Ordinance - 1875• ORDINANCE NO. 1875 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 637 - Sunset Medical Group) WHEREAS, there was filed with the City of West Covina a verified application on the forms prescribed in Section 26-153 and 26-199 of the West Covina Municipal Code, for the reclassification from; "Single -Family Residential (R-1), Area District II" to "Neighborhood -Commercial (N-C)" (Exhibit 2) on that certain property generally described as follows: Lots 10, 13 and portions of Lots 11 and 12 of Tract No. 19453 as recorded in Map Book 551 - Pages 19 through 23 filed in the County Recorders Office of Los Angeles County; and WHEREAS, after considering the proposed request in a duly advertised public hearing on January 23, 1991, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council approve said zone change; and WHEREAS, the City Council upon giving the required notice, did on the lath day of March, 1991, conduct a duly advertised public hearing as prescribed by law to consider said application; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission and other interested parties. at said public hearing held on January 23, 1991; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from "Single -Family Residential (R-1), Area District II" to "Neighborhood -Commercial (N-C)". 2. The zone change application is submitted in conjunction with a request for an amendment to the General Plan land use designation from "Low -Medium Density Residential" to "Service and Neighborhood Commercial" a request for a tentative parcel map, and a precise plan. 3. Findings necessary for approval of a zone change are as follows: a. There are changed conditions since the existing zoning became effective to warrant other or additional zoning. b. The proposed change of zone will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. 0171-91/CC/ZC637SUN.SET/bc Ordinance No. Sunset Medical March 11, 1991 1875 Group - Page 2 C. A change of zone will be in the interest or furtherance • of the public health, safety and general welfare. d. The approval of such a change of zone will not adversely affect the comprehensive General Plan so adopted by the City. e. The approval of such a zone change is consistent with. the General Plan or applicable specific plans. 4. An initial study prepared for the subject project has disclosed that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because mitigation measures have been incorporated into the project's design and as conditions of approval. A Negative Declaration of Environmental Impact has been prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended; and WHEREAS, based on the evidence presented to the City Council, both oral and documentary, the City Council finds as follows: a. There are changed conditions since the existing zoning became effective to warrant a change in zone as the subject site is located adjacent to Sunset Avenue which carries approximately 26,500 vehicles per day. The properties along Sunset Avenue have been developed with commercial and medical uses since the 1960's. The northeast corner of Sunset and Merced Avenues was zoned C-1 subsequent to the development of homes to the north and east. A portion of the corner was developed with an automobile service station, another portion with a convenience store and the bulk of what is now the subject site, remained vacant. b. The proposed "Neighborhood -Commercial" zone classification will allow the property to be developed as a medical facility which is consistent with other properties in the same vicinity. Over the past few decades the area along Sunset Avenue has been developed with medical facilities, many of which are adjacent to residentially zoned properties. Staff believes the proposed medical office building will provide a valuable service to the community, while providing a suitable transition into the residential neighborhood to the east. An eight -foot high decorative wall will be provided along the east and north property lines in order to screen the noise and view generated by the new parking area that will occupy this portion of the site. In addition, landscaped planters will be provided and planted with specimen size plant materials to help buffer the site from the adjacent residences. 0171-91/CC/ZC637SUN.SET/bc Ordinance No. 1875 Sunset Medical Group March 11, 1991 - Page 3 • C. The proposed change of zone will be in the interest of public health, safety and general welfare as the proposed zoning provides for a suitable transition into a low -medium density residential zone. The zoning will enable the site to be developed with a medical of f ice building which provides a valuable medical service to the community. d. The granting of this zone change will not adversely affect the General Plan, but will be consistent with the existing and proposed General Plan designation for the site. Additionally, the zone change will act to implement many goals and policies within the General Plan which call for uses and facilities to serve the residents of the City. e. The proposed change from "Single -Family Residential (R-1), Area District II" to "Neighborhood -Commercial, (N-C) " is consistent with the General Plan designation of "Service and Neighborhood Commercial." The proposed change is also consistent with the CBD Redevelopment area designation of "Neighborhood -Commercial." NOW, THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: SECTION NO. 1: Based on the evidence presented, both oral and documentary, the above Zone Change No. 637 is approved subject to the condition that Zone Change No. 637, shall not become effective until the applicant shows proof, to the satisfaction of the Planning Director, that Parcel Map No. 22798 has been recorded with the Office of the Recorder of the County of Los Angeles.
