AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF WEST COVINA, CALIFORNIA, AMENDING THE WEST
COVINA MUNICIPAL CODE BY AMENDING THE OFFICIAL
ZONING MAP (Zone Change No. 627 - San Gabriel
Valley Surgical Center Building Partnership
• WHEREAS, there was filed with the City of West Covina a verified
application on the forms prescribed in Section 26-153 and 26-199 of
the West Covina Municipal Code, for the reclassification from.
"Neighborhood -Commercial (N-C)" and
"Single -Family Residential (R-1), Area District
II" to "Office -Professional (O-P)" (Exhibit 1)
on that certain property generally described as follows:
Parcel 1 of Parcel Map 11358, in the City of
West Covina, County of Los Angeles, State of
California, as per map filed in Book 108 Pages
38 and 39 of Parcel Maps, in the Office of the
County Recorder; and
Lots 37 and 38 of Tract 24914, in the City of
West Covina, as per Map recorded in Book 646
Pages 88 of 89 of Maps, in the Office of the
County Recorder; and
WHEREAS, after considering the proposed request in a duly
advertised public hearing on December 6, 1989, as prescribed by law,
the Planning Commission of the City of West Covina recommended that
the City Council approve said zone change; and
WHEREAS, the City Council upon giving the required notice, did on
the llth day of December, 1989, conduct a duly advertised public
hearing as prescribed by law to consider said application; and
WHEREAS, the City Council of West Covina has considered evidence
presented by the applicant, the Planning Department, the Planning
Commission, and other interested parties at said public hearing held
on December 11, 1989; and
WHEREAS, the oral and documentary evidence considered in
connection with application reveal the following facts:
1. The applicant is requesting approval of a zone change from
"Neighborhood -Commercial (N-C)." and "Single Family
Residential (R-1), Area District II" to
"Office -Professional (O-P)."
2. The zone change application is submitted in conjunction
with a request for an amendment to the General Plan land
use designation from "Low -Medium Density Residential" to
"Office," and a request for a tentative parcel map.

3. Findings necessary for approval of a zone change are as
follows:
a. There are changed conditions since the existing zoning
became effective to warrant other or additional
zoning.
b. The proposed change of zone will not adversely affect
adjoining property as to value or precedent and will
not be detrimental to the area.
C. A change of zone will be in the interest or
furtherance of the public health, safety and general
welfare.
d. The approval of such a change of zone will not
adversely affect the comprehensive General Plan so
adopted by the City.
e. The approval of such a zone change is consistent with
the General Plan or applicable specific plans.
4. An initial study prepared for the subject project has
disclosed that although the proposed project could have a
significant effect on the environment, there will not be a
significant effect in this case because mitigation measures
have been incorporated into the project's design and as
conditions of approval. A Negative Declaration of
Environmental Impact has been prepared for the proposed
project pursuant to the requirements of the California
Environmental Quality Act of 1970, as amended; and
WHEREAS, based on the evidence presented to the City Council,
both oral and documentary, the City Council finds as follows:
a. The existing single-family residences were developed when
the area was primarily zoned "Residential -Agricultural,
R-A." The properties along Sunset Avenue have been
developed with commercial and medical office use since the
1960's. These uses are typically found along major
arterials. Three residential properties located at the
southwest corner of Merced and Shadydale Avenue were
included in a zone change to "Office -Professional" and were
subsequently included in the plans for the existing medical
facility. This action furthered the move toward Shadydale
Avenue to act as a natural division between the medical
uses oriented toward Sunset Avenue and residences on the
east side of Shadydale Avenue.
b. The proposed "Office -Professional" zone classification will
allow the property to be developed as a medical facility
which is consistent with other properties in the same
vicinity. Over the past few decades the area along Sunset
Avenue and east on Merced Avenue has been developed with
medical facilities, many of which are adjacent to
residentially zoned properties. Staff believes the
proposed postsurgical recovery center will provide a
valuable service to the community, as well as to the State
as a part of the demonstration project, while providing a
suitable transition into the residential neighborhood to
the east. A six foot high decorative wall will be provided
along the east and south property lines in order to screen
the noise and view generated by the new parking area that
will occupy this portion of the site. In addition,
landscaped planters will be provided and planted with
specimen size plant materials to help buffer the site from
the adjacent residences.

C. The proposed change of zone will be in the interest of
public health, safety and general welfare as the proposed
zoning provides for a suitable transition into a low -medium
density residential zone. The zoning will enable the site
to be developed with a postsurgical recovery center which
generates only minor amounts of traffic while providing a
• valuable medical service to the population. This facility
is in a State pilot program designed to study the potential
of reducing medical costs and other impacts on existing
hospitals.
d. The granting of this zone change will not adversely affect
the General Plan, but will be consistent with the proposed
General Plan designation for the site. Additionally, the
zone change will act to implement many goals and policies
within the General Plan which call for uses and facilities
to serve the residents of the City.
e. The proposed change from "Single -Family Residential, R-1
Area District II" and "Neighborhood -Commercial, N-C" to
"Office -Professional, 0-P" is consistent with the proposed
General Plan designation of "Office." The proposed change
is also consistent with the CBD Redevelopment area
designation of "Office -Professional."
NOW, THEREFORE, the City Council of the City of West Covina,
California, does ordain as follows:
SECTION NO. 1: Based on the evidence presented, both oral and
documentary, Zone Change No. 627, is approved subject to the condition
that Zone Change No. 627, shall not become effective until the
applicant shows proof, to the satisfaction of the Planning Director,
that Parcel Map No. 21595 has been approved by the City Council and
recorded with the Office of the Recorder of the County of Los Angeles.
SECTION NO. 2: A Negative Declaration of Environmental Impact
has been prepared in accordance with the California Environmental
Quality Act of 1970, as amended.
SECTION NO. 3: The City Clerk shall certify to the passage of
this Ordinance and shall cause the same to be published as required by
law.
