Ordinance - 1957ORDINANCE NO. 1957 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING CERTAIN SECTIONS OF THE WEST COVINA MUNICIPAL CODE RELATING TO MOBILE BUSINESSES (AMENDMENT NO. 263). WHEREAS, staff has received numerous requests from mobile pet groomers and other mobile business operators to provide mobile services at residential and non- residential sites located within the City of West Covina; and WHEREAS, Chapter 26 (Zoning) of the West Covina Municipal Code currently makes no provisions to allow mobile business within the City; and WHEREAS, Chapter 14 (Licenses and Business Regulations) of that same Code does authorize certain types of mobile businesses providing services associated with stationary property fixtures which cannot be provided off -site; and WHEREAS, the Planning Commission had received a request to amend the Zoning Code to allow mobile businesses which are not necessarily associated with stationary property fixtures; and WHEREAS, at the January 24, 1995 meeting of the Planning Commission, Resolution No. 1-95-4275 was approved initiating the amendment procedure for the Mobile Businesses Ordinance; and WHEREAS, at that same meeting, a study session was held to discuss the matter and staff received direction to draft code language to incorporate into a final resolution for recommendation to the City Council; and WHEREAS, the Planning Commission, upon giving the required notice, did on the 11th day of April, 1995, conduct a duly advertised public hearing as prescribed by law; and approved Planning Commission Resolution No. 4-95-4294 recommending that the City Council adopt Amendment No. 263; and WHEREAS, the City Council considered evidence presented by the Planning Commission, Planning Department, and other interested parties at a duly advertised public hearing on the 2nd day of May, 1995; and WHEREAS, the oral and documentary evidence considered in connection with the code amendment reveal the following facts: 1. The General Plan of the City of West Covina maintains as one of its goals the preservation of the essential residential character of West Covina - a City of beautiful homes; the maintenance of existing residential development;. and providing an aesthetically pleasant environment for those who live, work, play and visit in West Covina; and 2. Allowing mobile businesses to provide services in residences and businesses will not create negative impacts on surrounding properties provided that the prescribed standards are adhered to; and 3. Allowing mobile businesses in the City will provide an added convenience for those who live and work in West Covina; and 95-0612/1 JAY/A2630R. DOC Ordinance No. Mobile Businesses Ordinance (Amd. No. 263) May 16. 1995 - Page 2 4. Mobile businesses involving services posing potential violations of environmental, health, and safety laws should be prohibited from operating in the City; and 5. Mobile businesses providing services associated with property fixtures that cannot be provided off -site at a stationary commercial shop should be exempt from any new standards since these services are already permitted through licensing; and 6. The project is Categorically Exempt as a Minor Alterations in Land Use Limitations (Class 5) per Section 15305 of the California Environmental Quality Act (CEQA) of 1970, as amended. NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of West Covina as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth, Amendment No. 263 is hereby found to be consistent with the West Covina General Plan and the implementation thereof. SECTION NO. 2: Based on the evidence presented and the findings set forth, the City Council of the City of West Covina hereby amends Chapter 26 (Zoning) of the West Covina Municipal Code to read as follows: Chapter 26 ZONING* Art. No. 263) May 16. 1995 - Page 3 ARTICLE XI. NONRESIDENTIAL USES 0 Sec. 26-597. Service, trade, cultural, public and private uses (except industrial or manufacturing). No building or improvement or portion thereof shall be erected, constructed, converted, established, altered or enlarged, nor shall any lot or premises be used except for one or more of the following purposes. All such uses shall be within an enclosed building unless specifically stated otherwise. Uses specifically noted as "(Outdoor Display)": Outdoor display and sales uses are allowed providing all functions other than display are at all times conducted within an enclosed building. SPECIAL REGULATIONS FOR UNIQUE USES DIVISION 13. MOBILE MEDICAL SERVICES Sec. 26-685.50. Purpose. Sec. 26-685.52. Mobile Services Permitted. 95-0612/JAY/A2630 R. D OC Ordinance No. Mobile Businesses Ordinance (Amd. No. 263) May 16. 1995 - Page 4 (a) For the purposes of this division, mobile services shall include specified commercial services that are rendered at residences or places of business, provided only in response to direct requests for such services. Mobile services shall be limited to those typically and customarily provided by stationary service businesses permitted in the commercial zones (not including the M-1 zone) of the City. (b) Mobile services shall not include services that, in the opinion of the Planning Director, would pose a negative impact upon nearby properties when provided. (c) Mobile services involving the maintenance of stationary property fixtures shall be exempt from the provisions of this division, notwithstanding that such services must comply with the provisions of Chapter 14 of the West Covina Municipal Code (Licenses and Business Regulations). These services shall include, but are not limited to, gardeners, pool maintenance, and building contractors d) The Plannina Director shall be authorized to make determinations reaardina the conformance of proposed mobile services with these stated criteria, provided} however, that the decision of the Planning Director may be appealed to the Planning Commission pursuant to the procedures of Section 26-212 of this Chapter. Sec. 26-685.54. . Standards for Mobile Services Operation. (a) Mobile services provided at residences may be rendered only to the residents of the subject property. Mobile services provided at places of business may be rendered only to the owner or proprietor of the subject business, or to employees of the subject business with the consent of the owner or proprietor. (b) Mobile services may be provided only in response to direct request for such services. and may not be provided through "door-to-door" solicitation (c) The total number of days that a service may be provided at a particular residence or place of business by a given mobile service operator shall be limited to a maximum of five (5) during any given thirty (30) day period (d) Mobile services may be rendered only between the hours of 8:00 a.m. and 9:00 p.m., except as prohibited by noise regulations contained in Chapter 15 of the West Covina Municipal Code. (e) Mobile services shall be provided entirely within enclosed buildings, with the exceptions of the following services: i. auto repair and services provided at single-family residential properties, provided it occurs in conformance with Section 26-391(1) of this Chapter (including the prohibition of power tools after 8:00 p.m.). and further provided that oil. gasoline, and other flammable or hazardous materials are properly disposed of in accordance with environmental laws and regulations. 95-0612/JAY/A2630R. No. 263) May 16. 1995 - Page 5 ii. auto repair and services provided at multiple -family residential properties, provided it occurs in conformance with Section 26-436(I) of this Chapter (including the prohibition of power tools after 8:00 p.m.). and further provided that oil, gasoline, and other flammable or hazardous materials are properly disposed of in accordance with environmental laws and regulations. iii. services provided at residential properties, provided it occurs within a commercial service vehicle designed for the particular service provided (f) Licenses and permits as required in Chapter 14 of the West Covina Municipal Code (Licenses and Business Regulations) must be obtained by operators of mobile services. (g) The Planning Director shall be authorized to make exceptions to these standards, based on extraordinary circumstances. provided that negative impacts are not created, provided, however, that the decision of the Planning Director may be appealed to the Planning Commission pursuant to the procedures of Section 26-212 of this Chapter. BUSINESS LICENSES DIVISION 3. FEES Sec. 14-68. Schedule. The several rates for licenses for the pursuit of businesses, trades, and occupations hereinafter set forth, and to be paid by the owners or agents thereof, shall be those fixed and established from time to time by the city council by resolution and are subject to the category codes and restrictions as follows: Category Code S: Special Businesses. 21.
