Corrunissioner Blackburn led the Pledge of Allegiance and the Commission observed a moment of silence. Regular meeting, May 13, 2014 — The minutes were approved as presented. OTHER MATTERS OR ORAL COMMUNICATIONS None PUBLIC HEARINGS (CONTINUED FROM MAY 13, 2014) GENERAL PLAN AMENDMENT NO. 13-04 EAST HILLS MASTER PLAN REVISION NO. 13 ZONE CHANGE NO. 13-04 PRECISE PLAN NO. 13-07 TENTATIVE TRACT MAP NO, 72579 TREE REMOVAL PERMIT NO. 13-09 APPLICANT: Brandywine Homes (Brett Whitehead) LOCATION: 3228, 3238 and 3244 Holt Avenue REQUEST: Request to develop three contiguous parcels with 48 two-story townhomes. This request consists of a General Plan Amendment from "Residential Suburban" to "Medium Residential", a revision to the East Hills Master Plan amending the land use designation from Planned Development "Residential Suburban" to "Medium Residential", a zone change from "Residential Agriculture, Area District III" to "Specific Plan", a precise plan to allow construction of 48 ZOLANCOM\MINUTES12014 MINUTES15.27.14 minutes,doc Planning Commission Minutes Page 2 — May 27. 2014 townhome units, a tentative tract map for the subdivision of the property to create residential condominium units, and a tree removal permit to remove trees. Senior Planner Fabiola Wong presented the staff report. During her presentation she told the Commission that, as a result of meeting with the residents, the applicant had changed the configuration of the building layout. In addition she told the Commission that some parking had been eliminated, and some of the large common open space areas had been reduced. Further, in response to residents raising concern about their loss of privacy, the applicant agreed to build a six-foot block wall and hedges that will grow to 20 feet in height along Joy Street. Ms. Wong also said the pedestrian gate had been eliminated. The purpose of the recommendation for the gate was to provide safer access to schools, reduce the number of vehicle trips in the area and encourage pedestrian activity in the neighborhood. Chairman Menefee opened the public hearing. PROPONENTS: Analisa Amormino, representing the applicant, thanked staff for their help. She said that changes to the original plan had been made that were more satisfactory to the residents. Chairman Menefee asked about the tree removal permit and replacement of existing trees with larger trees. Commissioner Holtz asked about the elimination of the pedestrian gate. Ms. Amormino said they agreed to the removal of the gate and were in agreement with the residents that it be removed. There was then a discussion regarding the reasons staff was recommending the pedestrian gate. Commissioner Blackburn asked Ms. Amormino if there was concern that non-residents could access the property through the pedestrian gate. OPPONENTS: Eric Donnelly, Joe Maxey and Emad Boutros spoke in opposition to the project. Mr. Donnelly said the applicant had listened to the residents however he was opposed to the pedestrian gate, since he didn't believe it would encourage children in the area to walk to school. Mr. Maxey said he had previously spoken in favor of the project but he was now opposed due to the pedestrian gate. He expressed his concern that residents of the project would park on Oak Knoll and access the units through the pedestrian gate creating additional congestion in the area. He added that this was his only concern with the project. Mr. Boutros said he lives on Joy Street and was concerned that some of the guest parking spaces for the project site would negatively impact his privacy and create noise. He requested that the parking space directly behind his property be removed. She added that, since they had an excess amount of guest parking there would still be sufficient parking for the development. Chairman Menefee closed the public hearing. There was a discussion by the Commission regarding the pedestrian gate and the resident's opposition to it. Commissioner Holtz said that he didn't believe the pedestrian gate would encourage children residing in the development to walk to school. Commissioner Valles agreed with Commissioner Holtz. She also complimented the applicants for meeting with residents and addressing their concerns. Commissioners Blackburn and Castellanos concurred with the other commissioners and also complimented the applicants for their cooperation with residents. Chairman Menefee said he agreed and said this project will be an asset to the city. Motion by Blackburn, seconded by Holtz, to adopt Resolution No. 14-5612, recommending to the City Council certification of the Mitigated Negative Declaration of Environmental Impact for General Plan No. 13-04, East Hills Master Plan No. 13, Zone Change No. 13-04, Precise Plan No, 13-07, Tentative Tract No. 72579 and Tree Removal Permit No. 13-09. Motion carried 5-0. Motion by Blackburn, seconded by Holtz, to adopt Resolution No. 14-5613 recommending to the City Council approval of General Plan Amendment No. 13-04 and East Hills Master Plan Amendment No. 13. ZAPLANCOM\MINUTES\2014 MINUTES15.27.14 minutes.doe Planning Commission Minutes