RECONINIENDATION
It is recommended that the City Council review the Letters of Interest submitted to fill the
vacancy on the City Council for the term ending November 2013 and elther fill the vacancy on
the City Council by appointment or provide other direction to City staff.
DISCUSSION
At [lie Cit}- Council meeting of .January 15, 2013 options for Tilling the vacant City Council seat
were presented to the City Council for their review and discussion. By unaninnous vote, the City
Council' opted to accept Letters of Interest ("Letters") from residents wishing to till the vacancy
i:or the remainder of the unexpired term. Letters were to be submitted to the City Clerk's Office
within a seven (7) day period, no later than January 23, 2013 at 5:30 p.m.
The only requirement of an individual to be appointed to till the vacancy is they must be a
registered voter of the City at the time of their appointment. Letters received were reviewed by
the City Clerk's Office to determine the interested person is a registered voter residing in West
Covina and therefore meets qualifications to serve as a city councilmember in West Covina.
I_.etters were forwarded to the City Council and are attached for City Council for their review and
consideration. It was left to the discretion of each councilmember as to their review process or
interview process.
It ShOUld be noted that the City COLInCiI is not bOLInCI to make an appointment from the Letters
received. Options to till the vacant City Council seat are set forth by California Government
Code Section 36512(b) (Attachment A). The City Council must exercise their options within 60
days from the commencement of the vacancy, no later than March 8, 2013.
OPTIONS
The following options are available for City Council's consideration:
1. bill the vacancy by appointment prior to March 8, 2013 by selecting, an individual to Fill
the remainder of the term expiring November 2013.
2. Call for a special election not later than February 9, 2013 to ill the vacancy at a special
election to be held on June 4, 2013, the next established election date no sooner than 1 1 d
clays from the call of the election.
3. 'Take action after February 9, 2013 to not make an appointment or call for a special
election, whiCh would result in the council seat remaining vacant until the November
2013 general municipal election.
d. Do nothing prior to March 8, 2013, which would also result in tine council seat remaining
vacant until the November 2013 general municipal election.
FISCAL IMPACT
There is no fiscal impact if the vacancy is filled by appointment to serve the remaining unexpired
term. A cost estimate to hold a special election consolidated with the Los Angeles County election
on June 4, 2013 for one council seat only has been requested but not received as of the date of this
report. A projected estimate election cost could range from $129,000 (cost provided to conduct a
possible special election in 2012) to $275,000 (actual 11/08/2011 election cost). Election costs
vary by the number of agencies sharing costs of an election.

(a) if a vacancy occurs in an appointive office provided for in this chapter, the council shall fill
the vacancy by appointment. A person appointed to fill a vacancy holds office for the
unexpired term of the ,former incumbent.
(b) If a vacancy occurs in an elective office provided for in this chapter, the council shall;
within 60 days from the commencement of the vacancy, either fill the vacancy by
appointment or call a special election to fill the vacancy. Tile special election shall be held
on the next regularly established election (late not less than 114 days from the call of the
special election. A person appointed or elected to fill a vacancy holds office for the
unexpired term of the former incumbent.
(c) Notwithstanding subdivision (b) and Section 34902, a city may enact an ordinance that
does any of the following:
(1) Requires that a special election be called immediately to fill every city council vacancy
and the office of mayor designated pursuant to Section 34902. Tile ordinance shall
provide that the special election shall be held on the next regularly established election
date not less than 114 days from the call of the special election.
(2) Requires that a special election be held to fill a city council vacancy and the office of
mayor designated pursuant to Section 34902 when petitions bearing a specified number
of verified signatures are filed. The ordinance shall provide that the special election
shall be held on the next regularly established election date not less than 114 days from
the filing of the petition. A governing body that has enacted such an ordinance may
also call a special election pursuant to subdivision (li) without waiting for the filing of a
petition.
(3) Provides that a person appointed to fill a vacancy on the city council holds office only
until the date of a special election which shall immediately be called to fill the
remainder of the term. The special election may be held on the date of the next
regularly established election or regularly scheduled municipal election to be held
throughout the city not less than 114 days from the call of the special election.
(d) (1) Notwithstanding subdivision (b) and Section 34902, an appointment shall not be made
to fill a vacancy on a city council if the appointment would result in a majority of the
members serving on the council having been appointed. The vacancy shall be filled in the
manner provided by this subdivision.
(2) The city council may call an election to fill the vacancy, to be held on the next regularly
established election date not less than 114 days after the call.
(3) If the city council does not call an election pursuant to paragraph (2), the vacancy shall
be filled at the next regularly established election date.

