05-08-1989 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL May 8, 1989 • The regular meeting of the West Covina City Council was called to order at 7:30 pm by Mayor Bacon in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by the Mayor and the invocation was given by Rev. Lawrence Code of Community Presbyterian. ROLL CALL Mayor Bacon, Mayor Pro Tem Lewis, Councilmembers Manners, McFadden, and Tarozzi Others Present: Fast, Lennard, Thorson, Thomas, Eliot, Miller, Gardner, Fry, Fields,.Salazar, Glover, Aguirre,Lucke, Jones, Meacham, Koniarsky, Keating, Wylie, Johnson, Yoshizaki,.Fong, Berry APPROVAL OF MINUTES Motion by Lewis, seconded by Manners, and unanimously car- ried to approve the minutes of the regular meeting of April 24, 1989. PRESENTATIONS Mayor Bacon presented the -following proclamations: HIRE -A -VETERAN WEEK (5/7 - 5/13) to Armando Cervera CORRECT POSTURE MONTH (5/89) to Dr. Lee Laue RESPECT FOR LAW WEEK (5/7 - 5/13) to Carles Davenport • HEARING JOINT PUBLIC HEARING - FASHION PLAZA EXPANSION ENVIRONMENTAL IMPACT REPORT R.A. called to order Mayor Bacon called the Redevelopment Agency meeting to order (7:37 pm) in order to conduct the joint public hearing on this matter. City Clerk Berry verified the affidavit of publication and Fashion Plaza EIR the hearing was opened by Mayor Bacon. The staff report was presented by Redevelopment Manager Yoshizaki. ' City Clerk Berry stated that no written communications had been received regarding the final EIR. Mayor Bacon then opened the public testimony portion of the hearing and Public_ Testimony asked for. comments. The following addressed Council: Larry Costello, representing May Centers and Sylvan Larry Costello Shulman, requested a thirty -day postponement to allow them an opportunity to review their options. A brief discussion on the proper course to proceed ensued. It was decided to continue with the hearing and consider the request at the timelof the motion. . Royal Brown Royal Brown, 2153 Aroma Drive Fred Burkhardt Fred Burkhardt, Executive Vice President of the West Covina Chamber of Commerce Public -Testimony -closed Mayor Bacon closed the testimony portion of the hearing. He stated that the comments offered would be answered by staff in written form and submitted at a later time. • Matter continued to, Motion by Tarozzi, seconded by Lewis, and unanimously June 12, 1989 carried to continue the hearing until June 12, 1989, at which time the EIR comments will be addressed. Clerk Berry verified the affidavit of publication. Mayor Bacon opened the hearing and Human Services Director Salazar'presented the staff report. Mayor Bacon open the public testimony portion of the hearing and asked for comments from the audience. No one addressed Council and the public testimony portion was closed. City Attorney presented: RESOLUTION NO. 8333 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, DECLARING ITS INTENTION TO APPLY FOR GRANT FUNDS PURSUANT TO THE FEDERAL HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974 AS AMENDED AND CERTIFYING THE ENVIRONMENTAL REVIEW RECORD Motion by Manners, seconded by Tarozzi, and unanimously carried to waive further reading of the resolution and to adopt. AGENDA AND ORAL COMMUNICATIONS Louis Gilbert, 428 Fernwood Street, commented on'three items: Louis Gilbert 1) Landfill Disposal Rates - suggested amending'the UUP to allow the City to regulate other activities at BKK, such as liability insurance. 2) Recreation'Vehicles - opposed more restrictions on the parking of RVs'next to the curb. 3) Corridor Shuttle - noted the cost is $6.75 per rider and • suggested the program be discontinued. Katherine Castucci Katherine Castucci, 430 S. Pima Avenue, felt the problems caused. by park-ing.RVs on the -street effect'the entire city, not just at Ashdale & West Covina Parkway. George Tracy George Tracy, 808 S. Cajon, complained about the new striping on Azusa Avenue. - Pearl Aiassa Pearl Aiassa, 1120 S. Astell, felt the current restriction of parking RVs within 100 feet of an intersection was not sufficient. Louis Gilbert Louis Gilbert, .4280 Fernwood Street, commented further on the inadequacies of the Shuttle and suggested a public hearing. Mayor Bacon closed Agenda and Oral Communications, noting that the comments will be addressed at the time the matter came before the Council. PP 89201 - Dewco l PP 88202 - Western Commercial Const Replacement vehicles - Hertz Car Sales Item removed from Consent Calendar CONSENT CALENDAR MOTION Award of'Bids L)-"'PP,89201 '- G.ingrich'Park Security Lighting Staff recommends accepting the bid of Dewco, Yorba Linda, in the'amount of $51,954.00^as Submitted at the bid opening of April 26, 1989•, and authorize the Mayor and City Clerk to execute the agreement. 