Page.z.la y_.1 t ADMINISTRATIVE USE PERMIT NO. 13-58 CATEGORICAL EXEMPTION APPLICANT: Chin Guek LOCATION: 3040 Hillside Drive REQUEST: Request to construct a new 6,167 square foot two-story single-family residence (including a 837-square foot attached three-car garage) on a 57,194-square foot lot. The existing single-family residence will be demolished. Chairman Menefee called a recess at 7:48 p.m. due to technical difficulties. Chairman Menefee reconvened the meeting at 7:52 p.m. Assistant Planner Amy Davis presented the staff report. She also informed the Commission that a letter of concern was received from a resident expressing their concern about the construction activity for the new home. Staff recommended approval of the proposed home. There was a short discussion with the Commission regarding the size of the proposed home. Chairman Menefee opened the public hearing. PROPONENTS: No one spoke in favor of the project. OPPONENTS: Michael Murphy, Esq., spoke on behalf of Mr. and Mrs. Ortega and said they were concerned that the long, narrow roadway leading to the property would be filled with construction vehicles and workers' cars thereby obstructing the roadway and disrupting the neighborhood. He said he would like to mitigate some of the disruption to the area by proposing that construction be allowed between 7 a.m. and 7 p.m., trucks be loaded and unloaded between those hours and no construction vehicles be allowed to park on the north side of Hillside Drive, Mr. Murphy also suggested that the construction crews could access the site using an easement that exists in the area. There was a short discussion by the Commission regarding the use of a City easement for access to the construction site. Miguel Hernandez, representing the Public Works Department, said the easement was a Los Angeles County easement and did not reach the subject property. REBUTTAL: Chin Guek, applicant, spoke regarding the issues mentioned by the opponent and said he would agree to have construction vehicles parked away from the street. There was a short discussion by the Commission regarding the Municipal Code as it pertains to the hours that construction is allowed. The applicant also agreed to minimize the impacts of construction on the access road. Chairman Menefee closed the public hearing. There was a discussion by the Commission regarding the Municipal Code requirements for construction hours. Deputy City Attorney Chris Cardinale clarified the construction requirements in the Municipal Code for the Commission. Motion by Blackburn, seconded by Castellanos, to adopt Resolution No. 14-5617, as amended. Motion carried 5-0. 4. CODE AMENDMENT NO. 13-04 GENERAL EXEMPTION APPLICANT: City of West Covina LOCATION: Citywide REQUEST: The proposed code amendment consists of certain amendments to the Zoning section of the West Covina Municipal Code as it pertains to commercial parking standards. Planning Director Jeff Anderson presented the staff report. He reviewed and summarized the previous discussions regarding commercial parking standards and explained the proposed changes in terminology to be consistent with the remainder of the Code. There was a short discussion by the Commission regarding the proposed changes to the code. It was the consensus of the Commission to recommend to the City Council that the amendments be adopted. Motion by Holtz, seconded by Blackburn, to adopt Resolution No. 14-5618 recommending approval of Code Amendment No. 13-04. Motion carried 5-0. NON-HEARING ITEMS 5. STUDY SESSION — CODE AMENDMENT NO. 14-03 MEDICAL MARIJUANA DISPENSARIES Planning Director Jeff Anderson presented the staff report. During his presentation Mr. Anderson explained that medical marijuana dispensaries are not allowed in West Covina under the Business License section of the Municipal Code, which prohibits unlawful businesses to operate within the City. ZAPLANCOM\MINUTES12014MINUTES15,27.14 minutes.doc Planning Conunission Minutes Page 6 — May 27. 2014 There was a discussion by the Commission regarding personal freedoms protected under the Constitution and the possibility that the use of medical marijuana might become a protected use. Also during the discussion, the Commission considered the differences between tattooing and adult-oriented businesses, which are protected under the Constitution, and the use of medical marijuana, which is still unlawful under Federal law. Staff recommended that the Commission study the City of Malibu's code regulating medical marijuana dispensaries, since some of their regulations might be applicable in West Covina. There was then a discussion regarding the code adopted by the City of Malibu and which regulations should be considered for inclusion in West Covina's code amendment. During the discussion the Commission expressed their reluctance to create a code amendment to allow medical marijuana dispensaries without knowing the parameters of what would be required by the Federal government. It was the consensus of the Commission to direct staff to write a code amendment that would prohibit medical marijuana dispensaries in West Covina, and