THE WEST COVINA MUNICIPAL CODE
CHAPTER 26 (ZONING) AS IT RELATES
TO WATER EFFICIENT LANDSCAPING.
(AMENDMENT NO. 252)
SUMMARY: - At the December 15, 1992 City Council meeting an
ordinance was introduced which would amend the West Covina
Municipal Code Chapter 26.(Zoning) affecting three articles of the
code: Multiple -Family Zones, Nonresidential Standards,.and Overlay
Zones. The proposed amendment also includes the creation of a new
article entitled Supplemental Planning Requirements.

OVERVIEW:
The ordinance.before the City Council for adoption is in response
to Assembly Bill 325 entitled the Water Conservation and
Landscaping Act. This act was passed in 1990 and requires local
agencies to adopt a water efficient landscape ordinance by January
1, 1993 in order to conserve the state's limited. water supply. The
City is required to f ile a copy of .the ordinance with the State
Department of Water Resources by January 31, 1993.
RECOMMENDATION:
It is recommended that, the City Council adopt the following -
ordinance:

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA', AMENDING THE WEST COVINA MUNICIPAL
CODE, CHAPTER 26 (ZONING), AS IT RELATES TO WATER
EFFICIENT LANDSCAPING (Amendment No-. 252).
WHEREAS, in 1990, the State Legislature adopted Assembly Bill
325 (AB 325), titled "Water Conservation in Landscaping"; and
WHEREAS, AB 325 requires the State Department of Water
Resources to adopt a local model water efficient landscape
ordinance by January 1, 1992; and
WHEREAS, AB 325 requires local governments to adopt a water
efficient landscape ordinance by January 1, 1993, or the local
model ordinance shall become effective; and
WHEREAS, based on the State Legislation, the Planning
Commission on August 25, 1992, adopted Resolution No. 8-92-4104,
initiating the preparation of water efficient landscape standards;
and
WHEREAS, based on the Planning Commission direction and State
Legislation (AB 325), the City has undertaken the task of
developing standards for water efficient landscaping and irrigation
systems to fulfill the objectives of the State Legislation; and
WHEREAS, the increasing population growth in the region and
state as a whole, and its effects on infrastructure and natural
resources, demand more regional attention; and
WHEREAS, as a result of the -recent upswing in regional,
county, and statewide legislation, ARTICLE XIV - SUPPLEMENTAL
PLANNING REQUIREMENTS was developed to accommodate provisions that
address region wide mandates in the context -of local goals and
policies; and
WHEREAS, the Planning Commission upon giving the required
notice, did on the 24th day of November, 1992, conduct a duly
advertised public hearing as prescribed by law; and
WHEREAS, on November 24, 1992, the Planning Commission adopted
Resolution No. 11-92-4717, recommending that the City Council
approve Amendment No. 252; and
WHEREAS, the City Council of the City of West Covina
considered evidence presented by the Planning Department, Planning
Commission, and other interested parties at a duly advertised
public hearing on the 15th.day of December, 1992; and
WHEREAS, the oral and documentary evidence considered in
connection with the code.amendment reveal the following facts:
1. The waters of the State are of limited supply and are
subject to ever increasing demands; and
2. The continuation of California's and ultimately, West
Covina's economic prosperity is dependant on adequate
supplies of water being available for future uses; and
3. It is the policy of the State and City to promote the
conservation. and efficient use of water and to prevent
the waste of this valuable resource; and
4. Landscapes are essential to the quality of life in West
Covina by providing areas for. active and passive
recreation and as an enhancement to the environment by
cleaning air and water, preventing erosion, offering fire
protection, and replacing ecosystems lost to development;
and
5. Landscape design, installation, and maintenance can and
should be water efficient; and
7. All cities are being faced with issues such as
congestion, fuel waste, air pollution, preservation of
natural resources, labor force, economic development, and
population growth which transcend political boundaries
and therefore warrant regional attention; and
8. The establishment of Article XIV is necessary to balance
local with regional and State goals as well as balance
environmental issues,with urban growth; and
9. The establishment of Article XIV is' necessary to.foster
the continuation of local and state wide economic
prosperity which is dependent on adequate supplies of
natural resources being available for future uses.
NOW, THEREFORE, the City Council of the City of West Covina
does ordain as follows:
SECTION NO. 1: Based on the evidence presented and findings
set forth, Amendment No. 252 is hereby approved as consistent with,
the goals and policies of the General Plan and serves to further
implement the city's General Plan..-
. SECTION NO. 2: Based on the evidence presented and findings.
set forth, Chapter 26 (Zoning) of the West Covina Municipal Code is
hereby amended as stated in Exhibit I attached hereto and
incorporated therein
SECTION NO. 3: The project is considered a categorical
exemption pursuant to Section 15307 (Class 7) of the Calitornia
Environmental Quality Act (CEQA) in that it is the result. of
actions .taken by a Regulatory Agency for the protection of natural
resources; and
SECTION NO, 4: The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published as required
by law.
