Ordinance - 2025ORDINANCE NO.2025 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CERTAIN SECTIONS OF CHAPTER 26 (ZONING) OF THE WEST COVINA MUNICIPAL CODE TO REQUIRE A CONDITIONAL USE PERMIT FOR HOTELS WITHIN THE CITY OF WEST COVINA (CODE AMENDMENT NO. 282). WHEREAS, Code Amendment No. 282 is a City -initiated project to require a conditional use permit for hotels within the City of West Covina; and WHEREAS, the Planning Commission did, upon giving the required notice, did on the 13th day of October, 1998, conduct a duly advertised public hearing as prescribed by law, at which time the Planning Commission adopted Resolution No. 10-98-4525, recommending to the City Council approval of Code Amendment No. 282; and WHEREAS, the City Council. considered evidence presented by the Planning Commission, Planning Department, and other interested parties at a duly advertised public hearing on the 17th day of November, 1998; and WHEREAS, studies and investigations made by the City Council and in its behalf reveal the following facts: 1. Chapter 26 of the West Covina Municipal Code (Zoning) should be amended to establish a conditional use permit review process for the establishment and operation of hotels; and 2. There currently exists a discretionary review of "Motel" operations through the Conditional Use Permit process while the operation of "Hotels" are currently permitted by right; and 3. There currently exists a discretionary review of the physical development of a hotel through the Precise Plan process; and 4. Within recent years, there has been a growing trend in the lodging industry toward specialized limited service hotels and specialized marketing techniques that target the business traveler and/or extended stay client. Such new facilities tend to be a hybrid of design and operation characteristics of hotels and motels; and 5. With the new trends in the lodging industry, there is an increasing need to establish discretionary control over the operational aspects of hotels to ensure that hotels will not create adverse impacts; and 6. One of the stated goals of the West Covina General Plan is to "arrange land uses with regard to the health, safety, convenience and welfare of the residents of the City," and the proposed code amendment will serve in the achievement of that goal; and 7. The proposed action is considered to be a Categorical Exemption, Class 8 (Section 15308 - Actions by Regulatory Agencies for Protection of the Environment) pursuant to the provisions of the California Envitonmental Quality Act (CEQA), of 1970, since the City of West Covina is establishing a conditional use permit review process for hotels. CAWINDOWS\TEMP\Hotel CUP (Ord.01).doc Ordinance No. Code Amendment No. 282 Hotel CUP December 1, 1998 Page 2 of 3 9 NOW, THERFORE, the City Council of the City of West Covina, California, does hereby ordain as follows: SECTION NO. 1: Based on the evidence and the findings set forth, Code Amendment No. 282 is hereby found to be consistent with the West Covina General Plan and the implementation thereof. SECTION NO. 2: Based on the evidence presented and the findings set forth above, the City Council of the City of West Covina hereby amends Section 26-597 of the West Covina Municipal Code by deleting the "x" and adding a "c" preceding the listing of "Hotels" within the matrix of permitted nonresidential uses, thereby requiring a conditional use permit for hotels within the City of West Covina, as follows: * Indicates stated use is prohibited in the Civic Center Overlay Zone. x Indicates stated use is allowed by right. c Indicates stated use is allowed by conditional use permit. p Indicates stated use is allowed subject to administrative review and approval by the planning director. s Indicates stated use may be a specialized nonresidential use and may require a conditional use permit approval if it is proposed in an existing, planned, or proposed commercial center and the planning director finds the conditional use permit necessary. a Indicates stated use is allowed by administrative use permit. b Indicates stated use is allowed by adult oriented business permit.