agreed that attempts to regulate the use should wait until medical marijuana is allowed by the Federal government. CONTINUATION OF ORAL COMMUNICATIONS None COMMISSION REPORTS/COMMENTS AND MISCELLANEOUS ITEMS Chairman Menefee spoke about West Covina's Birthday Celebration at the Senior Center and the Commissioner Training at Ontario Airport, June 20 to June 22, 2014. PLANNING DIRECTOR'S REPORT: None CITY COUNCIL ACTION: June 3, 2014 — Code Amendment No. 14-03, Guest House Standards and appeal of Planning Commission approval of Conditional Use Permit No. 13-08 are scheduled for public hearing before the City Council. Arnar Road (Village Shopping Center) I. DESCRIPTION OF APPLICATION The project consists of a proposal to remodel the exterior of an existing commercial building located at the northeast corner of South Azusa Road and Amar Avenue. The applicant is proposing to complete architectural modifications to the façade. IL STAFF RECOMMENDATION Staff recommends that the Planning Commission approve Planning Director's Modification No. 14-10 subject to the conditions included in the staff report. III. ENVIRONMENTAL DETERMINATION The project is a Categorical Exemption Class 1 (Section 15301: Existing Facilities) pursuant to the requirements of the California Environmental Quality Act of 1970 (CEQA) since the project involves only the rehabilitation of an existing structure and existing facilities. PROJECT DESCRIPTION AND ANALYSIS The applicant is proposing to remodel the exterior 7,200-square feet of a portion of the shopping center. The subject property includes nine tenant spaces located on the northeast-- corner- o outh-A-zus a-Re ad-and-Arnar-Menue,-Th e-app Gant-is-reques ting approval of facade improvements to the site. The subject property is one of three properties that comprise the Village Center. Seafood City occupies the central portion of the center. The proposed facade changes are only for the tenant spaces located on the eastern side of the Village Center and not for the entire shopping center. The owner of the property is requesting these facade changes, but the applicant has no authority over any changes to the remaining two portions of the center (which are separately owned). Facade Improvement The applicant is proposing to modify the facade of the existing commercial buildings to update the architecture. The proposal is to redevelop the building's storefront in order to modernize and be compatible with the adjacent building facade of Seafood City. The facade changes include adding parapet walls with varying roof heights, cornices, new storefronts, stone facades on the column bases and increasing the column dimensions. The varying parapet wall will provide articulation along the front elevation. The proposal also includes a mural and landscaping on the east end of the building. The proposed design will eliminate the current mansard roof and replace it with parapet walls of varying height. The new facade will be covered with a smooth finish hand troweled plaster. The parapet walls will vary in rooftop styles and frontal elevations, which break up the scale of the facade. The column dimensions will be increased and accented with cultured ledgestone at the base and decorative molding above. The storefront will use aluminum framework for the opening of the doors and windows. A decorative steel canopy will be provided in the center of the building elevation. The parapet walls will provide sign areas for the individual businesses in the center. The proposed mural on the east wall of the existing building will be done with exterior plasters and metal control joints in outline of a tree. The trunk and straight branch lines will be composed of galvanized metal joints for a stucco construction, which will be pre- finished in black. A palette of varying green colored stucco and paint will be used where details of the mural are drawn. In the area that is not covered by the mural, the color and finish will be the same color as the proposed storefront. Landscape planters are proposed along the east side of the building where a freestanding wall extends from the building. In summary, the revised facade will add articulation and detail to modernize the front elevation of the store. The renovations will have consistent features with the existing facade and aesthetic of the neighboring business, Seafood City. Consistent features include column design, cultured stone, stucco treatment and roof form. While the design is not identical to the Seafood City façade, the proposed modifications create a more cohesive environment. Other Improvements Staff is supportive of the proposal. In inspecting the site, staff noted that the landscaping is well maintained. However, it does appear that the number of trees on the site are minimal. Conditions have been included which requiring the following landscape improvements. The planting of vines along the east wall (in the new planter) to discourage graffiti. The planting of vines on the wall at the front of the lot to discourage graffiti. The addition of 1 tree each in each of the end landscape planters