group of responsible parties reached an agreement called a consent decree. A consent decree is a judicial order that is negotiated and agreed to by the parties and submitted to the court for approval. After it is approved and finalized, it has the force of a court order. The California Attorney General's Office on behalf of DTSC, filed the BKK Consent Decree (Decree) with the Federal District Court, Central District of California, on October 31, 2005. BKK Consent Decree Summary Ocu The BKK Consent Decree is an interim agreement for almost two years that f allows the parties to develop a longer -tern solution for conditions at the Facility. gyp, The Decree requires the 27 responsible parties to perform essential maintenance work at the Facility shortly after the Decree becomes effective or an earlier date if the responsible parties want to begin work sooner. The Decree also requires 'x' 4 them to fund a portion of DTSC's activities at the site and it includes a number of other legal terms and conditions. The Decree can be viewed at www.dtsc.ca_gov. The BKK facility is located at 2210 South Azusa Avenue in the City of West Covina. On December 21, 2004, March 21, 2005, June 21, 2005, and September 21, 2005, BKK issued Proposition 65 warnings to certain residences in West Covina near the south end of the landfill. The letters informed -the residents that the 24-hour average concentration of vinyl chloride in the vicinity of their homes during the preceding year exceeded 0.05 parts per billion (ppb). BKK sends Proposition 65 notices to residences based on a calculation of average vinyl chloride concentrations. The calculated average determines the number of houses that receive notices. Under Proposition 65, a business is required to give a clear and reasonable warning to anyone who may be exposed to a listed chemical above a specified level. The Proposition 65 level of 0.05 ppb for vinyl chloride is essentially an early warning system designed to let people know that a problem may exist that needs attention. This level indicates that a person who is exposed to 0.05 ppb vinyl chloride in the air over a lifetime of 70 years may have a one in one -hundred -thousand (1 /100,000) chance of developing cancer. The number of residences in West Covina receiving proposition 65 notices increased from 18 in June 2005 to 44 in September 2005. This increase is due to unusual elevated readings for vinyl chloride that occurred on June 7, August 2 and 23, and September 7, 2005. The higher readings on four days increased the 24- hour average concentration, thereby increasing the number of notices sent by BKK. BKK's estimates of vinyl chloride concentrations at affected residential properties s' r'r ::;e3 cn samgl;ng rt;s-uIts ohiauie<i from twelve air monitoring stations irientified on the attached map. At the "Nogales End Station" (Station 3) vinyl chloride levels during the past 12 months have ranged from not detected to a high of 0.645 ppb on June 7, 2005. At the "Amax at Nogales Station" (Station 11), vinyl chloride levels ranged from not detected, to a high of 0.2090 ppb on June 7, 2005. In most cases, the highest readings for vinyl chloride at Nogales End correspond to unusual events at the site. The high readings obtained on June 7, 2005 were due to a power failure that temporarily shut down the upper flare station and a booster blower at the Nogales End. The high result recorded on August 2 may have been related to excavation proceeding at that time just above the Nogales End Station. The elevated reading on September 7 was due to a temporary loss ofpower that occurred when a contractor performing work on the Class III portion of the landfill accidentally broke a 12-inch gas collection header line. The average concentration of vinyl chloride over the past 12 months is well below the 0.05 ppb warning level at all. stations except the Nogales End Station where the average time - weighted concentration over the past 12 months has been 0.1262 ppb. These levels do not pose an immediate health threat to the residents in the area DTSC's contractor is continuing work to reduce the emissions. Examples are: • Gas collection wells have been rehabilitated; • Gas extraction from the Class I landfill has been increased; • Vegetation on the Class I landfill cap has been cleared to help the landfill cap irrigation system minimize drying and cracking of the Class I landfill cap; • Portions of the landfill cap from which gas may be escaping are being identified and repaired; • Repairs on the South Haul Road storm drain system have started and should be completed