SUBJECT: AWARD OF BID FOR RESIDENTIAL STREET REHABILITATION WORK
(PROJECT NO. SP-11105)
RECOMMENDATION:
It is recommended that the City Council award the contract to All American Asphalt Inc., in the
amount of $647,000.00 and authorize the Public Works Director/City Engineer and City Clerk to
execute the contract for residential street rehabilitation work.
ISCUSSION:
This project was approved by the City Council in the Fiscal Year 2010-2011 Capital
Improvement Program budget. The project consists of grinding down (coldmilling) two inches
of existing asphalt concrete pavement and providing asphalt concrete overlay, repair of damaged
curbs and gutters, sidewalks, construction of wheelchair ramps, adjustment of manholes, new
pavement messages, striping, and all incidental and appurtenant work. It includes twenty-four
segments of various residential streets Citywide (Attachment "A"). The street sections are
selected based on the Pavement Condition Index (PCI) as determined by the City's Pavement
Management System with the streets in the worst condition being given priority. Of the City's
246 miles of road, this project is approximately 3.3miles (an area of about 552,000 square feet).
Pursuant to the California Environmental Quality Act Guidelines Section 15302-Class 2, the
aforesaid improvements are of a minor nature and, therefore, the project is categorically exempt
from the requirements for Environmental Impact Report or Negative Declaration of
Environmental Impact Report.
A notice inviting bids for this project was advertised in the San Gabriel Valley Tribune on April
28, 2011 and May 5, 2011. In addition, the project was advertised in the Contractor's Green
Sheet and the Daily Construction Service. On May 17, 2011, a total of eight bids were received
and checked for errors and all were determined to be valid. The following is a summary of the
bids received.

The lowest responsive bid was $647,000.00 from All American Asphalt of Corona, California. If
awarded, the project construction will commence by the beginning of July 2011, and will be
completed within six to eight weeks.
ALTERNATIVES:
Reject all bids received and re-advertise. Since a favorable bid was received, it is unlikely
that seeking new bids would reduce costs any further.
Reduce the scope of work by eliminating some segments from the proposed location of
streets. This alternative requires negotiation of a change order or a re-bid. This will delay
the project and increase the City's backlog of street rehabilitation work, which is unnecessary
as there is adequate funding for this project.

RECOMMENDATION:
It is recommended the City Council receive and file this report.
DISCUSSION:
Effective January 1, 2006, Section 53646 of the Government Code states that a city's chief
fiscal officer may submit quarterly reports to their legislative body. This report is to include
the type of investment, issuer, date of maturity, par and dollar amount invested on all
securities, investments, and money held by the local agency. It must also include a statement
that the portfolio is in compliance with the City's investment policy, or manner in which it is
not in compliance, and note the ability of the local agency to meet its expenditure
requirements for the next six months, or provide an explanation as to why sufficient money
may not be available.
Although it is no longer a requirement to submit quarterly reports to the local legislative
body, the Finance Department will continue to submit treasurer's reports to the West Covina
City Council each month.
The April Report shows the City's portfolio increased from $43,242,080.00 on March 31,
2011, to $45,093,553.38 on April 30, 2011. Beginning with the May 2001 report, average
maturity information has been provided for investments in the City's portfolio. The overall
average maturity of the portfolio is 842 days or approximately two and a half years.
Approximately 6 percent of the portfolio is on deposit in various bank accounts. These funds
are available to satisfy obligations as needed. The majority of the portfolio is on deposit in
two investment pools. Approximately 37 percent is held in the State of California Local
Agency Investment Fund (LAIF) and 26 percent is in the Los Angeles County Investment
Pool (LACIP). These funds are completely liquid since the City could withdraw them at any
time. The portfolio also includes two long-term, high interest investments made in the early
1980s which constitute approximately 31 percent of the portfolio.