near the front of the lot. The addition of 2 trees in the end landscape planter adjacent to the cigarette kiosk. The installation of trees along the entry drive at 40 feet on center on each side of the entry drive. In addition, conditions have been included requiring the submittal of a Sign Criteria and the submittal of plan for trash enclosures for the storage or trash bins. VI. STAFF RECOMMENDATION Staff recommends that the Planning Commission approve Planning Director Modification No. 14-10, subject to the following conditions: Comply with plans reviewed by the Planning Commission on June 10, 2014. Comply with all applicable sections of the West Covina Municipal Code. Comply with all requirements of the "Planned Community Development" (PCD- 1) Zone. A Sign Criteria establishing consistent sign standards for the center shall be submitted prior to the issuance of building permits. The Sign Criteria shall be approved prior to the issuance of building permits. The existing landscaping shall be upgraded prior to the issuance of building permits, the applicant shall submit detailed landscaping and irrigation plans to the Planning Director for review and approval for areas where new planters are added or where new plant materials are added. Said plans shall include the type, size, and quantity of landscaping materials, as well as a fully automatic comprehensive irrigation system. The plans shall comply with the City's standards for water efficiency. Landscaping areas are to be kept free of litter and diseased or dead plants. Diseased, dead, damaged, and/or disfigured plants shall be replaced as deemed necessary by the Planning Director. All installation of landscaping and irrigation shall be complete prior to issuance of a building permit final. The landscape plan shall include the following: Vines shall be planted in the new planter along the wall on the east side of the building. Vines shall be planted on the front wall along Amar Road. •• One tree (15 inch box minimum) shall be planted in eaeh of- the end - landscape planters near the front of the lot. The addition of 2 trees (15 inch box minimum) in the end landscape planter adjacent to the cigarette kiosk. Trees (15 inch box minimum) to be installed at 40 feet on center on each side of entry drive. It is encouraged that existing plant shrubs be maintained where possible. All landscape areas shall be covered with mulch to a depth of three inches. All irrigation equipment must be repaired where appropriate. The applicant shall submit a Trash Enclosure Location Plan indicating the location and dimensions of any existing or proposed trash enclosures. All outdoor trash areas shall be screened on all sides from public view by a minimum 5'6" high decorative block wall with a gate constructed of durable materials and an architectural cover. Provide construction details prior to issuance of a building permit. The proposed trash enclosure shall include an architectural cover. g. All mechanical equipment not shown on the approved Study Plan shall be screened from all views in a manner that is architecturally compatible with the buildings on which they are mounted. If any changes to the light standards or light levels are proposed, a parking lot lighting plan showing electrolier types and locations, average illumination levels, points of illumination and photometric data in conformance with the Planning Commission Resolution No. 2513 and as requested shall be submitted to and approved by the City Engineer. i. During construction, the delivery of materials and equipment, outdoor operations of equipment, and construction activity shall be limited to the hours between 7:00 a.m. and 8:00 p.m. All construction equipment, stationary or mobile, shall be equipped with properly operating and maintained mufflers. k. All construction equipment shall be stored on the project site during the construction phase to eliminate daily heavy-duty truck trips on vicinity roadways. The operation of the facility shall comply with the West Covina Noise Ordinance. m. That the Planning, Building, Fire, and Police Departments and the Community Development Commission review any proposed change to the approved site plan, floor plan, or elevations, and that the written authorization of the Planning Director shall be obtained prior to implementation. n. Any new gutters and downspouts shall not project from the vertical surface of the building pursuant to section 26-568 (a) (3). The Planning Director prior to the issuance of building permits must approve the location of new electrical transformers, vaults, antennas, mechanical, and all other equipment not indicated on the approved plans. Provide construction details prior to the issuance of a building permit. All new on-site utility service lines shall be placed underground. This permit is valid for twelve months from the date of approval. If the work not completed within this period the approval will expire. This approval does not include the approval of signs; a separate sign permit shall be obtained. All signs shall be required to comply with the City of West Covina Sign Code.