by the end of October, • A new gas extraction line was installed on the South Haul Road on September 9 and is now operational; • A new large capacity blower to increase vacuum on perimeter gas collection wells will be installed in the near future to help reduce gas emissions; and • Repairs to the upper and lower flare stations will begin in October. Los cilculos estimadvos de BKK pars las concentrations de cloruro de vinilo en las propiedades residenciales afectadas se basan en los resultados de las muestras tomadas en dote estaciones de monitored de aire identificadas en el maps que se adjunta. En la estacion <Nogales End Station (Estacion 3) los niveles de cloruro de vinilo durante los 12 meses pasados han fluctuado desde no detectado hasta el nivel elevado de 0.645 ppb, to que ocurrio en Juno 2 del 2005. It is to our knowledge that DTSC has been overseeing the maintenance and repairs, in an effort to control and reduce the emissions below the Proposition 65 reporting levels. We understand that the vinyl chloride emissions levels have now exceeded USEPA'S 1994 vinyl chloride response action. Thank you for your September 20, 2005 letter regarding the Proposition 65 warning letters on vinyl chloride recently issued by the BKK Corporation (BKK) to 44 residences near the BKK landfills. You asked specifically for a detailed account of all repair work performed by the Department of Toxic Substances Control (DTSC) to address vinyl .chloride releases. Also, you asked why air monitoring data show continued increases in vinyl -chloride emissions rather than reductions, and you requested an explanation of how DTSC is coordinating with the United States Environmental Protection Agency (U.S. EPA) to implement BKK's response action plan. I appreciate your interest in these subjects, and I am happy to respond to your questions. Let me begin with some background information that will help put the problem. in perspective. BACKGROUND The gas collection and monitoring systems are large and complex. The landfill gas collection and monitoring systems consist of several thousand gas extraction wells, most of which were installed vertically, either through the clay cap into the waste prism, or into native soils. Each well is connected to horizontal pipes (headers) that range in size from 8 to 24 inches in diameter, and that are under vacuum. The headers convey collected gases to one of the two flare stations on the site, or to the cogeneration facility operated by Minnesota Methane. Literally miles" of gas collection pipes traverse the facility. In addition to the aforementioned wells, a series of perimeter probes are instaft.1, along t to exterior boundary of the Ciass I landfill. These probes. extend to depths between 5 and 200 feet below' the ground surface, and occur in clusters of 2 to 5 probes every 300 to 500 feet. 0 Printed on Recycied Paper Mr. Steven L. Samaniego September 29, 2005 Page 2 Ambient air samples are collected at 12 fixed locations around the 583-acre facility. Ambient air samples have been collected at the facility for many years. Over the last several years, the highest concentrations of vinyl chloride have occurred at the Nogales End Station (designated as Station •3" on the enclosed map). The 12-month rolling average for vinyl chloride detected in ambient air from Station 3 decreased from 1994 to below 0.05 parts per billion by volume (ppbv) in 1997, and remained well below that level until 2002. In August 2002, vinyl chloride averages began to trend upward. In September 2004, the 12-month rolling average climbed above 0.05 ppbv and has continued to increase at an approximate rate of 0.01 ppbv every 5 months. For the period running between September 27, 2004 and September 7, 2005, the 12-month rolling time -weighted average for vinyl chloride at the Nogales End was 0.1262 ppbv. By comparison, vinyl chloride levels ranged from 5 to 990 ppbv during the 1984 evacuations. DTSC's Activities Since initiating its emergency response action on November 18, 2004, DTSC has implemented a number of measures aimed specifically at addressing vinyl chloride emissions. The measures include: • cutting vegetation on the Class I landfill benches to improve irrigation system efficiency in order to minimize drying and cracking of the landfill cap; • repairing Class i landfill irrigation lines and sprinkler heads; • rehabilitating 22 dual phase gas/leachate extraction wells that were non -operational. - inspecting gas lines .to identify and repair leaks; • increasing the frequency of air monitoring at all stations; installing two additional air