ORDINANCE NO. 1916
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, EXTENDING
ORDINANCE NO. 1894 PURSUANT TO SECTION
65858(a) OF THE CALIFORNIA GOVERNMENT CODE.
1. WHEREAS, pursuant to the provisions of Section 65858(a) of
the Government Code of the State of California, the City Council on
March 17, 1992, adopted Ordinance No. 1894, allowing temporary
additional signage for multiple -family buildings in multiple -family
zones; and
2. WHEREAS, pursuant to Section 65858(a) of the Government
Code, Ordinance No. 1894 was adopted as an interim measure for a
period of no longer than 45 days; and
3. WHEREAS, pursuant to Section 65858(a) of the Government
Code, after notice and a public hearing, the City Council on April
21, 1992, extended the Interim Ordinance for a period of ten months
and fifteen days; and
4. WHEREAS, pursuant to Section 65858(a) of the Government
Code, after notice and public hearing, the City Council may by a
four -fifths vote extend the Interim Ordinance one final time for
one year period; and
5. WHEREAS, without the extension of the Interim Ordinance,
additional signage would not be available pursuant to the West
Covina Municipal Code for the\purpose of assisting in attracting
tenants during the current recession; and
6. WHEREAS, without the extension of the Interim Ordinance,
the lack of such additional signage could negatively impact the
public welfare and the economy of West Covina; and
7. WHEREAS, it has been found necessary to study the Zoning
Code standards relative to the provision of flags, banners and
pennants for the purpose of the lease of rental of multiple -family
units; and
8. WHEREAS, completion of a comprehensive study of the Zoning
Code relative to such signage will require approximately 9 to 12
months to complete; and
9. WHEREAS, a public hearing was held by the City Council on
March 2, 1993, and it was found that without the extension of
Ordinance No. 1894, the potential exists for damage to the public
welfare and the economy of West Covina.
NOW, THEREFORE, the City Council of the City of West Covina
does ordain as follows:
SECTION 1: This Ordinance is adopted extending Ordinance No.
1894 to March 2, 1994, pursuant to Section 65858 (a) of the
California Government Code and Section 4 of Ordinance No. 1894.
SECTION 2: Sections 26-371 shall be amended and supplemented
to read as follows:
• Notwithstanding the foregoing, during the effective period of
this ordinance in multiple -family zones in addition to the signs
allowed under West Covina Municipal Code Section 26-371 and Section
26-372, banners pertaining to the lease or rental of units shall be
allowed subject to the following provisions:
a. The maximum number of such banners shall be limited
to one per each street frontage.

b. The banner(s) must be attached flat against a
building, facing the abutting street right-of-way.
The banners) must be located below the top of a
parapet wall or below the roof eave of the
building.
C. The copy on the banner(s) shall be limited to the
name of the owner or leasing agency, the agency
logo, telephone number, and phrases "for lease,
rent, now available" or other similar messages.
The banner shall not contain more than three
colors.
d. The maximum banner size shall be 3 feet by 15 feet.
e. Any illumination of the banner(s) shall comply with
Section 26-307.
f. The banner(s) shall be maintained in good repair in
compliance with Sections 26-303 and 26-308 by their
owner by periodically repairing or replacing the
banner(s) in its entirety.
In addition, flags and pennants shall be allowed subject to
the following provisions:
a. . Flags/pennants shall be permitted on a pole not to exceed
fifteen (15) feet in height. Flags/pennants shall not be
attached to any building, fence or structure.
b. No more than one flag/pennants shall be permitted for
each forty (40) linear feet of street frontage.
C. The size of flags/pennants shall not exceed two (2) feet
by three and one-half (32) feet.
d. Flags/pennants shall not include more than three colors
on any given parcel.
e. Any illumination of flags/pennants shall comply with
Section 26-307.
f. All flags/pennants shall be maintained in good repair in
compliance with Section 26-303 and 26-308 by their owner
by periodically repairing or replacing them.
g. Flag/pennant stiffeners shall not be permitted.
Upon expiration of this interim ordinance, all banners, flags
and pennants erected under this interim ordinance shall be removed
within 10 days of the expiration date.
SECTION 3.
Severability.
If any provision of this ordinance is held invalid by a court
of competent jurisdiction, the remainder of the ordinance shall not
• be invalid and shall be affected thereby.
SECTION 4. Effective Date
This Ordinance is adopted as an urgency measure to protect the
current and immediate public safety, health and welfare and shall
take effect immediately upon its adoption. A statement of facts as
above set forth in the recital of this,Ordinance cites a current

and immediate threat to the public health, safety or welfare and
failure to provide additional signage will result in a continued
threat. The legal authority of the enactment of this Ordinance is
Section 65858 (a) of the California Government Code and other
applicable statutes. This ordinance shall be of no force and
effect one year from the date of its adoption.
SECTION 5. The Mayor shall sign and the City Clerk shall
certify to the adoption of this Ordinance by not less than a four -
fifths vote and cause the same to be published in the manner
prescribed by law.
