Ordinance - 1869ORDINANCE 1869 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 635 - W.F. Biewers). • WHEREAS, there was filed with the City a verified application on the forms prescribed in Chapter 26, Article VI of the West Covina Municipal Code, for the reclassification from; "Office -Professional" to "Service -Commercial" (Exhibit 1) on that certain property generally described as follows: Assessor Parcel No. 8443-020-034, as shown on the latest maps of the Los Angeles County Tax Assessor's Office; and WHEREAS, after considering the proposed request in a duly advertised public hearing on December 5, 1990, as prescribed by law, the Planning Commission of the City of West Covina recommended that the City Council approve said zone change; and WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, and the Planning Commission, and other interested parties at said public hearing held on January 14, 1991; and WHEREAS, the oral and documentary evidence considered in connection with the application reveal the following facts: 1. The applicant is requesting approval of a zone change from "Office -Professional (O-P)" to "Service -Commercial (S-C)". 2. This zone change application is submitted in conjunction with and is contingent upon approval of a request for a variance for substandard lot size, width and depth. 3. The proposed zone change is consistent with the General Plan of the City. 4. Findings necessary for approval of a zone change are as follows: a. There are changed conditions since the existing zoning became effective to warrant other or additional zoning. b. The proposed change of zone will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. C. A change of zone will be in the interest or furtherance of the public health, safety and general welfare. 9 2069/C:/Plancom/bc _Ord, No. 1869 ZC 635 - Biewers - Page 2 d. The approval of such a change of zone will not adversely affect the comprehensive General Plan so adopted by the City. • e. The approval of such a zone change is consistent with the General Plan or applicable specific plans. WHEREAS, based on the evidence presented to the City Council, both oral and documentary, the City Council finds as follows: a. The subject site was developed in 1963 under the "Restricted -Professional (R-P)" zone classification. When the existing zone classification of "Office -Professional" was established in March of 1968, all land in the "Restricted -Professional" Zone was transferred to and included in the "Office -Professional" Zone. With the subsequent establishment of the "Service -Commercial" Zone classification, properties adjacent to the subject site to the east and south were granted a change in zone classification to "Service -Commercial" to permit the development of office and retail commercial uses. The subject site remains under the restrictive "Office -Professional" zone classification while surrounding properties maintain zone classifications that permit retail and service commercial uses. b. The proposed change of zone will not adversely affect adjacent property as to value or precedent and will not be detrimental to the area. The subject application does not propose any alterations to the existing development on the subject site. The change of zone will bring the zoning of the subject site into conformity with zoning to the east and south and will permit retail and service commercial uses of a higher intensity at the site. The uses permitted under the proposed zone classification are similar to uses permitted in the surrounding commercial areas. The proposed zone change will not adversely affect the "Single -Family Residential (R-1)" zoned property to the north, as it is developed with a water pumping station. 9 2069/C:/Plancom/bc Ora. No. 1869 ZC 635 - Biewers - Page 3 C. The proposed zone classification will permit those retail and commercial uses that are permitted in the "Service -Commercial" zone. Due to the location of the • site and the proximity and visibility from a principal arterial, Azusa Avenue, retail and service commercial uses are appropriate for the site. The proposed zone classification will permit a wider variety of uses than those allowed under the existing "Office -Professional" zoning classification. d. The granting of this zone change will create consistency between the zone classification and General Plan land use designation of "Service and Neighborhood Commercial". The zone change will act to aid in the implementation of the goals and policies of the General Plan which call for uses and facilities to serve the residents of the City and strengthen the employment and economic base within the City. e. The proposed zone change from "Office -Professional (O-P)" to "Service -Commercial (S-C)" is consistent with the General Plan land use designation of "Service and Neighborhood Commercial". NOW, THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: SECTION NO. 1: Based on the evidence presented and the findings set forth, the above Zone Change No. 635 is hereby found to be consistent with the City's General Plan and appropriate for the proposed development concept and the land uses permitted within said zone classification.