By way of this letter I wish to express my interest to be appointed to the vacated city council seat with
the term expiring in.November 2013.
I am a lifelong resident of West Covina. I was born in the city, grew up in the city, bought a home in the
city, volunteer in the city and my wife and I are currently raising our child in the city. I am as "home
grown" as they come. West Covina is a great city and will continue to be great by decisions that are
made by the body of the City Council and the residents of the city.
I understand the importance of being active in the community and doing what you feel is right for
everyone and not just one person. The benefits of the many far outweigh the benefits.of the one. In
three years on the board of directors for Pacific Coast Little League we were able to turn around the
poor decisions of the past and bring back the core values of the league as a whole. We were able to pay
off all outstanding debts and restore financial responsibility to a league that was plagued with bad
business decisions and poor cash management. I also served on the Little league District 19 board of
directors which over saw all of the Little Leagues in West Covina and many in the surrounding cities.
This allowed me to work with other leagues and help them with similar things that I was involved with at
Pacific Coast Little League.
I have been appointed twice to the office of Commissioner for the City of West Covina. I currently serve
on the Community and Senior Services Commission and had the honor of meeting all of you several
times and the pleasure to sit down and discuss topics that are near and dear to not only my heart but
yours as well. I enjoy being a representative of the city and look to further that wo.rk by becoming one
of your colleagues.
I have several areas of the city that are important to me as a citizen and resident. I have a strong belief
in the youth sports of the city. While I don't think everything regarding youth sports should be rubber
stamped, I am very supportive of the various leagues and associations within the city. I have a love of
our parks and open spaces. I do not want to live in a concrete jungle as some other cities have become,
but I also believe that responsible development is important too. With all things there must be a give
and take approach and while it may not be popular, it must be the right thing at the right time.
We have a beautiful city with great residents and they love to share where they live. People I know love
that we have great streets in well maintained fashion and low amounts of graffiti compared to other
local communities. I believe we have one of the best Police and Fire Departments in the area and I do
not want to lose them. I want to find ways to increase the amount of officers for both departments_ so
that we continue to have a safe community. I want to find ways to keep their equipment needs -met
with new tools and vehicles to do their jobs.
As you can see I am vested in the community. I have spent my whole life here and with my wife we are
raising our family here.. I have volunteered in the community and will continue to volunteer in the
community regardless of this appointment opportunity. This city is my home and home to all of you so
you understand that love and dedication first hand.
In conclusion, I want to thank you for the opportunity to submit this letter and for your consideration. I
have seen this city change over my Lifetime and know it is time to for me to assi st in the future. I have
experience in dealing with budgets in tough times and in leadership. I am always ready to bring ideas to
the forefront that could help improve or solve a situation. I love a challenge and have a strong work
ethic. I listen/review everything and then make a decision. Everyone may not like my decision, but it
will be my decision each and every time. With our continued involvement we will continue to be a

