DISCUSSION:
Submitted for City Council consideration is a resolution confirming the Annual Report filed by
the Advisory Board for the West Covina Auto Plaza Business Improvement District (Attachment
No. 1). Adoption of the resolution places direct assessments on the auto dealers of the West
Covina Auto Plaza.
The assessment revenue is used to recover the operation and maintenance costs of an electronic
readerboard sign located in the West Covina Auto Plaza adjacent to the I-10 freeway, as well as
recover the operation and maintenance costs for the entry statement to the Auto Plaza, which
includes the sign and landscaping located at the southwest corner of Azusa Avenue and Garvey
Avenue South. The Parking and Business Improvement Area Law of 1989, codified in Streets
and Highways Code Section 36500 et seq., authorizes cities to establish parking and business
improvement areas for the purpose of imposing benefit assessments on businesses for certain
purposes. On June 1, 1993, the City Council adopted Ordinance No. 1923, which established the
West Covina Auto Plaza Business Improvement District.
On April 18, 2011, the West Covina Auto Plaza Business Improvement District Advisory Board
held its annual meeting to review the Annual Report. At the annual meeting, the Advisory Board
discussed various items, including the possibility of replacing or updating the freeway auto plaza
sign. The freeway sign was originally constructed with a loan from the CDC to the Auto Plaza
Business District and will be paid in full in July 2011. It was unanimously agreed by the
Advisory Board that the sign should be replaced or fully refurbished, but wanted some type of
financial assistance from the City or the CDC. The Advisory Board will further discuss and
indicated that it will present a plan to the City/CDC in the future.
The Annual Report was approved on April 18, 2011 by the Auto Plaza Business Improvement
District Advisory Board, and has been filed with the City Clerk as required by the Parking and
Business Improvement Area Law of 1989 (Streets and Highways Code Section 36500, et seq.).
The Annual Report describes an assessment budget of $48,092.62 divided among six (6) auto
dealers resulting in an assessment of $8,015.44 for each dealership for FY 2011-2012.

On June 7, 2011, the City Council adopted Resolution of Intention No. 2011-30 to levy
assessments and set the date for this public hearing, at which time the Council will consider the

Notice of the Public Hearing was sent to the six Business Improvement District property owners,
and as of this date, there have been no objections.
It is noted that two dealerships within the BID missed paying the assessment for this operational
year and the prior two fiscal years. The shortfall in the assessment revenue was covered by the
annual reserve balance and no impact to the BID operation was observed. The total amount of
the delinquency payment is $40,226.18. As the reserve was drawn-down each delinquent year,
the following annual assessment amount charged to each dealership increased to replenish the
required six-months of operation costs. A reserve of $24,110 will be maintained for FY 2011-
2012. Because the annual BID assessment is collected as a direct assessment as part of the
property tax roll, the Los Angeles County Tax Collector will forward the delinquent payment to
the BID when the total property tax delinquency is collected. A BID representative has discussed
the matter with the delinquent dealerships in the past and the BID is considering disapprobatory
actions.
At the conclusion of the hearing, the City Council may adopt, revise, change, reduce or modify
the proposed assessment or type of improvements to be funded, but the City Council may only
reduce the boundaries or assessments. If the Council determines to levy the assessment, it may
adopt a resolution confirming so.
FISCAL IMPACT:
No impact to City funds. All costs covered by assessments to auto dealers.

FOR FISCAL YEAR 2011-2012
The City Council of the City of West Covina resolves as follows:
SECTION 1: The City Council proposes to levy and collect assessments within the West
Covina Auto Plaza Business Improvement District Area ("Area") for Fiscal Year 2011-12.
SECTION 2: On June 1, 1993, the City Council adopted Ordinance No. 1923, which
established the West Covina Auto Plaza Business Improvement District ("District") for purposes
of levying an assessment within the designated Area. The proposed use of the assessment
revenue collected is used for financing the construction, operation, and maintenance of an
electronic readerboard sign located in the West Covina Auto Plaza adjacent to the San
Bernardino Interstate 10 freeway as well as financing of the operation and maintenance costs for

SECTION 3: The boundaries are not proposed to change. The improvements and
activities to be financed are set out in Exhibit A.
SECTION 4: The Advisory Board for the District filed with the City Clerk an Annual
Report pursuant to the Parking and Business Improvement Area Law of 1989 (Streets and
Highways Code Section 36500, et seq.) which describes the proposed improvements and
activities authorized by Ordinance No. 1923. The Annual Report is attached as Attachment No.
2 and incorporated herein by reference.
SECTION 5: On June 7, 2011, the City Council adopted a Resolution of
Intention to levy assessments within the District for Fiscal Year 2011-12, and set
the date for a public hearing to be held on June 21, 2010.
SECTION 6: The Annual Report recommends an assessment of $8,015.44 for each of
the six auto dealerships within the District for Fiscal Year 2011-12.
SECTION 7: The City Council confirms the Annual Report for the District for Fiscal
Year 2011-12.
SECTION 8: This resolution shall take effect immediately upon adoption.
SECTION 9: The City Clerk shall certify to the adoption of this resolution.

