AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, AMENDING THE PROCEDURES
FOR THE SETTING OF SEWER FEES BY RESOLUTION
WHEREAS, California Health and Safety Code Sections 5470-5470.10 authorize the
City Council to adopt by ordinance a system for prescribing, revising and collecting sewer fees;
and
WHEREAS, the City Council of the City of West Covina desires to amend the
procedures of prescribing, revising and collecting sewer fees by Resolution of the City Council.
NOW, THEREFORE, the City Council of the City of West Covina does hereby ordain as
follows:
SECTION 1. The proposed action is considered to be exempt from the provisions of the
California Environmental Quality Act (CEQA), pursuant to Section 15061(b)(3) of the CEQA
Guidelines, in that the proposed action consists of a code amendment, which does not have the
potential for causing a significant effect on the environment.
SECTION 2. Section 23-46 of Division 1 or Article II of Chapter 23 of the West Covina
Municipal Code, regarding fees for sewer connections, maintenance and other related fees is
added to read as follows:
"Sec. 23-46. Fees and Charges.
All sewer connection fees, maintenance fees and other sewer related fees and charges
shall be set by resolution of the City Council. The resolution may also provide that such sewer
fees and charges shall be collected as part of the annual County Secured Property Tax Bill."
SECTION 3. Effective Date: This ordinance shall be effective 30 days from the date of
its adoption.
SECTION 4. That the City Clerk shall certify to the passage of this ordinance and shall
cause the same to be published as required by law.
