Garvey Avenue, West Covina. INVOCATION Pastor Kelly Dupeé Faith Community Church PLEDGE OF ALLEGIANCE Councilmember Lane ROLL CALL Mayor Sanderson, Mayor Pro Tem Herfert Councilmembers Lane, Touhey Absent: Councilmember Hernández REPORTING OUT FROM CLOSED SESSION Deputy City Attorney Matt Gorman reported the following: Prior to convening into closed session all items on the City Council agenda were announced for inclusion in the closed session discussion. All Councilmembers were present except Mayor Pro Tem Herfert and Councilmember Hernández. Items on the City Council agenda: Conference with Legal Counsel – Existing Litigation – Christopher Chung v. City of West Covina - Deputy City Attorney Gorman reported that Special Counsel provided a report; City Council provided direction to Special Counsel with no further action and nothing further to report. Conference with Legal Counsel – Existing Litigation – Sue Williams v. City of West Covina - Deputy City Attorney Gorman stated that a report was provided to City Council with no further action and nothing further to report. Conference with Legal Counsel – Existing Litigation – Sharon Garcia v. City of West Covina - Deputy City Attorney Gorman stated that a report was provided by legal counsel; City Council authorized settlement in the amount of $17,500 as a full disposition of the case, which constitutes Council’s final action on the matter. Conference with Real Property Negotiators – Property: Civic Center property (West Covina Parkway/West Garvey Avenue/southwest corner) – Deputy City Attorney Gorman reported that a briefing was given by staff; direction was given by City Council for staff to pursue further discussion with no final action and nothing further to report. CHANGES TO THE AGENDA None. PRESENTATIONS Mayor Sanderson, assisted by Michael Viera, manager of the 2010 AABC Mickey Mantle and 16U under World Series Champions, presented certificates of recognition to the players. Mayor Sanderson assisted by Alex Chavez, manager of the West Covina Youth Pony Baseball Allstar Team who won the 2010 Bronco Super Region Championship, presented certificates of recognition to the players. Mayor Sanderson assisted by James Strevell, manager of the So Cal Smash Baseball Team who won the 2010 Cooperstown, New York Tournament Championship, presented certificates of recognition to the players. Mayor Sanderson assisted by Louis Velasquez, manager of the West Covina Youth Pony Baseball Allstar Team, winners of the 2010 Mustang Region Championship, presented certificates of recognition to the players. Mayor Sanderson, along with Michele McNeill, Community Services Director, recognized Eirin Ferreiro, winner of the August Photo contest, and Michelle Souza, who was awarded Honorable Mention. Mayor Sanderson recognized Dr. Sylvia Mann, who was named Los Angeles County Fair’s 2010 West Covina Community Hero for her dedication to the Arts and coordinating the re-birth of the West Covina Symphony Orchestra. Mayor Sanderson presented Dr. David Alfaro and Don Fernald of West Covina rotary, a proclamation designating October 24 through October 30, 2010 as Red Ribbon Week. RECESS Mayor Sanderson called a recess of the City Council meeting at 7:45 p.m. The City Council reconvened at 7:56 p.m. with all members present except Councilmember Hernández. ORAL COMMUNICATIONS Lloyd Johnson Lloyd Johnson, West Covina resident, inquired as to whether the City has regulations for ice cream trucks. Jesse Valenzuela Jesse Valenzuela, West Covina resident and apartment manager at 1800 Badillo, addressed the lack of street sweeping due to cars on the street and asked the City to look into the problem. Birdie Azpetia Birdie Azpetia, West Covina resident, addressed parking issues created by residents with trashcans and cones around the Japanese Community Center when there is an event eliminating parking for event attendees. Irene Fleck Irene Fleck, West Covina resident, shared upcoming Library news and events. Herb Redholtz Herb Redholtz, West Covina resident, addressed a request he made at the previous meeting regarding the work on irrigation lines on the south side and thanked Shannon Yauchzee for his prompt follow-up and addressed Proposition 22 voicing his support. CONSENT CALENDAR D-2 Commission Summary of Actions (receive & file) Summary of Actions Planning 09/28/10 D-3a Award of Bid Radio/Electronic Equipment