can do the job, and can connect with the residents of West Covina.
I have been involved in our city for a long time, I have seen a lot of great things happen in our city. I
would love to be part of building our city back up to what it used to be
In 1994 1 held a protest against pillowcase rapist that was being paroled in West Covina, In front of
the parole office on Badillo. To keep him from being paroled in West Covina.
I was very involved in getting the parole office out of West Covina on Badillo
In 2002 1 was involved with the sex offender Conklin. Protest. I went over to South Hills High School,
and talked to the residents,
I told them I would come and help them in any way I could even though I lived on the other side of
our city. Because our whole city is very important to me, not just part.
In 2005 1 helped stop -DC Corp from building 72 homes on San Bernardino rd. which would have
closed some business there.
I was against Booze for sale in gas stations,
I was against measure D. I
I have set in on contract negotiations when I worked in my union
I believe friendship between council members shouldn't have anything to do with how you vote on any
item in front of the council.
I have been involved in our city for along time not out in front,where everyone knew what I was doing.
That isn't why I did what I have been doing, the reason is I really care about this great city.
I would hope this council is looking for someone that will work with all our council members, will
decide on any item that comes before this council on its merits.
I know this council and I have had our difference in the past,and we probably will in the further.
If your looking for a person who will be a yes sir no sir person, then I am not your person,
But if your looking for a person that will have a open mind on any item that comes before the council.
And won't be afraid, to vote on a item no matter who is for it or against it, as long as it is in the best
interest of our city, and our residents.
Then I am the person who will be honored to serve, Our great city.
Real friends will tell you things that you really need to here, fake friends will tell you only what you
want to here. Make sure you can tell the difference.
Please choose a new council member thart has proven them selfs that they really care about bur great
city. Not someone who just throws their name in and says they care about our city when there is a
opening for a council seat. And has never been involved before.
I hope you will choose a person who the residents of West Covina will stand behind, and have the
ability to get elected when their term is up in 2013
1 am a disabled Vietnam veteran, who has fought in some tough battles. I can take the heat that this
seat gets, I know I will decide on any item on its own merits .
I will always make decisions on what is best for our city and residents. We must find ways and
means to keep our police department no matter what.
Our city has seen a lot of it's personal laid off because of the economy, we must find ways to stop
from loosing any more employees .
I am the person that most of the residents can get behind, when there are very difficult decisions to
make because they know I real always be truth full.
Any decision I make will never be based on friendship, I will decide with other council members when
I feel they are right. And vote against them when I feel they are wrong.
The residents of West Covina deserve a council member who has their best interest at heart. They
don't have to be the smartest person in the room.
They have to be a very good listener, they have to be smart enough to listen to our staff, the
decisions they make are made on facts.
Even if the staffs decisions are made on facts as a council member you must decide if they are in the
best interest of the city and it's residents.

As a Community Services Commissioner since late 2009.1 have had the distinct honor of
being able to give back to my community. Although my youth puts me in a distinctly small
demographic of individuals Nvho actually pay attention to, much less attend, cite council
meetings, I fee] that my youth puts me in a unique position to provide new leadership and ideas
to a community which I have called my home for most of my life.
The reason I desire the opportunity for such a leadership position is not because I have
any desire for a long; protracted political career, but because this cite is most assuredly in need
of new ideas and someone with the intestinal fortitude to see those ideas through. As someone
who is both educated and versed in the structural issues within our city? s budget, I am in a
unique position to inunediately contribute to solving this city's fiscal issues while presenting my
ideas and thoughts coherently and succinctly.
For those of you who do not know me or; at least; do not know me well enough to make
an informed decision about my candidacy; I challenge you to find someone with more education
and more knowledge about state and local government procedure; process and law than myself;
stereotypical cultural assumptions regarding age aside.

commission to find meaning in what we do during times where the Community Services