1. Any proposed changes in the boundaries of the business improvement district area.

3. Estimate of the cost of providing the improvements and the activities for Fiscal Year

Gross estimated annual cost for programming, maintenance, electricity, and insurance for
readerboard sign, seasonal color (landscape materials), landscape maintenance, taxes and
preparation costs is $48,220.00. A reserve of $24,110.00 for six months of operating
costs will be maintained. An assessment of $8,015.44 for each of the six sites in the
business improvement district will be placed on the tax rolls by the County of Los
Angeles Department of Auditor-Controller.
4. Method and basis of levying the assessment for Fiscal Year 2011-2012.
The method and basis of levying the assessment will be pursuant to Ordinance No. 1923,
which was adopted by the City Council on June 1, 1993.
5. Amount of any surplus or deficit revenues to be carried over from Fiscal Year 2010-
2011.
The total amount of surplus/deficit revenue to be carried over from Fiscal Year 2010-
2011 is $24,037.38.

DISCUSSION:
Since May 2003, the City has reviewed fees and charges annually as part of the budget process.
Staff recently completed a citywide evaluation using the methodology outlined in Ordinance No.
1939. The attached fee schedule accomplishes the following objectives: (a) provides for
reasonable cost recovery in providing services, (b) ensures that the fees and charges do not
exceed the cost of providing the service, and (c) collects revenue from services that primarily
serve a specific individual or group of recipients while ensuring that taxpayers in general do not
incur the cost.
The biggest changes this year are increases in parking fines to recover revenue taken by the
county courts. There are also a handful of new fees for filming, various planning activities and
minor increases in existing fees to ensure full recovery. In addition, wording changes have been
proposed to clarify fees or bring them into conformance with existing standards and common
sense. Finally, included is a proposed discount that can be applied to recreation programs on a
temporary basis to increase participation. The following table is a summary of the proposed
changes to fees and fines.

Beginning in January 2009, the county court system began to take portions of parking penalties
for court costs. While legislation entitled the courts to the additional funds, it did not
automatically increase the amount of the fine to keep local agencies whole. Local governing
bodies need to increase parking fines by whatever the courts take just to continue collecting the
same amount of fine revenue. In January of 2011, the courts began taking an additional $3 for
each citation paid. Staff has proposed an increase of $5 per citation to recover the court
takeaway and costs of implementation including reprinting of citation stock and training. The
County is also taking $50 from each handicapped parking cite issued pursuant to VC22507.
These have been increased by $50 to prevent any loss of revenue. This year’s review also found
that the fine for VC5204 related to license plates and tags was significantly below the
Countywide Uniform Bail schedule. An increase of $48 per citation is recommended to bring it
up to the County standard.
There are two new filming fees. The first is a $1,000 filming permit for productions that are
done late at night or run for long durations (ie. a week). The second is a $300 per day fee for
filming in City Parks or other City facilities to recover the cost of staff time related to these
activities. Planning proposed several other changes to fees. Deposits for zone changes and
general plan amendments were increased from $2,000 to $4,000 to reflect the typical charge for
those services. These are deposits, not fees. In the event actual costs are less than the amount
deposited, the difference will be refunded. Zoning conformance already has an established
deposit that covers 2 hours of staff time. An additional rate has been added which can be
charged if the service takes more time.
The sign review fee was clarified to show that the first sign is included in the base rate.
Additional per sign fees are only charged if more than one sign is needed.
The last three items result in minor reductions. The first of these is granting staff the authority to
offer a temporary discount for various recreation programs to encourage greater participation.
While this will result in a short-term subsidy of the program, the hope is that it will increase
long-term participation. Discounts will only be temporary and requires City Manager approval.
In addition, West Covina’s Senior discount for dog licenses requires seniors to document their
income, which is both inconvenient for the dog owner and requires city staff time to monitor.
The proposed change simply offers one $12 discount per household to all seniors over age 60
provided the animal has been spayed or neutered. Lastly, the half-day rental for the Ridge Rider
Arena would be reduced to one half the full day rental, a reduction of $20.
FISCAL IMPACT:
No significant fiscal impact is anticipated if the proposed schedule of fees and charges are
adopted as proposed. Parking fines were already budgeted assuming the court take away would
be recovered. The other fees are not for high volume services so any additional revenue would
be minimal.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, SETTING AND INCREASING CERTAIN FEES.
WHEREAS, the City Council adopted Ordinance No. 1939 on August 16, 1994, a)
establishing its policy as to the recovery of costs and more particularly the percentage of costs
reasonably borne to be recovered from users of City services and b) directing staff as to the
methodology for implementing that Ordinance; and
WHEREAS, pursuant to Government Code Section 66018 the specific fees to be charged
for services must be adopted by the City Council by resolution after providing notice and holding
a public hearing; and
WHEREAS, notice and publicly available data has been provided per Government Code
Sections 66016 and 6062 (a), and the required public hearing held at which time oral and written
presentations were made and received; and
WHEREAS, staff has developed a revised schedule of fees and charges based on certain
new or increased costs for operating expenses.
NOW, THEREFORE, the City Council of the City of West Covina does resolve,
determine and order as follows:
Section 1. Fee Schedule Adoption. The following schedule of fees and charges shall be
computed and applied by the various City departments and collected by the City Finance
Department for the listed services when provided by the City or its designated contractors.
Section 2. Separate Fee for Each Purpose. All fees set by this resolution are for each
identified process. Where fees are indicated on a per unit of measurement basis the fee is for
each identified unit or portion thereof within the indicated ranges of such units.
A. Added Fees. Additional fees shall be required for each additional process or
services that is requested or required including where the requestor’s delay increases costs, or if
the original fee charged was too low or in error.
B. Refunds. Unless otherwise provided in the West Covina Municipal Code or
state law, in the event the person requesting the service withdraws his/her/its application or
otherwise terminates the request for service before completion of the provision of the service, or
if an error is made in calculating the fee, the City shall determine if any refund is owing, based
on whether all costs reasonably borne have been incurred or committed, as well as the cost of
refunding the fee. An amount not spent or committed shall be refunded, minus the cost of
refunding. Any extra amount charged in error shall be refunded without deduction.
Notwithstanding, refund amounts of $20 or less shall be refunded only upon request of the fee
payor.
C. Interpretation of Fee Schedule. Administrative interpretations of this
resolution, including but not limited to provisions for waiver and appeal, shall be determined by
the City Manager as set out in West Covina Municipal Code Section 2-407.
Section 3. Fee Schedule. The fees set out in Exhibit A, attached and incorporated here,
are hereby approved and adopted.
Section 4. Reasonable Cost Finding. The City Council specifically finds that based on
the data made available to the public, the fees and charges adopted do not exceed the reasonable
cost of the service provided.
Section 5. CEQA. The adoption of this resolution is statutorily exempt from CEQA as it
sets fees only for operating expenses.
Section 6. Repealer. Fees contained in this resolution supersede fees set by prior
resolutions. Current fees set by prior resolutions, which are not modified by Exhibit B, remain in
place.
Section 7. Severability. If any portion of this resolution is found to be unconstitutional
or invalid, the City Council hereby declares that it would have enacted the remainder of this
resolution regardless of the absence of any such invalid part.
Section 8. Effective Date. This resolution shall be effective July 1, 2011.

