Ordinance - 1901• IN ORDINANCE NO. 1901 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE OFFICIAL ZONING MAP (ZONE CHANGE NO. 641) WHEREAS, on November 25, 1992, the City Council of the City of West Covina adopted Resolution No. 8758, initiating the subject zone change from: Los Angeles County Zoning Designation R-1-7500 to West Covina Zoning Designation R-1, Area District II on that certain property described as follows: Assessor Book -Page -Parcel: 8490 - 004 - 063 WHEREAS, after considering the proposed project in a duly advertised public hearing on the 9th day of March, 1992, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council approve said zone change; and WHEREAS, the City Council of the City of West Covina has considered evidence presented by the Planning Department, the Planning Commission and other interested parties at said public hearing held on March 9, 1992; and WHEREAS, the oral and documentary evidence considered in connection with the proposed project reveal the following facts: 1. This is a City initiated project to prezone the subject property with the City's "R-1, Area District II" classification. 2. The subject prezoning is being proposed in connection with the Local Agency Formation Commission's (LAFCO) March 11, 1992, decision to approve Annexation No. 243. 3. The proposed prezoning is consistent with the goals and objective of -the General Plan of the City. 4. Findings necessary for approval of a zone change are as follows: a. There are changed conditions since the existing zoning became effective to warrant other or additional zoning. b. The proposed change of zone will® not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. C. A change of zone will be in the interest or furtherance of public health, safety, and general welfare. d. The approval of such change of zone will not adversely affect the comprehensive General Plan so adopted by the City. e. An initial study prepared for the subject project has disclosed that the proposed project could not have a significant effect of the environment. A Negative -Declaration isof Environmental Impact has been prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended. WHEREAS, based on the evidence presented to the Planning Commission, both oral and documentary, the Planning Commission finds as follows: a. There are changed conditions since the existing zoning became effective to warrant other zoning. The property owner has petitioned LAFCO for annexation to the city. Should LAFCO approve the petition, prudent planning practice dictates the need to prezone. b. The proposed change of zone will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area in that the proposed zoning is comparable and compatible with the existing zoning and/or development. C. The change of zone will allow the continuance of existing uses in a manner which is comparable and compatible with the existing zone and surrounding development. It is consistent with the City's General Plan goals to arrange land uses with regard to health, safety, convenience and welfare of the residents of the city. It represents sound long term planning, in anticipation of potential annexation by eliminating a source of confusion regarding future zoning. d. The approval of such change of zone will not adversely affect the General Plan but will be consistent with the proposed General Plan designation for the site. The zone change will also act to implement the goals of the General Plan such as providing and maintaining an aesthetically pleasant environment for those who live and play in West Covina; and, to continuously refine and improve the physical, economic and social environment of West Covina to assure that it continues to be a beautiful and well -ordered community, striving for the highest quality in its facilities, amenities and physical appearance. e. The proposed change of zone is consistent with the proposed General Plan designation for the area. NOW, THEREFORE, the City Council of the City of West Covina, does resolve as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth, Zone Change No. 641 is hereby found to be consistent with the goals and objectives of the City's General Plan and appropriate for the subject area based upon the existing and surrounding development and land uses. SECTION NO. 2: A Negative Declaration of Environmental Impact has been prepared in accordance with the California Environ- mental Quality Act of 1970, as amended. SECTION NO. 3: The City Council does hereby approve Zone Change No. 641, subject, to final action taken by LAFCO on Annexation No. 243. 0195-92/C:CC/ORDZC641/em Ordinance No. 1901 ZC641/Gretta Prezone April 7, 1992 - Page 3 SECTION NO. 4: The City Clerk shall certify to the passage of this ordinance and shall cause the same to be published as required by law. • PASSED AND APPROVED this 21st day of April , 1992.