Although 1 have lived in West Covina my entire life, 1 feel that appointment to the Council requires much more than long-
term residency within the Citylimits. The position requires a real love for the community knowledge of what it will take
to help it thrive, and the strength to help it succeed. Because Ihold each of these attributes,. I feel that I am an ideal fit for
the position and should serve theCity and community by assuming the role.
Since graduating from the University of Southern California in 2004, I have held several positions in both the public and
private sector which have helped me prepare for assuming a role as Council Member.. Afterobtaining:-my degree in
Planning; Public Policy and Development from USC, I worked as a Project Coordinator for LePlastrier Development
Company, where I learned about the due diligence and entitlements processes in Southern California.
Thereafter, I assumed a role alongside my father at The McIntyre Company, a family owned and operated real estate
development company located in Covina. The McIntyre Company has been working with the Cityfor over 60 },ears and
has developed over 500,000 sq. ft of office space; 200,000 sq. ft. of retail space and over 1,000homes in the Covina area.
Having said that, lam very familiar with the City Council processes, the processes of the Planning Commission, and the
challenges that small businesses face when dealing with both organizations.
In addition to my*duties at The Mchatyre Company; I also currently sit on the board of many organizations in the greater -
Covina area including Citrus ValleyHealth Partners and Covina Irrigating Company:. Further, I recent)), assumed the
Chairman seat for The Covina Chamber of Commerce, and during my term I hope to continue to attract businesses to
thisarea.
Finally, together with help from my friends and family, l have found the time to give -back to. the City through
organizations such as Rotary International. . As a board member of our local Rotary club; I have played a role in
organizing several, annual chant), events including the Field of Valor, the Covina Fun Run, and the Covina Cares holiday
toy/food drive.

I believe that I have the Knowledge and Experience as well as the Willingness.io Serve the Residents And
the Business Community, of the City of West Covina in the Capacity of Councilmember.
As a Former Member of the City of Azusa City Council and Mayor Pro -Tern, from 1988-1997 1 served the
Residents of my Community, with Open Policy and Decision Making Process, as a Team -Player, Along
with all my Fellow Mayor and City Council & Staff. In which provided me the experience to make the
informed Policy decisions for the betterment of the Community as a Whole.
I have lived in the San Gabriel Valley all of my life. 40 years in the city of Azusa, and I love the Valley I
chose to make West Covina my Home one year ago, Because of the Pride and Diversity of the overall
community, and the overall. surroundings and city services that the community, has to offer. Not to
mention the mall and the proximity of the city to the La basin and the OC.
I believe that the city Needs someone that can from day one, take on the responsibilities of the office
with the needed knowledge and experience that I have to offer. West Covina like all Cities in our Fine
State are at a Cross roads of Financial uncertainty, with the Loss of redevelopment Agencies, coupled
with less and less County, State, Federal funds. Cities like West Covina need experienced leaders who
can look beyond the box for new and constructive ways to generate new Income sources and I truly
believe that my personal business experience and government experience qua Iifies me -for that job.
I from day one have the experience to understand budgets, and how to address public policy with the
fine balance of public interest, and political fallout.
1 have always and would continue to support public safety this is the main ingredient in the overall
success of bringing in new business and industry as well as new residents, and forging a strong
partnership with schools. This will help create a stable livable community for a II to enjoy.
I understand public policy and I enjoy working together with the city manager and staff on a daily basis
without micro managing their abilities, ensuring that the residents can always get the best service at all
times, something that I believe is missing in some cities And ensures effective maximization of the city
budget.

will take place after this term runs out. And I have the time and funds necessary to do this at the time
this seat is up for re-election.

This letter serves as notice of my interest to fill the City Council vacancy created by the
resignation of Michael Touhey.
I have been a West Covina resident and home owner for close to twenty years serving on the
West Covina Community Services Commission from 1995 to 2008.
Upon graduation from South Hills High School I attended Cal Poly Pomona where I earned a
Bachelor of Science Degree in Recreation Administration/Community Services. I continued my
education at Cal State Long Beach earning a Master's Degree in Public Administration in 1991.
My education has served me well in more than twenty-five years of municipal government
service in the Cities of Covina, Azusa, and Los Angeles where I've gathered a broad base of
knowledge in public works operations, transportation related issues, pension administration,
and the delivery of community services programs. The wide range of experience and liaising
with community based organizations underlies my knowledge of governing policies in general
and administrative and municipal budgeting activities encompassing a variety of funding
sources..
While the City continues to face many challenges now and into the future, West Covina has

