Ordinance - 1837• f ORDINANCE NO. 1837 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP (Zone Change No. 628 - Garellen Properties) WHEREAS, there was filed with the City of West Covina, a verified application on the forms prescribed in Section 26-153 and 26-199 of the West Covina Municipal Code, for the reclassification from: "Open Space, 0-S Freeway Corridor Overlay Zone" to "Office -Professional (0-P)" (Exhibit 1) on that certain property generally described as follows: THAT portion of lot 175 of E.J. Baldwin's fifth subdivision of a portion of Rancho La Puente, in the City of West Covina, County of Los Angeles, State of California, as shown on map recorded in Book 12 Pages 134 and 135, of maps, in the Office of the County Recorder of said county, described as follows: BEGINNING, at the northerly terminus of that course in the boundary line of parcel 40 of the proposed relinquishment (REL-910), shown as having a bearing and distance of south 00 36' 14" west 30.00 feet on map recorded July 26, 1976 in Book 14 Page 95 of State Highway Map Book, in the Office of the County Recorder of said county; thence south 890 34' 50" east 159.12 feet to a non -tangent curve in said boundary line of parcel 40 shown as concave southeasterly and having a radius of 185.00 feet; thence along said boundary line southwesterly along said curve from a tangent which bears 630 31' 52" west through an angle of 37' 34' 3711, an arc distance of 131.33 feet to a reverse curve in said boundary line concave northwesterly and having a radius of 102.00 feet; thence southwesterly along said reverse curve, from a tangent which bears south 250 57' 15" west through an angle of 640 38' 59", an arc distance of 115.09 feet; thence along said boundary line the following four courses; North 890 23' 46" west 21.95 feet, north 060 50' 42" east 113.93 feet, south 890 34' 50" east, 25.6.1 feet, north 00 36' 14" east 30.00 feet to the point of beginning. WHEREAS, after considering the proposed request in a duly advertised public hearing on January 17th and February 7th 1990, as prescribed by law, the Planning Commission of the City of West Covina recommended to the City Council denial of said zone change; and WHEREAS, the applicant did appeal Planning Commission's decision on February 8, 1990; and WHEREAS, the City Council upon giving the required notice, did on the 26th day of February, 1990, conduct a duly advertised public hearing as prescribed by law to consider said application; and 435 Ordinance No. 1837 Zone/628 - Garellen - Page 2 of 4 WHEREAS, the City Council of West Covina has considered evidence presented by the applicant, the Planning Department, the Planning Commission, and other interested parties at said • public hearing held on February 26, 1990. 1. The applicant is requesting approval of a zone change from "Open Space, 0-S" to "Office -Professional (0-P)." 2. This zone change application is submitted in conjunction with a request for a precise plan. 3. Findings necessary for approval of a zone change are as follows: a. There are changed conditions since the existing zoning became effective to warrant other or additional zoning. b. The proposed change of zone will not adversely affect adjoining property as to value or precedent and will not be detrimental to the area. C. A change of zone will be in the interest or further- ance of the public health, safety and general welfare. d. The approval of such a change of zone will not adversely affect the comprehensive General Plan so adopted by the City. e. The approval of such a zone change is consistent with the General Plan or applicable specific plans. 4. An initial study prepared for the subject project has disclosed that although the proposed project could have a significant effect on the environment, there will not be a significant effect in this case because mitigation measures have been incorporated into the project's design and as conditions of approval. A Negative Declaration of Environmental Impact has been prepared for the proposed project pursuant to the requirements of the California Environmental Quality Act of 1970, as amended. WHEREAS, based on the evidence presented to the Planning Commission, both oral and documentary, the City Council finds as follows: a. There are changed conditions since the existing zoning became effective to warrant other zoning as the property has been zoned "Open Space" since 1975. Over the past two and a half decades, land along the freeway has been developed with increasing intensity. As a result of this and other factors, traffic on the freeway has increased greatly which makes the site appropriate for a higher intensity use. In 1978, Amendment No. 145 was adopted approving the Freeway Corridor Overlay Zone consisting of all freeway excess parcels lying contiguous to the freeway. The purpose of the Overlay Zone is to ensure that the 435 Ordinance No. 1837 ZC/628 - Garellen - Page 3 of 4 goals of the environmental quality element of the General Plan are being met. Included in the Freeway Corridor Overlay Zone are specific uses and • development standards designed to carry out the goals of the General Plan. Further, the Freeway Corridor Overlay Zone specifically allows professional office buildings as permitted uses. The proposed project meets, and in some instances exceeds all applicable development standards of the zoning ordinance and General Plan by providing an attractively designed building with almost 39 percent of the site landscaped. b. The proposed zone change will not adversely affect adjoining properties. The proposed "Office - Professional" zone classification will allow the property to be developed with a professional office building which is consistent with the type of development called for in the Freeway Corridor Overlay Zone. The proposed development will benefit residential properties to the south as the property is located in a noise impacted zone, and will act as a sound barrier between freeway generated noise and the residences. C. The proposed change of zone is in the interest of public health, safety and general welfare as it will promote employment, add to the taxbase, promote economic stability in the community, enhance the urban scenic freeway corridor by providing an attractively designed office building, with almost 39 percent of the site landscaped, and protect the adjacent residential area from traffic noise generated by the freeway. d. The granting of this zone change will not adversely affect the General Plan. On the contrary, the zone change will act to implement many goals and policies within the General Plan. The I-10 Freeway is considered to be an urban scenic highway by the City of West Covina. The intent is to give the community an identity of "beauty, spaciousness, balance, taste, fitness, broad vistas, and high quality." The development standards of the Freeway Corridor Overlay Zone are designed to implement this broad intent. Other relevant goals and policies of the General Plan call for the provision of employment opportunities, an addition of the taxbase, and the promotion of economic stability. e. The proposed change "Open Space, O-S" to "Office -Professional, 0-P" is consistent with the General Plan designation of "Office" and the Freeway Corridor Overlay Zone. 0 435 Ordinance No. 1837 ZC/628 - Garellen - Page 4 of 4 NOW THEREFORE, the City Council of the City of West Covina, California, does ordain as follows: • SECTION NO. 1: Based on the evidence presented, both oral and documentary, Zone Change No. 628, is approved. SECTION NO. 2: A Negative Declaration of Environmental Impact has been prepared in accordance with the California Environmental Quality Act of 1970, as amended. SECTION NO. 3: The City Clerk shall certify to the passage of this Ordinance and shall cause the same to be published as required by law.
