AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, CALIFORNIA, APPROVING ZONE CHANGE NO.659.

CATEGORICAL EXEMPTION
APPLICANT: West Covina Chrysler/Plymouth — Steve Bell
LOCATION 1829 E. Garvey Avenue, North
WHEREAS, there was filed with this City a verified application on the forms
prescribed in Section 26-153 and 26-199 of the West Covina Municipal Code, for the
reclassification from:
Neighborhood Commercial (N-C) to Service Commercial (S-C) (Exhibit A)
on that certain property generally described as follows:
Los Angeles County Assessor's Parcel Number 8454-018-023; and
WHEREAS, the proposed zone change is consistent with the existing General Plan
Designation of Service and Neighborhood Commercial and Redevelopment Plan
Designation of Service Commercial; and
WHEREAS, the proposed zone change maintains consistency between the General
Plan and Zoning Map; and
WHEREAS, said zone change application is requested to allow for the
establishment of an automobile dealership on a site designated for such use in the West
Covina Redevelopment Project Area Plan; and
WHEREAS, the Planning Commission, upon giving the required notice, did on the
23rd day of June, 1998, conduct a duly advertised public hearing to consider the subject
application for a zone change, at which time the Planning Commission adopted Resolution.
No. 06-98-4510, recommending to the City Council approval of Zone Change No. 659; and
WHEREAS, the City Council did, on the 7th day of July, 1998 conduct a duly .
advertised public hearing as prescribed by law, to consider evidence presented by the
Planning Commission, Planning Department, and other interested parties; and
WHEREAS, studies and investigations made by the City Council and in its behalf
reveal the following facts:
1. The applicant is requesting approval of a zone change from Neighborhood
Commercial (N-C) to Service Commercial (S-C).
2. This zone change application is submitted in conjunction with a request for
approval of a precise plan to allow the establishment of an automobile
dealership.
3. The proposed zone change application is requested to bring zoning into
consistency with adjacent zoning and to facilitate the establishment of an
automobile dealership on the site. Further, the zone change will allow for
future assembly of like zoned properties to complete the build -out of a 12-

acre auto sales . facility by the applicant. The Redevelopment. Agency
anticipates entering into an Exclusive Negotiation Agreement in the
immediate future for the expansion project. The proposed zone change
consistent with the General Plan and the Redevelopment Project Area Plan.
4. Approval of the zone change to facilitate the development and expansion of
the automobile dealership will promote the goals and policies of the General
Plan by expanding the economic base, and establishing a land use pattern
that promotes the health, safety, convenience, and welfare of the residents.
5. Approval of the zone change will allow for the economic use of a site that
has been vacant for more than five years and that is designated under the
definition as "blighted" by the Redevelopment Project Area Plan'.
6. Findings necessary for approval of a zone change are as follows:
a. There are changed conditions since the existing zoning became
effective to warrant other or additional zoning.
b. The proposed change of zone will not adversely affect adjoining
property as to value or precedent and will not be detrimental to the
area.
C. A change of zone will be in the interest or furtherance of the public
health, safety, and general welfare.
d. The approval of such a change of zone will not adversely affect the
comprehensive General Plan so adopted by the City.
e. The approval of such a zone change is consistent with the General
Plan or applicable specific plans.
7. Pursuant to the requirements of the California Environmental Quality Act
(CEQA) of 1970, this project is a Categorical Exemption, Class 1 (Section
15305: minor alterations in land use limitations), since the project consists
of rezoning of commercial designations within the same General Plan
designation. No Environmental Impact Report or Negative Declaration is
required to be filed.
WHEREAS, based on the evidence presented to the City Council, both oral and
documentary, the City Council finds as follows:
a. Throughout the middle 1960's and extending through the late 1970's, a
series of zone changes to the Service Commercial (S-C) Zone classification
occurred to surrounding properties that resulted in the subject property left
to remain as the only non-contiguous parcel zoned as Neighborhood
Commercial (N-C).
Since the construction of Interstate 10 approximately four decades ago,
freeway corridor development has intensified to one of the more significant
levels within the southern California region. Further, recognizing the
regional influence created by the high visibility of Garvey Avenue from
Interstate 10 and the related high traffic counts, numerous auto dealerships
and an auto mall have been developed along the freeway corridor, thus
creating changes in the land use pattern. Therefore, there are changed
circumstances that have occurred since the previous zoning of the property
became effective. A change in zoning will further serve to implement the
goals and policies of both the General Plan and the Redevelopment Plan.

b.. The zone change facilitates the elimination of an otherwise isolated zoning
classification as the subject property is the final remaining property to be
rezoned to Service Commercial (S-C) since the zone change transition began
in the mid-1960's. Approval of the request further completes the zone
change process for the area and is, therefore, not precedent setting. The
proposed reuse of the vacant property is oriented to and consistent with
freeway activity and will continue an orderly land use pattern consistent
with other uses 'in the vicinity.
C. The proposed zone change will allow the reuse of the subject property in a
manner consistent with surrounding land uses and will re-establish the
viability of a property that has been vacant, defined as "blighted" by the
Redevelopment Plan and that has not been adequately maintained for
approximately five years. Reclassification of the zoning of the underutilized
and physically limited site in conjunction with the associated establishment
of an auto dealership will, therefore, be in the interest and furtherance of the
public health, safety, and general welfare.
d. The proposed zone change will not adversely affect the General Plan as
consistency between the General Plan and the Zoning Map will be
maintained. Further, the zone change will result in the implementation of a
number of goals and policies contained in the General Plan by; 1) providing
for a range of non-residential uses that will ensure a strong economic base
for the City, 2) arrange land. uses with regard to the health, safety,
convenience and welfare of the residents of the City, 3) develop and expand
the local economy in order to create new employment opportunities, attract
new investment and strengthen the tax base of the City, 4) maximize new
revenue accruing to the City from economic development, and 5) preserve
and strengthen existing development in the City.
e. The subject site currently has a General Plan Land Use Designation of
Service and Neighborhood Commercial and a Redevelopment Plan
Designation of Service Commercial. The proposed zone change from
Neighborhood Commercial (N-C) to Service Commercial (S-C) is consistent
with the existing General Plan and Redevelopment Plan designations.. As
stated in Finding "d." above, there are a number of goals that this project
serves to implement.
NOW, THEREFORE, the City Council of the City of West Covina, California, does
hereby ordain as follows:
SECTION NO. 1: Based on the evidence presented, and the findings set forth, the
above Zone Change No. 659 is hereby found to be consistent with the City's
General Plan and the land uses permitted within said zone classification.
SECTION NO. I. This project is a Categorical Exemption in accordance with the
California Environmental Quality Act of 1970, as amended.
SECTION NO. 3 • The City Council does hereby approve Zone Change No. 659
(Exhibit A) changing the zoning classification for the subject property as forth on
the zoning map of the City of West Covina from Neighborhood Commercial (N-C)
to Service Commercial (S-C) as depicted on Exhibit A:
SECTION NO. 4: The City Clerk shall certify as to the passage of this Ordinance
and shall cause the same to be published as required by law.
