10-18-2011 - General Plan Amendment No. 11-02Zone Change No. 11 - Item 8 Attach 9 (2).docP L A N N I N G C O M M I S S I O N R E S O L U T I O N N O. 11-5441 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF WEST COVINA, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT NO. 11-02 _______________________________________________________________________________________ GENERAL PLAN AMENDMENT NO. 11-02 MITIGATED NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT APPLICANT: Tom Lao, Charles Company LOCATION: 301 S. Glendora Avenue ________________________________________________________________________ WHEREAS, there was filed with this Commission a verified application on the forms prescribed in Chapter 26, Article VI of the West Covina Municipal Code, requesting an revisions to the General Plan Land Use Element and to change the land use designation from: “Regional Commercial” to “Mixed Use” on that certain property generally described as: Assessor Parcel No. 8474-010-010 in the records of the Los Angeles County Assessor; and WHEREAS, the requested General Plan amendment has been proposed to add goals, policies and a “Mixed Use” designation to the Land Use Element and to change the land use designation: and WHEREAS, consistent with this request, the applicant has also requested a zone change from “Regional Commercial” (R-C) to “Specific Plan No. 24 (Lakes District Specific Plan- ZC No. 11-02)”; and WHEREAS, a precise plan (PP No. 11-05) for the site plan and architecture has been submitted for the development of the project; and WHEREAS, a tentative tract map (TTM No.71644) has been submitted, for the subdivision of the lot to allow 413 residential and commercial condominiums; and WHEREAS, it is a stated policy of the Land Use Element of the General Plan to provide for a range of non-residential uses that will ensure a strong economic base for the City; and WHEREAS, it is a stated goal of the Housing Element of the General Plan “to provide all residents of West Covina with opportunities to live in decent, safe, sanitary and energy efficient housing at costs they can reasonably afford”; and WHEREAS, it is a stated goal of the Housing Element of the General Plan to “identify all sites, vacant or developed with a potential for residential development, and encourage their efficient and attractive use;” and WHEREAS, it is a stated policy of the Housing Element of the General Plan to “encourage the construction of a wide variety of new housing to meet the needs of all residents”. WHEREAS, the Planning Commission upon giving the required notice did on the 27th day of September, 2011, conduct a duly advertised public hearing as prescribed by law to consider said application. NOW, THEREFORE, the Planning Commission of the City of West Covina does hereby resolve as follows: SECTION 1: Based on the evidence presented, both oral and documentary, the Planning Commission recommends that the City Council approve General Plan Amendment No. 11-02, modifying the text of the General Plan Land Use Element attached as Exhibit A and amending the land use designation for the subject property as set forth on the Land Use Map as depicted on Exhibit B; and SECTION 2: A Mitigated Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION 3: The Secretary shall be instructed to forward a copy of this Resolution to the City Council for its attention in the manner prescribed by law.
