ORDINANCE NO. 2003
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA REGARDING JUVENILE TRAFFIC
SAFETY AND DECLARING THE URGENCY THEREOF
The City Council of West Covina does ordain as follows:
so' Section 1. Findings.
1. The City Council finds that children are endangered and a safety hazard has been created
within the City when parents and others load or unload juvenile students across the street from school
sites in areas without a crosswalk or traffic signal and students then cross the street through traffic.
2. Parents blame the School District and the City if a child is injured.
An urgency ordinance is necessary.
Section 2. Section 22-199 is added to the West Covina Municipal Code to read as follows:
22-199 - Loading and Unloading of Juvenile Passengers
(a) No operator of a motor vehicle shall stop or park to load or unload juvenile
passengers where such loading or unloading is in a location which would cause the juvenile to cross the
street unattended without a crosswalk or signal;
(i) where there is no crosswalk or signal within 100 feet;
(ii) where such loading or unloading is prohibited by signage;
(iii) in an intersection, private driveway, or traffic lane;
(iv) in a manner that places passengers in a hazardous situation, including but not
limited to beckoning juvenile to cross the street in violation of this section.
(b) Notwithstanding, subsection (a) shall not apply when the operator is directed to stop
or park and passengers to unload at the direction of a peace officer.
(c) As used herein, "juvenile" means children twelve (12) years of age or younger.
Section 3. Sections 1-37.1 and 1-37.2 hereby are amended to add a section which is an
infraction for which a citation may be written.
Section 4. Effective Date. This ordinance shall be effective immediately for the preservation of
public safety.
