AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA REPEALING ORDINANCE NO. 2220 AND
ORDINANCE NO. 2221 PROHIBITING CONSTRUCTION OF GUEST
HOUSES, HABITABLE SPACE ADDITIONS, SPORTS COURTS, TENNIS
COURTS; SWIMMING POOLS AND OTHER SIMILAR TYPES OF
IMPROVEMENTS ON THE REAR, LOWER PORTION OF
EQUESTRIAN ORIENTED PROPERTIES IN SPECIFIED AREAS OF
THE CITY
WHEREAS, on September 6, 2011, the City Council adopted urgency West Covina City
Council Ordinance No. 2220 prohibiting the approval or issuance of any licenses, permits,
grading permits, building permits, tentative parcel or tract maps or other entitlements for the
construction of guest houses, habitable space additions, sports courts, tennis courts, swimming
pools and other similar types of improvements on the rear, lower portion of the properties further
than 125 feet from the front property line for properties located at 2633, 2641, 2653, 2707, 2715,
2727, 2743, 2755, 2769, and 2807 Vanderhoof Drive, West Covina; and
WHEREAS, on October 4, 2011, the City Council adopted West Covina City Council
Ordinance No. 2221 extending the effective date of urgency Ordinance No. 2220; and
WHEREAS, on May 1, 2012, the City Council introduced a West Covina City Council
ordinance establishing development standards and regulations for the construction of guest
houses, habitable space additions, sports courts, tennis courts, swimming pools and other similar
types of improvements on the rear, lower portion of the properties affected by urgency
Ordinances No. 2220 and No. 2221; and
WHEREAS, there is no longer a need for the zoning moratorium enacted by West Covina
City Council Ordinances No. 2220 and No. 2221.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF WEST COVINA
CALIFORNIA DOES HEREBY ORDAIN AS FOLLOWS:
SECTION NO. 1: West Covina City Council Ordinance No. 2220 is repealed
commencing on the effective date of West Covina City Council ordinance revising the standards
for the separation of animal keeping areas from residential uses, revising the requirements for
guest house covenants and establishing standards for the Animal Keeping Overlay Zone..
SECTION NO. 2: West Covina City Council Ordinance No. 2221 is repealed
commencing on the effective date of West Covina City Council ordinance that adds the Animal
Keeping Overlay Zone to the subject properties.
SECTION NO. 3: The proposed action is considered to be exempt from the provisions
of the California Environmental Quality Act (CEQA); pursuant to Section 15061(b)(3) of the
CEQA Guidelines, in that the proposed action consists of the adoption of a zoning moratorium
ordinance which does not have the potential for causing a significant effect on the environment.
SECTION NO. 4: The City Council hereby declares it would have passed this
Ordinance sentence by sentence, paragraph by paragraph, and section by section, and does
hereby declare that the provisions of this Ordinance are severable and, if for any reason any
sentence, paragraph, or section of this Ordinance shall be held invalid, such decision shall not
affect the validity of the remaining parts of this Ordinance.
SECTION NO. 5: The City Clerk shall certify to the passage of this Ordinance and it
shall be published as required by law.
