Ordinance - 1894ORDINANCE NO. 1894 AN URGENCY ZONING ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA TEMPORARILY ALLOWING RENTAL BANNERS, FLAGS AND PENNANTS FOR DEVELOPMENTS IN MULTIPLE -FAMILY ZONES • THE CITY COUNCIL OF THE CITY OF WEST COVINA DOES ORDAIN AS FOLLOWS: Section 1. Findings: The City Council of the City of West Covina finds as follows: (A) that present provisions of the West Covina Municipal Code regulates "for rent" or "for lease" signage in multiple - family zones; (B) that owners and managers of multiple -family buildings in multiple -family zones believe that additional signage will assist in attracting tenants during the current recession; (C) that this ordinance is an urgency matter necessary to protect the public welfare and the economy of West Covina. Section 2. Sections 26-371 shall be amended and supplemented to read as follows: Notwithstanding the foregoing, during the effective period of this ordinance in multiple -family zones in addition to the signs allowed under West Covina Municipal Code Section 26-371 and Section 26-372, banners pertaining to the lease or rental of units shall be allowed subject to the following provisions: a. The maximum number of such banners shall be limited to one per each street frontage. b. The banner(s) must be attached flat against a building, facing the abutting street right-of-way. The banner(s) must be located.below the top of a parapet wall or below the roof eave of the building.. C. The copy on the banner(s) shall be limited to the name of the owner or leasing agency, the agency logo, telephone number, and phrases "for lease, rent, now available" or other similar messages. The banner shall not contain more than three colors. d. The maximum banner size shall be 3,feet by 15 feet. e. Any illumination of the banner(s) shall comply with Section 26-307. f. The banner(s) shall be maintained in good repair in compliance with Sections 26-303 and 26-308 by their owner by periodically repairing or replacing the banner(s) in its entirety. 0154-92/C:CC/URGBANNE.RS/em Ordinance No. 1894 Urgency Zoning Ord Temporarily Allowing Rental Banners, Flags and Pennants for Multi -Family Units March 17, 1992 - Page 2 • In addition, flags and pennants shall be allowed subject to the following provisions: a. Flags/pennants shall be permitted on a pole not to exceed fifteen (15) feet in height. Flags/pennants shall not be attached to any building, fence or structure. b. No more than one flag/pennant shall be permitted for each forty (40) linear feet of street frontage. C. The size of flags/pennants shall not exceed two (2) feet by three and one-half ( 3 z ) feet. d. Flags/pennants shall not include more three colors on any given parcel. e. Any illumination of flags/pennants shall comply with Section 26-307. f. All flags/pennants shall be maintained in good repair in compliance with Section 26-303 and 26-308 by their owner by periodically repairing or replacing them. g. Flag/pennant stiffeners shall not be permitted. Upon expiration of this interim ordinance, all banners, flags and pennants erected under this interim ordinance shall be removed within 10 days of the expiration date. Section 3. Severability. If any provision of this ordinance is held invalid by a court of competent jurisdiction, the remainder of the ordinance shall not be invalid and shall be affected thereby. Section 4. Effective Date. This ordinance is an urgency ordinance pursuant to Government Code § 65858 necessary for the economic welfare of the City of West Covina and its residents and business and as such shall be effective immediately. It shall be of no force and effect 45 days hereafter unless renewed pursuant to that section. PASSED, APPROVED AND ADOPTED this 17th day of March, 1992.
