Ordinance - 1971ORDINANCE NO. 1971 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, RESCINDING URGENCY ORDINANCE NO. 1962. WHEREAS, on December 5, 1995, the City Council of the City of West Covina adopted Urgency Ordinance No. 1961 which established an interim administrative review process for the keeping of horses on eligible Residential Agriculture (R-A) and Single -Family Residential (R-1) zoned properties within Area Districts III, IV, and V; and WHEREAS, the urgency ordinance was adopted to protect the health and quality of life of residents from the potential fly, dust, and odor impacts associated with the keeping of horses; and WHEREAS, on January 16, 1996, the City Council adopted Urgency Ordinance No. 1962 which extended the provisions of Urgency Ordinance No. 1961 for a period of ten months and fifteen days in accordance with California Government Code Section 65858; and WHEREAS, on March 19, 1996, the City Council considered a report regarding a proposed code amendment to establish within the Zoning Code a requirement to obtain an administrative permit prior to establishing the keeping of horses on R-A and R-1 zoned properties; and WHEREAS, after receiving input from the Planning Commission and the public regarding the proposed code amendment, the City Council declined to proceed with the amendment and further directed staff to prepare an ordinance to rescind Urgency Ordinance No. 1962; and WHEREAS, the City Council, upon giving the required notice, did on the 7th day of May 1996, conduct a duly advertised public hearing as prescribed by law to consider the proposed ordinance which would rescind Urgency Ordinance No. 1962, thus removing the requirement to obtain an administrative permit prior to keeping horses on R-A and R-1 zoned properties. NOW, THEREFORE, the City. Council of the City of West Covina, California hereby ordains as follows: SECTION NO. 1: The City Council finds as follows: a. The current horse maintenance standards contained within the Zoning Code are sufficiently designed to protect the health and quality of life of residents who live adjacent to properties on which horses are kept. b. Property owners who fail to comply with any of these horse maintenance standards will be subject to City of West Covina Code Enforcement legal proceedings. MSECTION NO. 2: Based on the evidence presented and the findings set forth, Urgency Ordinance No. 1962 is hereby rescinded in its entirety. SECTION NO. 3: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
