AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST
COVINA, AMENDING CERTAIN SECTIONS OF CHAPTER 22
(TRAFFIC .REGULATIONS) OF THE WEST COVINA MUNICIPAL
CODE TO INCORPORATE REGULATIONS RESTRICTING THE
PARKING OF VEHICLES DISPLAYING "FOR SALE" SIGNS (CODE
AMENDMENT NO. 278).
WHEREAS Code Amendm
ent No. 278 is a City -initiated project to develop
code provisions to control the concentration of "for sale" vehicles parked on public
streets and directly adjacent non-residential properties; and
WHEREAS, the Planning Commission did, on the 8th day of April, 1997,
conduct a duly advertised public. hearing as prescribed by law at which time the
Planning Commission adopted Resolution No. 4-97-4426, recommending to the City
Council approval of Code Amendment No. 278 related to vehicles displaying "for
sale" signs; and
WHEREAS, the City Council considered evidence presented by the Planning
Commission, Planning Department, and other interested parties at a duly advertised
public hearing on the 6th day of May, 1997; and
WHEREAS, studies and investigations made by the City Council and in its
behalf reveal the following facts:
1. The current provisions contained within Chapter 22 (Traffic Regulations) of
the West Covina Municipal Code do not regulate the parking of a vehicle
which displays a sign advertising such vehicle for sale; and
2. The lack of such standards has resulted in instances of "for sale" vehicles
being parked, at times in concentrated numbers, along public streets and
adjacent parking lots, which has created adverse impacts on traffic safety and
aesthetics within the West Covina community; and
3. Vehicles that are displayed for sale and parked within the public right-of-way,
or on property directly adjacent thereto, can constitute a hazard to traffic
safety by distracting the attention of passing motorists; and
4. The uncontrolled display of "for sale" signs on vehicles parked on public
streets and adjoining private parking lots can be aesthetically unattractive
and detract from the visual quality of the surrounding environment; and
5. Local legislation based on aesthetic and safety concerns is a legitimate
exercise of a community's police powers to protect the public health, safety,
and welfare; and
6. The establishment of reasonable controls on parking of "for sale" vehicles will
serve to better ensure the safety of motorists and protect the positive image
'of the West Covina community; and
7. One of the stated goals of the Land Use Element of the West Covina General
Plan is to "provide and maintain an aesthetically pleasant environment for
40 those who live, work, play, and visit in West Covina;" and
8. One of the stated goals of the Circulation Element of the West Covina
General Plan is to "provide a comprehensive transportation system for the
movement of people and goods within and through the City in a manner that
maximizes efficiency and convenience, while minimizing danger and delay;"
and

9. The adoption of this ordinance will serve to advance the achievement of the
aforementioned General Plan goals; and
10. It has been determined that the project will not have a significant effect on the
environment and is categorically exempt from the provisions of the California
Environmental Quality Act (CEQA).
so NOW, THEREFORE, the City Council of the City of West Covina does
hereby ordain as follows:
SECTION NO. 1: Based on the evidence presented and the findings set
forth, Code Amendment No. 278 is hereby found to be consistent with the West
Covina General Plan and the implementation thereof.
SECTION NO. 2: Based on the evidence presented and the findings set
forth, the City Council of the City of West Covina hereby amends Section 22-183 of
the West Covina Municipal Code to read as follows:
Sec. 22-183. Parking for certain purposes prohibited.
No person shall park a vehicle upon any roadway for the principal purpose of:

(ba) Washing, servicing, repairing, or otherwise working on such vehicle except
repairs necessitated by an emergency.
(sb) Selling therefrom or therein any article, service or thing; provided that, any
peddler or canvasser licensed under the provisions of any ordinance of the city may
take orders or deliver any commodity from a vehicle on that part o f any street
immediately adjacent to the premises of any purchaser.
SECTION NO. 3: The City Council of the City of West Covina hereby
renumbers Section 22-183.1 as Section 22-183.2, and adopts a new Section 22-
183.1 to read as follows:
Sec. 22-183.1 Display of "for sale" signs on vehicles
(a) No more than two (2) vehicles owned by any one (1) person or firm and
displaying a sign indicating or advertising such vehicle for sale may be parked on
any roadway at anv one time.
(b) No person shall park a vehicle with a sign advertising such vehicle for sale
within the public right-of-way of any of the followinq streets within the city limits of the
City of West Covina: Amar Road Azusa Avenue Barranca Street Cameron
Avenue, Citrus Street, Garvey Avenue North Garvey Avenue South Glendora
Avenue Grand Avenue Lakes Drive Plaza Drive Sunset Avenue Vincent Avenue
Goor West Covina Parkway.
(c) Except upon a lot operated by a licensed automobile dealership no person
shall park a vehicle with a sign advertising such vehicle for sale upon any portion of
any private non-residential property within 100 feet of the right of way of the
following streets: Amar Road Azusa Avenue Barranca Street Citrus Street
Garvey Avenue North Garvey Avenue South Glendora Avenue Grand Avenue

Lakes Drive, Plaza Drive, Sunset Avenue Vincent Avenue or West Covina
Parkway.
SECTION NO. 4: The City Clerk shall certify to the passage of this
Ordinance and shall cause the same to be published as required by law.