2) 'PP '88202 -' Shadow Oak Park Improvements Staff recommends: a) transferring $20,000 from PP 89201 (161-320-3912-7200) to PP 88202 (135-320-3813-7700), b) accept the bid of Western Commercial Construction, Covina, in the amount of $284,959.72 as,submitted at the bid opening of April 11, 1989, and authorize the Mayor and City Clerk to execute the agreement, and c)'authorize negotiation and execution of a deductive Change Order in the approximate amount of$40,000.00 for deletion of the tennis courts lighting system. 3) Purchase of Replacement Vehicles Staff recommends a) finding that it would he impracticable useless, or uneconomical to initiate a formal bid process, and b) authorize the Chief of Police to purchase six unmarked vehicles from Hertz Car Sales, Los Angeles, at a unit price not to exceed $14,500.00, including tax. Quarterly Construction Activity Report '(receive and file) Informational report on major construction activity for the quarter ending March 31, 1989, as reflected by the Building permits. Item C-5g (Azusa Avenue Rehabilitation) was removed for separate consideration. Motion by Manners, seconded by Lewis to approve all other items listed onthe'Consent'-Carendar. Motion carried by the following vote: AYES: Tarozzi, McFadden, Manners, Lewis, Bacon NOES: None City Engineer Thomas explained the narrower lanes painted on Azusa Avenue. Motion by Manners, seconded by McFadden, and unanimously carried to approve the staff.recommendation "re the Azusa Avenue Rehabilitation matter. " PUBLIC WORKS DIVISION 1) PP 89203 - APPROVE PLANS AND SPECIFICATIONS - FREEWAY LANDSCAPE MODIFICATIONS Council reviewed the staff report. Parking`RVs on city streets,, Cquncil discussed the problems caused by the parking ;., of RVs on the city streets,;and..possible options that they preferred. Motion by Manners, seconded by Lewis, and unani- mously carried to iefer the,matter to the Traffic Committee for tighter restrictions -and draft'an ordinance for Council's consideration. 3) COMMUTE MANAGEMENT PLAN Commute Management Plan Council reviewed the staff report. - Motion by Manners, seconded by McFadden, and unani- mously carried to receive and file the report. Council - member Tarozzi felt the Shuttle Program was a waste of. public funds. Motion by Manners, seconded by Lewis to a) authorize the Mayorto'amend -the Agreement with Community Transit Services.as necessary for the extended service, and b) authorize staff to file an amended Project Description with the Los Angeles County Transportation Commission for the extended service.. Tom Lorincz, 1020 Sandy Hook, commended the Fire Department for quick response to a fire 'bomb alert that happened to his Tom Lorincz next door neighbor. Jean Arenson, 1116 Donna Beth, took exception to commentsr. in the Mayor's speech at the last meeting.regarding the Jean Arneson history of the BKK Landfill and litigation results. Frank Barbagallo, 1023 Hopper Drive, introduced himself to Frank Barbagallo the Council and forwarned them of pending communications. Royal Brown, 2153 Aroma Drive, addressed the need to consider a Water.Master Plan, as referred to in AB 1092. He also . suggested looking at 'a shuttle service going north and south Royal Brown in the City on such streets as Azusa, Lark Ellen, and Valinda. Bea Uribe, 1121 E. Greenville Drive, addressed Council on two items: l)_commended the Maintenance Department for outstanding 'job during Clean Up, Fix Up Week, and 2) have • the City Manager make the decision as to which staff members c Bea Uribe should go to conferences,(referened an article in the Tribune). (5/1,/89) CHILD PASSENGER SAFETY WEEK (5/21-.5/27) 25th ANNIVERSARY OF'THE AMERICAN BUSINESS WOMEN'S ASSOCIATION 7 CITY COUNCIL MINUTES Fashion Plaza expansion COUNCILMEMBERS' REPORTS McFadden Tarozzi May.8, 1989 Page Eight Mayor Bacon expressed concern -about the action taken by May Centers and noted Councilmember McFadden's major point of 'opposition to the.expansion centered around the 85% com- mitment of .the sales tax increment and that he would not be opposed to another consultant's study of the expansion. Mayor Bacon requested the possibility of another con- sultant or two be agendized for the May 22nd meeting to allay McFadden's concerns. Councilmember McFadden requested a staff report on the pro- posed landfill in Azusa. He then commented further on the Fashion Plaza expansion situation - Councilmember Tarozzi reported on the founding ceremony of the Filipino Mission at St. Martha's Episcopal Church. He also -stated -that the.Minutes of April 24 should have reflected that'he voted no in electing Richard Lewis as Mayor Pro Tem, rather.than:abstehtion. -He reported that bleachers werecmoved by the Maintenance Department.as requested by the West Covina Pony League. He requested a report from' staff.•on-possibly doubling property tax on businesses to lower taxes for individuals and the impact this would have on Redevelopment.