Mtc Award of Bid for 0610-A Radio and Electronic Equipment Maintenance Agreement Recommendation is that the City Council accept the bid of Advanced Electronics of Redondo Beach in the amount of $100,566.87 at the bid opening on September 7, 2010 and authorize the Public Works Director/City Engineer and City Clerk to execute the contract. D-3b Award of Bid for Curb and Gutter Repair, Sidewalk Repair, and Curb & Gutter Repairs the Upgrade of Wheelchair Ramps – (Project Nos. SP-11102, SP-11103, and SP-11104) Recommendation is that the City Council accept the bid of DMC Engineering, Inc. of Long Beach in the amount of $244,677.00 as submitted at the bid opening on September 21, 2010 and authorize the Public Works Director/City Engineer and City Clerk to execute an agreement with DMC Engineering, Inc. for the work to be done. D-4 Traffic Committee Minutes-September 21, 2010 (accept & file) Traffic Committee Minutes I. Request: City Initiated Annual Intersection Collision Rate Report for the Year 2009 (Informational) Traffic Committee Recommendations That staff review the sight restriction at the intersections of Lark Ellen Avenue and Walnut Creek Parkway and Puente Avenue and Nora Avenue. That the school crosswalk on Hollenbeck Avenue at Rio Verde Drive be modified based on the Safe Route to School Plan prepared by the consultant. That staff continue to monitor the intersection of Lark Ellen Avenue and Merced Avenue. That red curb be added on the south side of Puente Avenue west of Nora Avenue. That red curb be added on the west side of Lark Ellen Avenue north of Walnut Creek Parkway. II. Request: Elizabeth Schneider, West Covina Resident That multi-way stop signs be installed at the Casa Linda Drive and Hidden Valley Drive intersection. Traffic Committee Recommendations: That a stop sign be installed eastbound on Casa Linda Drive approach at Hidden Valley Drive. That stop signs be installed south and northbound approaches of Hidden Valley Drive at Casa Linda Drive. That a “Stop Ahead” sign and pavement markings be installed northbound on Hidden Valley Drive. D-5 City Treasurer’s Report (receive & file) Treasurer’s Report Report for the Month of August 2010 D-6 Miscellaneous - Community Services Department 2011 Community Unity Cleanup Outline of the Proposed ‘2011 Community Unity’ Neighborhood Clean-Up Event Recommendation is that the City Council receive and file this report. CONSENT CALENDAR ACTION Motion by Lane and seconded by Herfert to approve all items on the Consent Calendar as recommended. Motion carried by 4 – 0. PUBLIC HEARINGS E-1 Continued Public Hearing Weed Abatement 2010 Weed Abatement 2010 – Various Locations Citywide City Manager Pasmant stated that staff recommended that Council not conduct the public hearing and receive and file the report. Motion Motion by Lane and seconded by Herfert to not conduct the public hearing and receive and file the report. Motion carried by 4 – 0. COMMUNITY DEVELOPMENT COMMISSION Mayor Sanderson recessed the Council meeting at 8:10 p.m. to convene the CDC meeting. The City Council reconvened at 8:12 p.m. with all members present except Councilmember Hernández. MAYOR’S/COUNCILMEMBER REPORTS H-1 Councilmember Roger Hernández Proposition 23 Request from Councilmember Hernández Requesting the City Council Take a Position on Proposition 23 – Suspends Implementation of Air Pollution Control Law (AB32) Until Unemployment Drops to 5.5% or Less for a Full Year Motion by Herfert and seconded by Touhey to take a position in support of Proposition 23. Motion carried by 4 – 0. COUNCILMEMBER REQUESTS FOR REPORTS, STUDIES OR INVESTIGATIONS I-1 Councilmember Michael Touhey Proposition 22 Request from Councilmember Michael Touhey Requesting City Council Consensus to Instruct City Staff to Prepare a Report for the City Council to Take a Position on Proposition 22 – Prohibits the State from Taking Funds Used for Transportation or Local Government Projects and Services Councilmember Touhey requested and received Council’s support for Proposition 22. Motion Motion by Herfert and seconded by Touhey to forego a report back to Council and take action now for the City to take a position in support of Proposition 22. Motion carried by 4 – 0. AB1234 Councilmember Touhey gave an oral report on the ICSC meeting in San Diego he attended and reported news that conditions for retailers are getting better.
