ORDINANCE ,NO. 1850
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA
MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP
(Zone Change No. 630 - Noel Novarro/Richard Longo-
bardo)
WHEREAS, there was filed with the City of West Covina a
verified application on the forms prescribed in Section 26-153
and 26-199 of the West Covina Municipal Code, for the
reclassification from:
"Residential -Agricultural (R-A), Area District V" to
"Single -Family Residential (R-1) Area District IV"
(Exhibit 1)
on that certain property generally described as follows:
That portion of Lot 7 of Tract No. 2371, in the City of West
Covina, in the County of Los Angeles, State of California, as
per map recorded in Book 23, Pages 98 and 99 of Maps, in the
office of the County Recorder of said County, described as
follows:
Beginning at the northeasterly corner of said lot; thence
south 10 04' west along the east line of said Lot 7 a distance
of 863.81 feet to the southeast corner thereof; thence north
880 56' west along the south line of said Lot 7, a distance of
229.81 feet; thence north 10 04' east 949.77 feet, more or
less, to a point in the southerly line of Cortez Street,
formerly California Avenue, as shown on said map; thence north
20 25' 10" east 30 feet to the center line of said Cortez
Street; thence easterly along said center line, being a curve
concave to the south having a radius of 400 feet, and a
central angle of 380 38' 50", the tangent to said curve at its
point of beginning, bearing south 870 34' 50" east, a distance
of 269.81 feet, the tangent to said curve at its point of
ending, bearing south 480 56' east; thence south 410 04' west
30 feet to the point of beginning.
Excepting therefrom the northerly 30 feet within the lines of
Cortez Street, formerly California Avenue, as shown on said
map.
Also except the south 380.42 feet of said land, measured along
the east and west lines of said land.
Also except therefrom the "Precious Metals and Ores Thereof"
as excepted from the partition between John Rowland, Sr, and
William Workman in the partition deed recorded in Book 10,
Page 39 of Deeds.
Also except the westerly 214.01 feet of the northerly 190.00
of the southerly 570.42 feet of that portion of Lot 7 of Tract
2371, as per map recorded in Book 23, Page 98 and 99 of Maps,
in the Office of the County Recorder, Los Angeles County, of
the State of California; and

WHEREAS, after considering the proposed request in a duly
advertised public hearing on May 16, 1990, as prescribed by law,
the Planning Commission of the City of West Covina recommended that
the City Council approve said zone change; and
• WHEREAS, the City Council upon giving the required notice, did
on the llth day of June, 1990, conduct a duly advertised public
hearing as prescribed by law to consider said application; and
WHEREAS, the City Council of West Covina has considered
evidence presented by the applicant, the Planning Department, the
Planning Commission, and other interested parties at said public
hearing held on June 11, 1990; and
WHEREAS, the oral and documentary evidence considered in
connection with application reveal the following facts:
1. The applicant is requesting approval of a zone change from
"Residential -Agricultural (R-A), Area District V" to
"Single -Family Residential (R-1), Area District IV".
2. The zone change application is submitted in conjunction
with a request for a tentative parcel map and variance.
3. The proposed zone change is consistent with the
"Low -Density Residential" land use designation of the
General Plan and East Hills Specific Plan.
4. Findings necessary for approval of a zone change are as
follows:
a. There are changed conditions since the existing zoning
became effective to warrant other or additional
zoning.
b. The proposed change of zone will not adversely affect
adjoining property as to value or precedent and will
not be detrimental to the area.
C. A change of zone will be in the interest or
furtherance of the public health, safety and general
welfare.
d. The approval of such a change of zone will not
adversely affect the comprehensive General Plan so
adopted by the City.
e. The approval of such a zone change is consistent with
the General Plan or applicable specific plans.
5. An initial study prepared for the subject project has
disclosed that although the proposed project could have a
significant effect on the environment, there will not be a
significant effect in this case because mitigation
measures have been incorporated into the project's design
and as conditions of approval. A Negative Declaration of
Environmental Impact has been prepared for the proposed
project pursuant to the requirements of the California
Environmental Quality Act of 1970, as amended; and

WHEREAS, based on the evidence presented to the City Council,
both oral and documentary, the City Council finds as follows:
a. The existing zoning classification of "Residential -
Agricultural (R-A), Area District V" was established as a
prezone for the area due to its similarity with the County
• zoning designation that was in place prior to annexation.
The proposed zone classification of "Single -Family
Residential(R-1), Area District IV" would reduce the
minimum lot size requirements from 40,000 to 20,000 square
feet. Due to the configuration of the subject site,
reduction of the minimum site size requirements would
permit a more efficient pattern of development of
otherwise underutilized residential land.

b. The proposed zone change will not adversely affect
adjoining property as to value or precedent and will not
be detrimental to the area. The proposed zoning
classification of "Single -Family Residential (R-1), Area
District IV" is consistent with the existing zoning
classification of properties adjacent to the subject site
to the east and will permit residential development in a
manner that is compatible with the surrounding
single-family residential development.
C. The proposed zone change is in the interest of public
health, safety and general welfare as it will facilitate
fuller utilization of residential land and permit a more
efficient pattern of development of the subject site by
reducing the minimum site size requirements.
d. The granting of the zone change will aid in the
implementation of the goals and policies of the General
Plan and will not adversely affect the General Plan.
e. The proposed change in zoning classification from
"Residential -Agricultural (R-A), Area District V" to
"Single -Family Residential (R-1), Area District IV" is
consistent with the General Plan and East Hills Specific
Plan land use designation of "Low Density Residential."
The proposed zone change would permit residential
development in a manner that is consistent with the goals
and policies of the General Plan and East Hills Specific
Plan in terms of density and pattern of development.

NOW, THEREFORE, the City Council of the City of West Covina,
California, does ordain as follows:
SECTION NO. 1: Based on the evidence presented, both oral and
documentary, Zone Change No. 630, is approved subject to the
condition that Zone Change No. 630, shall not become effective
• until the applicant shows proof, to the satisfaction of the
Planning Director, that Parcel Map No. 21156 has been recorded with
the Office of the Recorder of the County of Los Angeles.
SECTION NO. 2: Section 26-135 of the West Covina Municipal
Code is hereby amended by amending the official zoning map of the
City of West Covina as shown on the zoning map amendment (Exhibit
1) which is attached hereto and by this reference incorporated
herein.
SECTION NO. 3: A Negative Declaration of Environmental Impact
has been prepared in accordance with the California Environmental
Quality Act of 1970, as amended.
SECTION NO. 4: The City Clerk shall certify to the passage of
this Ordinance and shall cause the same to be published as required
by law.
