AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, MOVING THE DATE OF
THE GENERAL MUNICIPAL ELECTION FROM THE SECOND
TUESDAY IN APRIL OF EVEN -NUMBERED YEARS TO THE
FIRST TUESDAY AFTER THE FIRST MONDAY IN MARCH
OF ODD -NUMBERED YEARS
WHEREAS, Section 2551 of the California Elections Code provides
that the statewide direct primary and the presidential primary shall be
consolidated and conducted on the fourth Tuesday in March in any year
divisible by the number four beginning in 1996;
WHEREAS, the General Municipal Election is now scheduled for the
second Tuesday in April of even -numbered years;
WHEREAS, if the General Municipal election is held two weeks
after the California Presidential Primary, the County Election Department
may be unable to assist or to loan equipment to the City to conduct the
General Municipal Election; there is a significant risk of voter con-
fusion, as voters in the City will receive two sets of absentee ballot
supplies, two sample ballot pamphlets and directions for two elections at
different polling locations two weeks apart; and it may be difficult to
secure election precinct workers willing to work in the polling place; and
WHEREAS, Election Code Section 2601 authorizes the City to
reschedule its General Municipal Election to avoid the practical
difficulties noted above.
NOW, THEREFORE, THE CITY COUNCIL OF WEST COVINA DOES ORDAIN AS FOLLOWS:
SECTION 1. Pursuant to. Section 2601 of the California Elections Code
the April, 1996, election will be held on March 4, 1997, and thereafter
the date of the General Municipal election of the City of West Covina is
moved to the first Tuesday after the first Monday in March of each odd -
numbered year.
SECTION 2. In accordance with the change of election date, the terms
of office of those members of the City Council presently serving shall be
extended for a period of approximately eleven (11) months until election
results are declared by the City Council.
SECTION 3. This ordinance shall take effect thirty (30) days after
its .final passage. Within 30 days of the effective date, the City Clerk
shall cause a notice to be mailed to all registered voters of the City
informing them of the change in the election date.
SECTION 4. The City Clerk shall certify to the passage and adoption
of this ordinance and shall cause the same to be published according to
law.
