Ordinance - 1994ORDINANCE NO. 1994 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 651 - Hassen Imports Partnership). WHEREAS, there was filed with the City a verified application on the forms pp prescribed in Section 26-153 and 26-199 of the West Covina Municipal Code a request for a zone change for the reclassification from: "Multiple -Family Residential (MF-20)" to "Service Commercial (S-C)" (Exhibit 1) on that certain property generally described as follows: Los Angeles County Assessor's Parcel Numbers 8478-004-039, 905; and WHEREAS, the proposed zone change is consistent with the existing General Plan Designation of "Service and Neighborhood Commercial" and Redevelopment Plan Designation of "Service Commercial"; and WHEREAS, said zone change is requested to provide consistency between the General Plan and Zoning Map; and WHEREAS, said zone change application is requested to allow for the expansion of an existing automobile dealership onto a site that has been planned for an automobile dealership and identified as such in the Redevelopment Project Area Plan; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 25th day of March, 1997, conduct a duly noticed public hearing to consider said application, at which time the Planning Commission adopted Resolution No. 2- 97-4419, recommending to the City Council approval of Zone Change No. 651; and WHEREAS, the City Council did, on the 15th day of April, 1997, conduct a duly advertised public hearing as prescribed by law to consider evidence presented by the Planning Commission, Planning Department, and other interested parties. WHEREAS, studies and investigations made by the City Council and in its behalf reveal the following facts: 1. The applicant is requesting approval of a zone change from "Multiple - Family Residential (MF-20)" to "Service Commercial" (S-C). 2. This zone change application is submitted in conjunction with a request for a revision to a precise plan to allow the expansion of an existing automobile dealership. 3. The proposed applications are requested to facilitate the buildout of the originally planned auto mall, in a manner that is consistent with the General Plan and the Redevelopment Project Area Plan. 4. Approval of the zone change to facilitate the expansion of the automobile dealership will promote the goals and policies of the General Plan by expanding the economic base, and establishing a land use pattern that promotes the health, safety, convenience, and welfare of the residents. There are changed conditions since the existing zoning became effective to warrant other or additional zoning. 46 b. The proposed change of zone, will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. C. A change of zone will be in the interest or furtherance of the public health, safety, and general welfare. d. The approval of such a change of zone will not adversely affect the comprehensive General Plan so adopted by the City. e. The approval of such a zone change is consistent with the General Plan or applicable specific plans. 6. Based on the findings of an initial study, it has been determined that although the proposed project could have a significant effect on the environment, there will be none in this case due to the mitigation measures which have been incorporated into the project design and required as conditions of approval. A Negative Declaration of Environmental Impact has been prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act (CEQA) of 1970, as amended; and WHEREAS, based on the evidence, both oral and documentary, the City Council finds as follows: a. In January of 1981, the West Covina Redevelopment Agency adopted specific guidelines for the Garvey Avenue Auto Center (later named "Auto Plaza") and parceled off four individual lots suitable for auto dealership development. Then, in 1984 the Agency approved the development of the final two parcels for automobile dealerships and at the same time began exploring the expansion of the "Auto Plaza". In December of 1984, the Environmental Impact Report for Amendment Number 3 to the Central Business District Redevelopment Project Area was certified and plans approved to allow for the future development of what is referred to as the "Juniper Site" in historical documents. This resulted in a land use pattern that surrounded the current MF-20 site on three sides by automobile dealerships, with Garvey Avenue and the San Bernardino (1-10) Freeway on the north. The amended redevelopment plan for the "Auto Plaza," identified the apartment site as a potential future site for a new automobile dealership. The proposed zone change will facilitate the buildout of the "Auto Plaza" along the 1-10 Freeway frontage. Therefore there are changed circumstances that have occurred since the previous zoning of the property became effective. A change in zoning will further serve Goto implement goals and policies of the General Plan. b. The subject property is the final remaining undeveloped property within the "Auto Plaza" fronting the 1-10 Freeway. The development of an automobile dealership, or in this situation expanding an existing dealership, will facilitate the elimination of an incompatible zoning classification and will, in converse, continue an orderly land use pattern in a manner consistent with adjacent land uses. Further, the Z:\CC\ORDINSDM\WCDGZCRS.DOC Ordinance No. Hassen Imports Partnership (West Covina Dodge) Zone Change 651 April 15, 1997 - Page 3 site is entirely surrounded on three sides by existing dealerships (on the east and south by the dealership to be expanded, and on the west by a Saturn dealership). The site is the final property located within the automobile dealership to be developed with a new dealership. Therefore, the zone change will not be precedent setting, rather it will facilitate the buildout of the "Auto Plaza." C. The proposed change of zone will be in the furtherance of the public's health and general welfare, as the site is no longer utilized for residential purposes and is currently sitting vacant. In addition, the zone change will result in the removal of the residential site from within a freeway noise impact zone. The Redevelopment Plan has been implemented by relocating the previous residents to new housing through the implementation of a housing replacement and relocation plan. Development. of the site will eliminate the underutilized site within the "Auto Plaza" and, by doing so, will further the economic base of the community. d. The proposed zone change will not adversely affect the General Plan as it is intended to provide consistency between the General Plan and the Zoning Map. Further, the zone change is intended to result in the implementation of a number of goals and policies contained in the General Plan by; 1) providing for a range of non-residential uses that will ensure a strong economic base for the City, 2) arrange land uses with regard to the health, safety, convenience and welfare of the residents of the City, 3) develop and expand the local economy in order to create new employment opportunities, attract new investment and strengthen the tax base of the City, 4) maximize new revenue accruing to the City from economic development, and 5) preserve and strengthen existing development in the City. e. The subject site currently has a General Plan Land Use Designation of "Service and Neighborhood Commercial" and a Redevelopment Plan Designation of "Service Commercial". The proposed zone change from "Multiple -Family Residential (MF-20)" to "Service Commercial" is consistent with the existing General Plan and Redevelopment Plan designations. As stated in Finding d. above, there are a number of goals that this project serves to implement. NOW, THEREFORE, the City Council of the City of West Covina, California, does hereby ordain as follows: SECTION NO. 1: Based on the evidence presented, and the findings set forth, the above Zone Change No. 651 is hereby found to be consistent with the City's General Plan and the land uses permitted within said zone classification. SECTION NO. 2: A Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. 40 SECTION NO. 3: The City Council does hereby approve Zone Change No. 651, changing the zoning designation for the subject property as set forth on the Zoning Map of the City of West Covina from "Multiple -Family Residential (MF-20)" to "Service Commercial (S-C)" as depicted on Exhibit 1. SECTION NO. 4: The City Clerk shall certify as to the passage of this Ordinance. and shall cause the same to be published as required by law.