Because Sports Council leagues do not pay for athletic
fields, lights or gym usage, there is currently no
consequence for non-compliance. A fine penalizing
leagues that fail to comply provides a method for

SUBJECT: IDENTIFICATION OF NEW PROJECTS FUNDED BY COMMUNITY
DEVELOPMENT BLOCK GRANT (CDBG) FUNDS
RECOMMENDATION:
It is recommended that the City Council consider a range of new CDBG-eligible projects and
direct staff to come back with costing elements for those that are the most desirable.
DISCUSSION:
The City receives an annual grant of CDBG Funds from the U.S. Department of Housing and
Urban Development (HUD). CDBG is a federal program with an overall objective of developing
viable urban communities by providing decent housing and a suitable living environment, and
expanding economic opportunities principally for low and moderate income persons.
Through March 31, 2011, the City has an unobligated balance of CDBG Funds totaling
$780,343. This total includes the unobligated balance in the City’s CDBG line-of-credit with
HUD of $631,343 as well as $150,000 that would result from the anticipated cancellation of a
project approved in 2008 to install an elevator in the Police Department. This project may be
funded in a future budget.
Because HUD requires that funds be used in a timely manner staff recommends that the City
identify new projects for which these funds can be obligated and expended. New projects or
significant changes to the funding or scope of existing projects would require a substantial
amendment process, which includes public noticing, a 30-day review period, and a public
hearing.
To qualify for CDBG funding, projects must first be shown to principally serve persons of low
and moderate income. One way to meet this requirement is on an area basis. Maps identifying
CDBG-eligible Census Tracts (Attachment No. 1) and Census Block Groups (Attachment No. 2)
are included in this report. Maps assist in the preliminary evaluation process, however the scope
of a proposed project and service area must ultimately be considered and approved by HUD as
an eligible activity under CDBG regulations.
CDBG-eligibility of projects is evaluated on a case-by-case basis, however, staff has identified a
number of options and preliminary cost estimates the City Council may want to consider:

HUD has a strong interest in public involvement relative to use of the funds. The City is
required to have a Citizen Participation Plan, which includes the aforementioned substantial
amendment process, for the purpose of encouraging involvement. Bearing this in mind, staff
recommends holding a community-based meeting to ascertain projects of interest from residents
adjacent to Del Norte and Palmview Parks if the City Council ultimately decides to proceed with
projects at these locations.
ALTERNATIVES:
1. It is recommended that the City Council consider a range of new CDBG-eligible projects
and direct staff to come back with costing elements for those that are the most desirable.
2. Provide alternate direction.
FISCAL IMPACT:
There is no fiscal impact resulting from this report. Based on the projects that the City Council
deems most desirable, staff will submit costs of construction and associated long-term
maintenance that will be brought back to the City Council for further consideration.