By way of this letter, I am expressing my interest and strong desire to serve on the West Covina
City Council. it has been my honor and privilege to serve the City and its residents as a member
of the Planning Commission and Human Resources Commission. I was also able to Chair both .
commissions.
My desire to serve is not something I take lightly or do on a whim. in 2011, 1 was a candidate
for City Council, garnering more then 2200 votes. In 2009, 1 was president of Citizens United for
ALL of West Covina, leading the effort to defeat Measure D, the ballot initiative to divide the
city into 5 council districts. The measure was defeated by more then 2 to 1. 1 have also been
involved in several council campaigns over many years.
Our city, like so many others in California, is facing unprecedented financial woes. These issues
are not going to resolve themselves. It is going to require making tough decisions. I am fully
prepared to study the situation, weigh the alternatives, and make these decisions. The Council
working with our professional staff needs to focus like a laser beam on economic development.
Keeping business here, and making it very attractive for new business to come here. We cannot
and must not burden our residents with more taxes. We must retain our own Police and Fire
departments.
I am a proud member of the Hurst Ranch Foundation, the Barn Boys, West Covina Elks Lodge
#1996, NAACP San Gabriel Valley branch 41066, and the Gallup Panel.

In the early 1970's served on the Los Angeles County Master Trail
Planning Committee most of which is now called the Schabarum Trail.
From that experience became involved in the Walnut General Plan
update task force, and following was appointed a Planning Commissioner

Elected to the Walnut Cite Council in 1982 and sen7ed three four-year
terms. During this period also served three terms as hZayor and two as

The Cite of Walnut used a committee system for council members and

employees) as the corporation's Sr. Vice President, a corporate officer and
member of the board of directors for 12 years having a broad portfolio

o All marketing and communications;
o Government affairs that included an off -ice in Washington
DC;
o Real property acquisition and disposal, and;
o Regulatory compliance including environmental, safety
health.
Being responsible for all Government affairs and real property provided

offered a chance to be part of a management buy-out of Wyle

Goals of the Cite Council are broadly defined under `Quality of Life,
Responsive Government, Dedicated Public Service, Balanced Community,
Safety, Precautions, and Service and Municipal Leadership' and I
wholeheartedly support these goal statements. There is an important
balance between the elected officials (Council Members), staff experts
and board/committee/commissioners that is critical to any city and West
Covina is no exception. Currently the local and global economies are
struggling and a significant noticeable impact is on retail sales which in
turn effects local sales tax revenue needed for the General Fund. This.is
exacerbated by a financial crisis. at the County and State levels that also
impacts City revenue, so going forward the City of West Covina will be
challenged to continue providing needed services witli less revenue. All of
this is further impacted by the loss of the Redevelopment Agency as a
critical tool for new development. This paradox will require new thinking
and a new level of energy to create alternative solutions. The near -term
challenges are critical as over 80% of the City's resources go to the vital
area of public safety which is critical to the well being of any community.
I am offering to provide my time and energy to assist the city in a
productive way.

I would like to submit my name to fill the vacancy that exists on the City Council. Of course
three of you have seen much of this before. Here it is again.
I am J�Test CoN ina born and bred.
I was born at Queen of the Valley Hospital in 1966. I attended Wescove Elementary, J�Tilloviood
and graduated from Edgeivood High School. I marched in the band, lettered in sports and was
Associated Student Body President.
I played baseball at Walmarado Park and swam for the city sponsored West Cmna Water
Otters. I v^Tent to church in JhTest Co«na. I became an Eagle Scout in I'Vest Cm ina and did the
Eagle Project at the West Coirina Library. I bought a home here. My dad taught at Edgewood
and JhTest CoNgna High School. My mom is still active in the Women's Club. Both my sisters
graduated from JATest Covina Schools. My two children attend school here, and I have a niece at
South Hills High.
I have benefited greatly from my experiences here.. I have always wanted to give back to my
hometown. In 1990 I serf-ed on the �TTest Covina Fourth of July Committee, the City's Census
Committees and belong to the West Covina Historical Society and am a Life Member of the
Friends of the j�Test Covina Library. I have donated to West Covina Beautiful, Hurst Ranch and
volunteer m)7 time as a board member of the local Meals on Wheels.
Voters have elected six times to the (Nest Cm ina Unified School District Board of Trustees.
JATest Cmrina is the second largest employer in the city. When I was elected the district was
coming out of bankruptcy and our academics suffered. I am proud to be part of the team that
changed that. Now JNCUSD has ti�rice as much in reserves per student as neighboring districts
and are scores are continually rising. I have served 18 years on the East San Gabriel Valley ROP
Technical Center an internationally recognized Career and Academic training facility located in
�ATest Covina. I also was a founding member of the California Virtual Academy Los Angeles
Board of Directors.
As a board member I have presided at meetings, negotiated �Ath unions, hired emplo.)7ees,
disinissed employees, approved budgets and dealt writh a range of issues from workman's
compensation insurance to construction projects.