body, the Finance Department will continue to submit treasurer's reports to the West Covina
Community Development Commission Board each month.
The April Report shows the CDC's portfolio increased from $10,268,913.41 on March 31,
2011, to $13,916,520.62 on April 30, 2011. To ensure funds are available on short notice to
take advantage of development opportunities, the CDC's surplus funds are in investment
pools with the State of California Local Agency Investment Pool (LAIF) and the Los
Angeles County Investment Pool (LACIP). These funds are completely liquid since the City
could withdraw them at any time. Approximately 65 percent of the portfolio is on deposit in
LAIF and 34 percent is in LACIP. The remaining 1 percent of available cash is on deposit
in various checking accounts. This report also shows cash holdings for the Community
Facilities District. These funds are used for district operating expenses and debt service and
are invested in a separate LACIP account.

DISCUSSION:
The West Covina General Municipal Election is scheduled for November 8, 2011, for the
purpose of electing two Members of the City Council. In preparation for the election, it is
required that the City Council adopt certain resolutions.
The following is a brief description of the resolutions requiring City Council approval:
Resolution Calling the Election (Attachment 1)
The first resolution calls for the holding of a General Municipal Election to be held on Tuesday,
November 8, 2011, to fill two seats on the City Council for four-year terms each. The resolution
further stipulates that the election will be conducted by and conform to all applicable laws.
Resolution Reauesting Consolidation with Los Angeles County (Attachment 2)
The second resolution requests the Board of Supervisors of the County of Los Angeles to
consolidate the City's General Municipal Election with the County's School District Election to
be held on November 8, 2011. The resolution also authorizes the County elections department to
canvass the returns of the election and provides for City reimbursement to the County for costs
of the election services provided to the City for its portion of the consolidated election. The City
Clerk's Office will issue, receive and certify all candidate nomination papers.
Resolution Regarding Candidate Statements (Attachment 3)
The third resolution sets general provisions for the candidate statements including the foreign
languages in which candidates statements must be translated into in West Covina and payment
policy. Candidate statements may be of no more than 200 words and may include the name, age
and occupation of the candidate and a brief description of the candidate's education and
qualifications expressed by the candidate himself or herself.

Candidates may choose to print a candidate statement in the English sample ballot booklet and
they may also choose to have a Spanish translation of that statement printed in the English
sainple ballot booklet. The County Election Division does not allow the printing of candidate
statements in any other language in the main sample ballot pamphlet. The resolution stipulates
the Candidate shall pay for the cost of printing the statement (English and Spanish) in the
English voter pamphlet and the Candidate shall pay a deposit for the estimated costs of printing,
handling and mailing of the statement. The cost estimate is provided by the Elections Division
of the County of Los Angeles. The deposit and the statement must both be submitted at the time
the candidate submits his/her nomination papers. The City is not bound by the estimate and may
bill the candidate for any additional actual expense or refund any excess paid.
To comply with the Federal Voting Rights Act the County of Los Angeles must translate
candidate's statement for voter information booklets into the languages described in Section 2(a)
of the resolution. These filly translated sample ballot booklets will be available to voters in
precincts which meet the language criteria in those precincts and will be mailed to the voters who
request such translated material at no cost to the city or candidate.
FISCAL IMPACT:
On February 10, 2011, the County of Los Angeles Elections Division provided an estimate to
consolidate with the November 8, 2011 School District Election for two offices at $126,000.
The estimate is based on 52,981 registered voters, 7,947 permanent absent voters, 26 precincts,
and 4 jurisdictions sharing prorated costs.
There are also other costs to conduct an election which are not provided by the County. These
costs include required newspaper publications in English and several foreign languages and the
foreign language translations of those publications. Funds for the election are included in FY
2011-2012 budget.
ADDITIONAL INFORMATION:
Any person wishing to submit nomination papers for the two seats on the City Council must be a
registered voter of the City of West Covina at the time nomination papers are issued. The
nomination period for the November 8, 2011, election begins on July 18, 2011, and closes on
August 12, 2011 at 5:00 p.m. If an incumbent does not file nominations papers by 5:00 p.m. on
August 12, 2011, the filing period is extended until August 17, 2011 at 5:00 p.m. During this
extension period, any eligible person other than the incumbent may take out, circulate, and file
nomination papers for that office. It should be noted that the City is closed on Fridays; however,
due to consolidation with the County, the City Clerk's Office will remain open on the closing
day of the nomination period until 5:00 p.m. for the purpose of issuing or accepting nomination
documents only (EC § 10407).
Nomination packets may be picked up and returned by a candidate's representative, but are
issued Apecifically to a named prospective candidate, not on an anonymous basis.

