Mayor/Chairman Sanderson called to order the regular meeting of the joint West Covina City Council and Community Development Commission at 7:03 p.m. in the City Hall Council Chambers,
1444 W. Garvey Avenue, West Covina.

PRESENTATIONS Mayor Sanderson announced that all guests for tonight’s meeting had not yet arrived, so the meeting will proceed with Oral Communications.
ORAL COMMUNICATIONS
Phillip Moreno Phillip Moreno, West Covina resident, spoke in support of Fred Sykes to fill the Council seat vacated by Councilmember Hernandez.
Mayor Sanderson announced that all guests arrived and the meeting would now continue with presentations.
PRESENTATIONS Mayor Sanderson presented Fred Ortega, Field Representative for Congresswoman Judy Chu, with a certificate of recognition for Congresswoman Chu’s service as a member of
Congress.
Mayor Sanderson presented Bill Baca, Field Representative for Senator Gloria Romero, with a certificate of recognition for Senator Romero’s service as a California State Senator.
Mayor Sanderson presented Jorge Marques, Field Representative for Assemblyman Dr. Ed Hernandez, with a certificate of recognition for his service as a California State Assemblyman.
Mayor Sanderson presented Councilmember Roger Hernández with a Resolution of Commendation and City Tile for his service on the City Council for the past seven years.
Councilmember Roger Hernández expressed his gratitude in serving the City of West Covina; addressed several projects in which he collaborated with his colleagues; addressed his goal
to continuously work with the City as he represents the 57th
Assembly District and thanked his family and friends for their support.
Councilmember Touhey expressed his best wishes for Councilmember Hernández in Sacramento.
Councilmember Lane congratulated Councilmember Hernández on his future role.
The following presented Assemblyman-elect Hernández with certificates recognizing his election to the assembly:

Mayor/Chairman Sanderson called a recess at 7:40 p.m.
The City Council/CDC reconvened at 7:50 p.m. with all members present except Mayor Pro Tem/Vice Chair Herfert.

Shirley Buchanan Shirley Buchanan, West Covina resident, thanked Jeff Anderson and Tom Bachman for their response to a prior inquiry; congratulated Councilmember Hernández; hoped that
more information would be disseminated to the public on how they can express interest in filling the Council vacancy.
Boris Duarte Boris Duarte, West Covina resident, addressed several past decisions made by the Council that have affected his neighborhood stating that Councilmember Hernández best represented
his views; addressed the Council’s future decision to fill the Council vacancy and voiced his support of the appointment of Fred Sykes to replace Roger Hernández.
Joanne Wilner Joanne Wilner, West Covina resident, congratulated Roger Hernández and addressed the decision of the Council to fill the vacancy supporting the appointment of Fred Sykes;
suggested a tutorial page to operate the new audio on the website and requested video access be added.
Elsie Messman Elsie Messman, West Covina resident, congratulated Roger Hernández on his job in representing the people and supported the appointment of Fred Sykes as his council replacement;
addressed a lack of transparency; and addressed several budget related issues.
Bruce Leinbach Bruce Leinbach, West Covina resident, addressed the success of West Covina High School football team; congratulated Councilmember Hernández on his election to the Assembly;
expressed his concerns with no independent thinkers on Council; expressed concerns with the City’s budget; and voiced his support for Fred Sykes.
Fredrick Sykes Fredrick Sykes, West Covina resident, expressed his gratitude to those who spoke in support of him and addressed budget issues.
Forrest Wilkens Forrest Wilkens, West Covina resident, addressed his recent visit to the local theater and their exit doors, which didn’t work, and his follow-up with the Fire Dept.;
stated that the Council should seek
the best qualified replacement for Roger Hernández whom he stated is Fred Sykes.
John Shewmaker John Shewmaker, West Covina resident, spoke on voters’ choices and expressed his support for Herb Redholtz who has been involved in the city for over 20 years.

4) Miscellaneous - City Manager’s Office
Appointment – Mosquito Vector Appointment of City Council/City Staff Representative to San Gabriel Valley Mosquito & Vector Control District Board of Trustees
Recommendation is that the City Council re-appoint Mayor Shelley Sanderson to the San Gabriel Valley Mosquito & Vector Control District Board of Trustees to a two-year term.
5) Miscellaneous - Community Development Commission
Ashdon Development ENA Extension to an Exclusive Negotiating Agreement with Ashdon Development West Covina, Inc.
Recommendation is that the Community Development Commission Board (“CDC Board”) approve a six-month extension to the Exclusive Negotiating Agreement (“ENA”) with Ashdon Development
West Covina, Inc., “(“Ashdon”) in order to finalize the terms of sale and development of the AAA Pad located at the northeast corner of Azusa Avenue and Giambi Lane Intersection, and
authorize the Executive Director to prepare and execute the extension.
6) Miscellaneous - Community Services Department
Sports League Use of City Facilities Sports Council League In-Kind Use of City Facilities
Recommendation is that the City Council approve:
A reduction in the West Covina Sports Council league residency requirement from 70% to 65%.
A condition that a Sports Council league resident team must be present at all times when using City-owned playing areas, except during an authorized tournament or regional play.
A Sports Council league registration prerequisite of 12 teams or 150 players in order to maintain free use of City-owned playing areas.
7) Miscellaneous – Public Works Department
CA Building/Fire Codes California Building and California Fire Code Ordinance Introduction
Recommendation is that the City Council take the following actions:
Introduce the following ordinance:
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CHAPTER 7, ARTICLES II, IV, VI AND VII; CHAPTER 9, ARTICLE I; AND CHAPTER 10, ARTICLE II OF THE MUNICIPAL
CODE RELATING TO THE ADOPTION OF THE 2010 EDITION OF THE CALIFORNIA BUILDING CODE, THE 2010 CALIFORNIA RESIDENTIAL CODE, 2010 CALIFORNIA MECHANICAL CODE, 2010 CALIFORNIA PLUMBING CODE,
2010 CALIFORNIA ELECTRICAL CODE, 2010 CALIFORNIA GREEN BUILDING STANDARDS CODE, 2010 CALIFORNIA ENERGY CODE, AND THE 2010 CALIFORNIA FIRE CODE WHICH ADOPTS BY REFERENCE THE 2009 INTERNATIONAL
FIRE CODE
Set December 7, 2010 as the date for a Public Hearing concerning the adoption of the California Building Code and the International and California Fire Codes cited above.
8) Miscellaneous – Risk Management
Third Party Claims Administrator Award of Bid – General Liability Third Party Claims Administration Services Contract
Recommendation is that the City Council authorize the City Manager and City Clerk to execute a five-year contract with NovaPro Risk Solutions, LP to provide General Liability Third
Party Claims Administration (TPA) Services, effective January 1, 2011.
CONSENT CALENDAR ACTION Motion by Touhey and seconded by Hernández to approve all items on the Consent Calendar as recommended.
Motion carried by 4 – 0.
COUNCILMEMBER/CDC COMMISSIONER COMMENTS
Councilmember Touhey congratulated Councilmember Hernández on his election to the Assembly.
Councilmember Hernández read into the record a letter to the City Council in which he supported the appointment of Fred Sykes to fill the city council vacancy seat with his election
to the Assembly.
Councilmember Lane congratulated Councilmember Hernández.
ADJOURNMENT Motion by Hernández and seconded by Touhey to adjourn the meeting at 8:38 p.m. in memory of Senator Jenny Oropeza, who represented Senate District 28.
