Yauchzee, Director/City Engineer Public Works Department SUBJECT: WASTE MANAGEMENT ENFORCEMENT AGENCY HEARING PANEL RECOMMENDATION: It is recommended that the City Council appoint three primary and two alternate Councilmembers to the City’s Waste Management Agency Hearing Panel; such appointed shall coincide with City Council rotation and terms. DISCUSSION: In 1992, the California Department of Resources Recycling and Recovery (CalRecycle) certified the City of West Covina’s designation of the Waste Management Enforcement Agency program to oversee the BKK landfill operations, which included the five-member City Council as the Hearing Panel. The Hearing Panel’s responsibility is to be the mediator on enforcement matters that are objected to by the landfill operator. There has never been an occasion that required the need to activate the City’s hearing panel since the Waste Management Enforcement Agency program was established 15 years ago. The CalRecycle Local Enforcement Agency Program Assistance and Evaluation section has requested an update as to which three City Council members will serve as the “primary” hearing panel appointees to the City’s Waste Enforcement Agency. The update is required to be in compliance with state regulations. Staff recommends that the members be appointed in the same order and terms as the City Council rotation. Thus, the current three members would be Mayor Steve Herfert, Mayor Pro-Tem Michael Touhey, and Councilmember Sherri Lane, and Councilmember Shelley Sanderson and Councilmember Karin Armbrust would be the alternates. ALTERNATIVES: Appoint three primary members including two alternates. This would require Council action each time rotation and terms changes.