WHEREAS, under the provisions of the laws relating to general law cities in the State of
California, a General Municipal Election shall be held on November 8, 2011, for the election of
municipal officers.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS

may be necessary in order to properly and lawfully conduct the General Municipal Election.
SECTION 4 That the polls for the election shall be open at seven o'clock a.m. of the day
of the election and shall remain open continuously until eight o'clock p.m. of the same day when the
polls shall be closed, except as provided in § 14401 of the ElectionS Code of the State of California.
SECTION 5. That notice of the time and place of holding the election is given and the City
Clerk is authorized, instructed and directed to give further or additional notice of the election, in
time, form and manner as required by law.
SECTION 6. That in all particulars not recited in this resolution, the election shall be held
and conducted as provided by law for holding municipal elections.
SECTION 7. That the City Clerk is hereby directed to file a certified copy of this
resolution with the Board of Supervisors and the County Election Department of the County of Los
Angeles.
SECTION 8. That the City Clerk shall certify to the passage and adoption of this
resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, REQUESTING THE BOARD OF SUPERVISORS
OF THE COUNTY OF LOS ANGELES TO CONSOLIDATE A GENERAL
MUNICIPAL ELECTION TO BE HELD ON NOVEMBER 8, 2011, WITH
THE SCHOOL DISTRICT ELECTION TO BE HELD ON THAT DATE
PURSUANT TO SECTION 10403 OF THE ELECTIONS CODE
WHEREAS, the City Council of the City of West Covina called a General Municipal
Election to be held on November 8, 2011, for the purpose of electing two Members of the City
Council for the full term of four years; and
WHEREAS, it is desirable that the General Municipal Election be consolidated with the
School District Election to be held on the same date and that within the City the precincts, polling
places and election officers of the two elections be the same, and that the Election Department of
the County of Los Angeles canvass the returns of the General Municipal Election and that the
election be held in all respects as if there were only one election.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER AS
FOLLOWS:
SECTION 1. That pursuant to the provisions of §10403 of the Elections Code, the Board
of Supervisors of the County of Los Angeles is hereby requested to consent and agree to the
consolidation of a General Municipal Election with the School District Election on Tuesday,
November 8, 2011, for the purpose of the election of two Members of the City Council.
SECTION 2. That the County Election Division is authorized to canvass the returns of the
General Municipal Election. The election shall be held in all respects as if there were only one
election, and only one form of ballot shall be used.
SECTION 3. That the Board of Supervisors is requested to issue instructions to the
County Election Division to take any and all steps necessary for the holding of the consolidated
election.
SECTION 4. That the City of West Covina recognizes that additional costs will be
incurred by the County by reason of this consolidation and agrees to reimburse the County for any
costs.
SECTION 5. That the City Clerk is hereby directed to file a certified copy of this
resolution with the Board of Supervisors and the Elections Division of the County of Los Angeles.
SECTION 6. That the City Clerk shall certify to the passage and adoption of this
resolution.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, ADOPTING REGULATIONS FOR
CANDIDATES FOR ELECTIVE OFFICE PERTAINING TO
CANDIDATES STATEMENTS SUBMITTED TO THE VOTERS AT AN
ELECTION TO BE HELD ON TUESDAY, NOVEMBER 8, 2011
WHEREAS, §13307 of the Elections Code of the State of California provides that the
governing body of any local agency adopt regulations pertaining to materials prepared by any
candidate for a municipal election, including costs of the Candidate's Statement.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA,
CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMINE AND ORDER
