AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING THE
OFFICIAL ZONING MAP (Zone Change No. 633 -
Goldrich and Kest Industries),
WHEREAS, there was filed with the City of West Covina a
verified application on the forms prescribed in Section 26-153 and
26-199 of the West Covina Municipal Code, for the reclassification
from:
"Residential Agricultural (R-A), Area District IV" to ""Low
Density Multiple Family (MF-15)" (Exhibit 1)
on that certain property generally described as follows:
Assessor Parcel Nos. 8277-001-012, and 8277-001-013, as
shown on the latest rolls of the Los Angeles County Tax
Assessor; and
WHEREAS, after considering the proposed request in a duly
advertised public hearing on the 24th day of February, 1992, as
prescribed by law, the Planning Commission of the City of West
Covina' recommended that the City Council approve said zone change;
and
WHEREAS, the City Council of the City of West Covina has
considered evedence presented by the applicant, the Planning
Department, the Planning Commission and other interested parties at
said public hearing held on March 17, 1992; and
WHEREAS, the oral and documentary evidence considered in
connection -with the application reveal the following facts:
1. The applicant is requesting approval of a zone change
from "Residential Agricultural (R-A), Area District IV"
to "Low Density Multiple Family (MF-15)."
2.. This zone change application is submitted in conjunction
with a request for a General Plan Amendment, East Hills
Specific Plan Amendment, tentative tract map, precise
plan and a tree removal permit to construct a 56 unit
townhouse condominium development.
3. The proposed zone change is contingent upon the approval
of the proposed General Plan Amendment and East Hills
Specific Plan Amendment.
4. Findings necessary for approval of a zone change are as
follows:
a. There are changed conditions since the existing
zoning became effective to warrant other or
additional zoning.
b. The proposed change of zone will not adversely
affect adjoining property as to value or precedent
and will not be detrimental to the area.
C. A change of zone will be in the interest or
furtherance of the public health, safety and
general welfare.
d. The approval of such a change of zone will not
adversely affect the comprehensive General Plan so
adopted by the City.

e. The approval of such a zone change is consistent
with the General Plan or applicable specific plans.
5. An initial study disclosed that the above project may
• have a significant effect on the environment, and an
Environmental Impact Report has been prepared for the
proposed project pursuant to the requirements of the
California Environmental Quality Act (CEQA) of 1970, as
amended.
WHEREAS, based on the evidence presented to the City Council,
both oral and documentary, the City Council finds as follows:
a. The subject property was annexed into the City of West
Covina in 1960 as a part of Annexation No. 165 (Ordinance
No. 676). Prior to annexation to the City, while under
Los Angeles County jurisdiction, the properties zoning
designation was R-A 40,000. Since the City did not have
a comparable designation, the property's zoning designa-
tion was changed.to Residential -Agriculture (R-A), Area
District IV (Zone Change No. 174), which requires a
minimum lot size of 20,000 square feet. This zoning
designation in currently in effect.
Subsequent to the zone change in 1960, Grand Avenue the
adjacent Principal Arterial, was extended through to the
city of Walnut (1967-68) opening the area up to through
traffic. More recently, Grand Avenue was extended further
into Diamond Bar and to the Pomona Freeway. In addition
to this intensification, the San Bernardino (I-10)
Freeway was extensively widened in the early 19701s.
Together, these two actions have changed the character of
the area by allowing for an increase in vehicular traffic
and the resulting intensification of land uses along
major transportation routes in the urbanized areas.
b. The proposed change of zone will not adversely affect
adjoining properties in that the proposed development
will act as a transition from the high intensity of the
San Bernardino Freeway into the adjacent single-family
residential areas. The design of the proposed develop-
ment incorporates elements such as berming and sound
walls that address the adjacent freeway and Grand Avenue,
an arterial street. The style of architecture, setbacks
and landscaping treatment address the character of the
existing single-family residential areas to the south.
In addition, the equestrian trail that extends the entire
width of the site on the south is proposed to be better
defined and improved by the proposed development.
Development of the proposed project will benefit the City
and vicinity and will not adversely affect adjacent
properties.
C. The proposed change of zone is in the interest of public
health, safety and general welfare as the characteristics
of the area have changed since the original zoning became
effective. Due to the increased intensity of the San
Bernardino Freeway, Grand Avenue and land uses adjacent
to the freeway, the site is now located in a noise impact
zone. As a result of the noise and traffic, the site is
not suitable for single-family residential development
that would also create a number of new openings onto the
roadways and create difficulty in abating noise. As
proposed, the site will act as a transition from the San
Bernardino (I-10) Freeway into the adjacent residential
properties to the south. The project has been designed

with extensive noise abatement devices and limited new
access points onto existing roadways. The noise
abatement devises, berming and sound -walls will not only
screen noise from the proposed development but also act
as a noise barrier from existing single-family
residences. In addition, the proposed project will
provide new housing alternatives.
d. The granting of this zone change will not adversely
affect the General Plan, but will be consistent with the
proposed General Plan designation for the site. Addi-
tionally, the Zone Change will aid in the implementation
of the general plan by changing the zoning on under-
utilized land thus allowing for an attractive,. higher
density development.
e. The proposed change of zone from "Residential -Agricul-
tural, (R-A), Area District IV" to "Low Density Multiple -
Family" Residential is consistent with and implements the
proposed General Plan and East Hills Specific Plan desig-
nations of "Medium Density Residential (8.1 -15.0
du/acre)." In addition, the proposed zone change is
consistent with the Eastland Redevelopment Project Area
designation of "Planned Development."
NOW, THEREFORE, the City Council of the City of West Covina,
California, does ordain as follows:
SECTION NO. 1: Based on the evidence presented, and the
findings set forth, the above Zone Change No. 633 is approved
subject to the condition that Zone Change No. 633, shall not
become effective until the applicant shows proof, to the
satisfaction of the Planning Director, that Tract Map No.
50037 has been recorded with the Office of the Recorder of the
County of Los Angeles.
SECTION NO. 2: An Environmental Impact Report has been
prepared in accordance with the California Environmental
Quality Act of 1970, as amended.
SECTION NO. 3: The City Council of the City of West Covina
approved Zone Change No. 633 (Exhibit 1 and 2 incorporated by
reference), subject to the following conditions:
1. Zone Change No. 633 is being processed concurrently with
and is contingent upon the approval of General Plan
Amendment No. 14, and East Hills Specific Plan Amendment
No. 7.
SECTION NO. 4: The City Clerk shall certify to the passage of
this ordinance and shall cause the same to be published as
required by law.