monitoring stations along the eastern boundary of the facility to assess any vinyl chloride releases toward the City of Walnut and the proposed Standard Pacific Homes development project;' • investigating impacts of varying gas line vacuum pressure levels initiated by BKK/Minnesota Methane in October and November 2004; w • initiating work on the replacement and repair of the storm drain system; and ° DTSC installed these air monitoring stations in April 2005. They are shown as stations "B" and "14" on the enclosed map. • Mr. Steven L. Samaniego September 29, 2005 Page 3 • installing a new landfill gas collection line along the South Haul Road above the Nogales End area. In addition, DTSC plans to move ahead with the purchase of a new large capacity blower to increase the vacuum of perimeter wells, and has issued. a work order to its contractor, Engineering/Remediation Resources Group, Inc., to upgrade the flares at both the upper and lower flare stations. As noted in the March 30, 2005 letter.you received from Mr. Donald Plain of DTSC, the BKK landfills have many potential sources of gas releases. These include leaks from the South Haul Road storm drain, drop inlets running under bench roads, gas line vaults, the cap, poorly seared gas wells, gas lines, and inefficiencies in the landfill gas collection system. Inspections are conducted daily and problems are fixed when discovered. We think the Class IiI closure activities now underway may also be contributing to vinyl chloride readings and will be discussing that concern with the Integrated Waste Management Board in the very nearfuture. The measures described above should each incrementally improve the situation and we hope to see those changes reflected in weekly monitoring results relatively soon. Vinyl Chloride Data As I discussed with you by telephone on September 20, P 2005, BKK uses a simple isopleth drawing method in which concentrations in ambient air at locations removed from the air monitoring stations are assumed- to be mathematically proportional to distance from the monitoring stations, without consideration of factors that attenuate gas concentrations. Higher numbers tend to increase the mathematical average, thereby increasing the number of notices sent by BKK. The increase in the number of Proposition 65 notices issued by BKK from 18 on June 21, 2005 to 44 on September 21, 2005 is due to unusually high results that were factored into the calculation of the annual 24-hour rolling average. A reading of 0.6450 ppbv occurred on June 7, 2005. That high result was caused by a temporary power failure that shut down the flare stations and a booster blower at the Nogales End. The 0.4280 ppbv result for September 7, 2005 was likely due to a temporary shutdown of the system caused when Yeager Construction, a contractor engaged in Class III closure operations, ran over and broke a 12-inch gas collection header line on the Class III facility. The 0.3090 ppbv reading obtained on August 2, 2005 may have been due to the excavation of a trench near the Nogals End. The cause of the 0.4990' ppbv reading obtained on August 23, 2005 remains unclear. Despite these high results, the average concentration of vinyl chloride over the past 12 months is well below the 0.05 ppb warning level at all stations except the Nogales End Mr. Steven L. Samaniego September 29, 2005 Page 4 Station where the average time -weighted concentration of the past 12 months has been 0.1262 ppb. These levels do not pose an immediate health threat to the residents in the area. Response Action Plan The "Response Action Plan for Vinyl Chloride" (the Plan) that you refer to is a document prepared by BKK on July 21, 1994 and approved by U.S. EPA on August 4, 1994, as part of a remedial action plan prepared by BKK in response to a corrective action order issued by U.S. EPA. The Plan identifies particular response actions that will be taken if vinyl chloride concentrations exceed specified levels. For example, it states that if vinyl chloride levels range from 0.5 to 1.0 ppbv, BKK will review its operational activities, looking first for anomalies in activities such as excavations and equipment breakdown. Other examples of responses to levels of vinyl chloride between 0.5 and 1.0 ppbv include the repair of damaged wells. Additional measures are prescribed for BKK when vinyl chloride levels range between 1.0 and 2.0 ppbv, and between 2.0 and 10.0 ppbv. As you can see from the preceding discussion, the measures DTSC has taken in response to vinyl chloride emissions below 1.0 ppbv at the Nogales End far exceed the measures called for by the Plan that BKK is actually responsible for implementing. I hope the foregoing answers are useful to you, and provide you with a better understanding of the various measures taken and planned by DTSC to address vinyl chloride emissions at the BKK landfill. DTSC takes this problem very seriously, and is doing all it can to identify the source(s) of the releases and take appropriate corrective measures to address those releases. This information is based on landfill sweeps using methane (CH4) as an indicator. 