Education isn't the only thing that has interested me. The Speaker of the State Assembly
appointed me to a four year term on the Library of California Board of Directors. I served on
the San Gabriel Basin 1hlater Qualit>> Authority Ad�rison, Committee and two terms as the
taxpayer representative on the Mt. Sac. Bond Oversight Committee. I served as a Trustee for -
the Junior Statesman Foundation and the Southern California Leadership Network. I served as
a lay Sunday School teacher and leader in my local church and still serve as a Boy Scout Merit
Badge Counselor.
I am a partner in a couple of business ventures and serve as Chief of Staff to Assemblyman Curt
Hagman and previously served in that position for Assemblyman Joel Anderson.
Their assignments have included Public Safety, Energy, IA7ater, Budget, Land Use and many
other issues that face cities today. I understand how government works or sometimes how it
doesn't. I have testified at hearings at the city, count}7 and state levels and have drafted
administrative regulations and legislation.
Most importantly I am married to the former Marielena Barros and have two wonderful kids,
Reagan and Nathanael.
I have many diverse and unique experiences that Nvill benefit the Council should I
be chosen. I can get up to speed very quickly.
My goals would be simple. Leave citizens alone, let them raise their families, run their
businesses and get the same joy I received from living here. Public Safety comes first for me.
If you are looking for a rubber stamp I am not your candidate. I am independent. I
ask tough questions and try to hold government accountable to the public. That is_my goal.
The city sued me in 1998 over a ballot argument opposing to a tax measure. The tax failed as
did the lawsuit. It is clear I am a fighter for -what I think -will benefit West Covina.
Since then I have worked with several members from the council that sued me on other
projects. I can work with those I disagree with if it is the right thing to do.
I hope you will give the opportunity to continue my sen ice as a Councilmember.

council seat recently vacated.
I am a 55 year resident of West Covina and have
seen the city more than double in population and expand
to its present size. Running a 50 yr. business in the
area as a C-15 Contractor has also afforded me close
ties with the community in which I have been very
active.
During this time I managed a West Covina Bobby Sox
Softball team for 5 years in the ' 70' s and Little
League Majors & umpired in the 1960' s & 70 ' s .. I am
a major 5 year sponsor of the Queen of the Valley Neo-
natal program, Charity Golf Tournament and CV Hospice.
My children and grandchildren attended West Covina
schools and I supported all school activities with
donations of help or money when needed.
I have served 4 years on the Board of Directors for
South Hills Country Club and am presently serving on
their Finance Committee.

Commission and Sports Council and 6 years on the
Planning Commission, twice as Chairman. During' this
time I have expended a great deal of time, expertise,
and energy to work for the residents of our city.
As a current planning commissioner I have researched

for additions, new construction and other business
requests.
In addition, during that time, I have made it a point
to attend ever City Council meeting, just to further
my knowledge of the concerns and needs of the residents
as well as those of the governing bodies.
I have. followed West Covina politics since the days of
Ken Chappell and I know our City and many of the
residents.
At your last meeting you stressed the point that you
wanted someone to fill the position that could "hit