AS FOLLOWS:
SECTION 1. GENERAL PROVISIONS.
That pursuant to §13307 of the Elections Code of the State of California, each Candidate
for elective office to be voted for at an Election to be held in the City of West Covina on
November 8, 2011, may prepare a Candidate's Statement on an appropriate form provided by the
City Clerk. Such statement may include the name, age and occupation of the Candidate and a
brief description of no more than 200 words of the Candidate's education and qualifications
expressed by the candidate himself or herself Such statement shall not include party affiliation
of the candidate, nor membership or activity in partisan political organizations. Such statement
shall be filed in typewritten form in the office of the City Clerk at the time the candidate's
nomination papers are filed. Such statement may be withdrawn, but not changed, during the
period of filing nomination papers and until 5:00 p.m. of the next working day after the close of
the nomination period.
SECTION 2. FOREIGN LANGUAGE POLICY.
a. Pursuant to the Voting Rights Act, all Candidates statements are required to be
translated into the following languages: Spanish, Chinese, Tagalog, and
Vietnamese.
Pursuant to State law, the Candidate's statement may, at the Candidate's request, be
printed in the main (English) sample ballot pamphlet in English and Spanish only.
The County of Los Angeles Elections Division shall
1) have translated all Candidates Statements in the languages specified in (a)
above.
2) translate, print and mail sample ballot pamphlets and candidates statement in
the languages specified in (a) above to voters who have requested such
translated material at no cost to the city or Candidate.
SECTION 3. PAYMENT
a. Each Candidate SHALL be required to pay for the cost of printing the Candidate's
Statement in English in the main (English) voter pamphlet and for the cost of
printing the Candidate's Statement in Spanish in the main (English) voter pamphlet,
if so requested as specified in (b) of Section 2 above.
b. The Candidate SHALL NOT be required to pay for the cost of translating the
Candidate's Statement into any required foreign language as specified in (a) of
Section 2 above.
c. The Candidate SHALL NOT be required to pay for the cost of printing, the
Candidate's Statement in a foreign language required by (a) of Section 2 above, in
the facsimile voter pamphlet (fully translated sample ballot booklet).
The Los Angeles County Elections Division shall provide the City Clerk with an estimate of the
total cost of printing, handling and mailing the Candidate's statement filed pursuant to this
section and require each Candidate filing a statement to pay in advance to the City Clerk his/her
estimated pro rata share as a condition of having his/her statement included in the voter's
pamphlet.
The estimate is just an approximation of the actual cost that varies from one election to another
election and the actual cost may be significantly more or less than the estimate, depending on the
actual number of Candidates filing statements. Accordingly, the County Elections Division and
the City Clerk are not bound by the estimate and may, on a pro rata basis, bill the Candidate for
additional actual expense or refund any excess paid depending on the fmal actual cost. In the
event of underpayment, the City Clerk shall require the Candidate to pay the balance of the cost
incurred and in the event of overpayment, the City Clerk shall refund the excess amount paid
within 30 days of the election.
SECTION 4. No Candidate will be permitted to include additional materials in the
sample ballot package.
SECTION 5. That the City Clerk shall provide each Candidate or the Candidate's
representative a copy of this resolution at the time the nominating petitions are issued.
SECTION 6. That all previous resolutions establishing council policy on payment for
the Candidates' Statement are repealed.
SECTION 7. That this resolution shall apply only to the election to be held on
November 8, 2011, and shall then be repealed.
SECTION S. That the City Clerk shall certify to the passage and adoption of this
resolution and enter it into the book of original resolutions.