3) Some re -design and replacement work will be needed at the facility. 4) The Class III landfill is likely a recent contributing source of vinyl chloride to some of the air stations, but it is not a sole source. DTSC reviewed the Class III landfill sampling efforts with the City representatives. 5) ERRG has been told that when BKK conducted the sampling in years prior to initiation of DTSC's emergency response action in November, 2004, BKK may have irrigated the landfills prior to sample collection, which would have potentially suppressed landfill gas emissions over the short term. ERRG has.made a conscience effort to NOT follow this alleged BKK procedure, which was not consistent with the intent of US EPA's air monitoring requirements (EPA requires that no samples be collected w/in a 72 hour rain event). 6) DTSC explained the gas extraction trench on the South Haul Road. 7) The current vinyl chloride response is consistent with US EPA's 1994 BKK response action plan. 8) DTSC is looking for additional sources of vinyl chloride and plans to focus on down drains. 9) DTSC gave an update on the Consent Decree and PRP involvement. 10) DTSC reported that BKK has indicated that approximately 100 homes will receive Prop 65 notices in the near future. 11) DTSC will continue to update the City on vinyl chloride mitigation efforts and keep the City posted on any new findings. 0 ATTACHMENT G Environmental Management Department August 23, 2005 Mr. Scott Walker, P.E. Box 4025 Sacramento, CA 95812-4025 Re: BKK Landfill Class III interim Final Closure and Postclosure Maintenance Plans - January 17, 2005 Dear Scott: As a follow-up from our conversation August 16, 2005, I would lice to address the Local Enforcement Agency's (LEA) concerns regarding any proposed further reduction of the interim approved 5-foot vegetative cover soil for the BKK Class III Landfill. On February 5, 2005, the Regional Water Quality Control Board for the Los Angeles Region (RWQCB) conditionally approved a reduction in the thickness of the vegetative cover soil on the top deck from 7.5 feet to 5 feet. This reduction was based on the understanding that the final end use of the BKK Landfill was non -irrigated open space, not an irrigated golf course. Because of inadequate closure funds, the California Integrated Waste Management Board (CIWMB) is now considering further reducing the RWQCB approved 5-foot vegetative cover soil layer to 2.5 feet. It was the LEA's understanding that the RWQCB approved 5-foot depth was the minimum reduction the Board would consider and that they were reluctant to go lower than 5 feet. The citizens in West Covina have had a great sense of comfort in terms of public health and safety with the State agency's requirement of a 7.5-foot vegetative cover soil cap approved in the November 1997 (Revised) Final Closure and Postclosure maintenance plans. The public has voiced concerns over the initial reduction from 7.5 feet to 5.0 feet and needed reassurance that their public health and safety would not be jeopardized. The public accepted RWQCB's reduction with the understanding that that was the minimum reduction. Prior to any discussions or approvals of further reducing the approved interim 5-foot vegetative cover soil to 2.5 feet, the LEA would appreciate the CIWMB explaining in writing any additional proposed revisions to BKK's conditionally approved Class III BKK Landfill Interim 1444 W. In conclusion, the LEA shares the CIWMB's public health and safety objective to certify closure of the BKK Class III Landfill. Unfortunately, the CIWMB, RWQCB and LEA should not overlook any potential long-term impacts the citizens of West Covina may be subjected to from a closure certification that is inconsistent with the approved November 1997 (Revised) Final Closure and Postclosure Plan. The approved design has taken years to approve going through the required environmental planning and public review process to now be significantly changed without any due process provided for the public's input addressing their public health and safety concerns.
