AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA
MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP
(Zone Change No. 632- Chris Cheung).
WHEREAS there was filed with the City of West Covina a
verified application on the forms prescribed in Section 26-153
and 26-199 of the West Covina Municipal Code, for the
reclassification from:
"Single -Family Residential (R-1), Area District I"
to "Neighborhood Commercial, N-C" (Exhibit 1)
on that certain property generally described as follows:
That portion of Lot 102 of E.J. Baldwin's Second
Subdivision of a part of Rancho La Puente, City of West
Covina, as per map recorded in Book 7, Page 7 of Maps in
the office of the County Recorder of said County,
described as follows:
Beginning at a point in the Southwesterly line of said
Lot distant thereon south 48' 25' 18" East, 150.00 feet
from the most Westerly corner of said Lot; thence
continuing south 48' 25' 18" East, 57.43 feet to a point
distant along said Southwesterly line 207.43 feet from
said most Westerly Corner of said lot; thence North 410
31' 50" East along a line parallel with the
Northwesterly line of said Lot a distance of 160.00
feet; thence North 480 25' 18" West, 57.43 feet along a
line parallel with the southwesterly line of said lot;
thence south 41' 31' 50" West along a line parallel with
the Northwesterly lot line a distance of 160.00 feet to
the point of beginning.
Property aka: 2117 West Francisquito Avenue, West
Covina, California.
WHEREAS, after considering the proposed request in a duly
advertised public hearing on June 20, 1990, as prescribed by law,
the Planning Commission of the City of West Covina recommended
that the City Council approve said zone change; and
WHEREAS, the City Council of West Covina has considered
evidence presented by the applicant, the Planning Department, the
Planning Commission, and other interested parties at said public
hearing held on July 23, 1990; and
WHEREAS, the oral and documentary evidence considered in
connection with the application reveal the following facts:
1. The applicant is requesting approval of a zone change from
"Single -Family Residential, R-1 A.D.I." to "Neighborhood
Commercial, N-C."
2. This zone change application is submitted in conjunction
with a request for a variance.
• 3. The proposed zone change is consistent with the General Plan
of the City.

4. Findings necessary for approval of a zone change are as
follows:
a. There are changed conditions since the existing zoning
became effective to warrant other or additional zoning.
b. The proposed change of zone will not adversely affect
adjoining property as to value or precedent and will
not be detrimental to the area.
c. A change of zone will be in the interest or furtherance
of the public health, safety and general welfare.
d. The approval of such a change of zone will not adversely
affect the comprehensive General Plan so adopted by the
City.
e. The approval of such a zone change is consistent with
the General Plan or applicable specific plans.
WHEREAS, based on the evidence presented to the City
Council, both oral and documentary, the City Council finds as
follows:
1. There are changed conditions since the existing zoning
became effective that warrant a change of zone to
"Neighborhood Commercial." The property was developed
commercially in 1959, under a use variance from the County.
Later, in 1961, the property was annexed to the City, and
the residential zoning classification was maintained. The
property immediately to the west was also developed while
under County authority through a use variance, and later,
in 1980, experienced a zone change to Neighborhood
Commercial. This chain of events represents the changed
conditions since the original zoning became effective which
warrant a change of zone.
2. The proposed zone change will not adversely affect
adjoining properties, as the proposed zone change will not
result in any physical changes. Further, the existing
development is approximately 30 years old and has been a
neighbor to residences on the north and east for the same
period of time. Future development of the site would be
required to meet current development standards and would be
subject to separate environmental review.
3. The proposed change of zone is in the interest of public
health, safety, and general welfare as it will allow for
consistency between the zoning classification and the
General Plan designation without impacting the surrounding
properties. The site has been developed commercially since
1959, and has functioned in harmony with surrounding
residences. The proposed zone change will aid in promoting
the goals and policies of the General Plan.

4. The granting of this zone change will not adversely affect
the General Plan, but will be consistent with the existing
General Plan Designation for the site. Additionally, the
zone change will act to implement many goals and policies
within the General Plan which call for uses and facilities
to serve the residents of the City and strengthen the
employment and economic base within the City.
5. The proposed change from "Single Family Residential, R-1,
A.D.1" to "Neighborhood Commercial, N-C" is consistent with
the General Plan designation of Service and Neighborhood
Commercial."
NOW, THEREFORE, the City Council of the City of West Covina,
California, does ordain as follows:
SECTION NO. 1: Based on the evidence presented and the
findings set forth, the above Zone Change No. 632 is hereby
approved as consistent with the City's General Plan and
appropriate for the proposed development concept and the land
uses permitted within said zone classification.
SECTION NO. 2: A Negative Declaration of Environmental
Impact has been prepared in accordance with the California
Environmental Quality Act of 1970, as amended.
