RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE CITY’S TICKET DISTRIBUTION POLICY
WHEREAS, every California city by and through its governing body and other public officials, is empowered to exercise all powers necessary or appropriate to a municipal corporation for
the general welfare of its inhabitants which are not prohibited by the California Constitution;
WHEREAS, the California Fair Political Practices Commission (“FPPC”) recently amended Sections 18944.1 and 18942 of the California Code of Regulations relating to tickets or passes to
City Officials for the purpose of the City Official performing a ceremonial function at an event;
WHEREAS, Section 18942 provides that a ticket received by a City Official is not considered a gift if the ticket is received by the City official to perform a ceremonial function at
an event;
WHEREAS, Section 18944.1 requires that a ticket received by a City Official from the City that is used by the City Official to perform a ceremonial role or function at an event is subject
to the City’s Ticket Distribution Policy and therefore must be reported on a Form 802 and disclosed on the City’s website;
WHEREAS, the City’s Ticket Distribution Policy currently provides that a ticket received by a City Official to perform a ceremonial role or function at event is not subject to the City’s
Ticket Distribution Policy;
WHEREAS, to conform to FPPC Regulations, the City’s Ticket Distribution Policy must be amended to include tickets received by City Officials to perform a ceremonial role or function
at an event.
NOW, THEREFORE, the City Council of the City of West Covina, California, does hereby resolve as follows:
SECTION 1. The City Council of the West Covina hereby amends the City of West Covina Ticket and/or Passes Distribution Policy to delete Section 4(e).
SECTION 2. Consistent with the requirements of California Code of Regulations Section 18944.1, the City Council hereby directs the City Clerk to post the amended Ticket and/or Passes
Distribution Policy in a prominent fashion on the City’s website;
SECTION 3. The City Clerk shall attest and certify to the passage and adoption of this Resolution, and it shall become effective immediately upon its approval.
