City Clerk Berry verified the affidavit -of mailing. ' Protest Hearing. Motion by Lewis, seconded 'by.Bacon,'and unanimously'. carried to receive and file the affidavit of mailing. "Mayor Manners opened the hearing and Fire Chief McClelland presented the"staff report. 'The following individual.addressed Council: Yng Yuah-Lin -YngY' uanLin> 1441 S. Willow Avenue stated he had made - . improvements on his property and it was no longer necessary to include it on the rolls. Public Testimony closed There being no other speakers, the public testimony - - - - - - - - - - - - .portion of the hearing was closed and staff was directed to "review the property in question and remove it from the rolls, eif,appropriate. '.�.Motion by.Bacon, seconded by McFadden, and unanimousli carried to order the abatement of weeds and rubbish on those properties described in Resolution of Intention No. 8325. AGENDA AND ORAL COMMUNICATIONS Tom Lorincz Jorden Denholi�`n_; a , Katherine Castucci Beatrice Uribe Joe Castucci Pearl Aiassa Royal Brown Tom Lorincz, 1020 Sandy Hook, discussed possible notices to' be.used throughout the business community indicating the new NO FIREWORKS ban in West Covina. Jorden Denholta;�, 1302 Barbara, noted'his objection to the elevatianof Councilmember Lewis to Mayor Pro Tem on the basis of Lewis' appointment to fill the unexpired term of Councilmember..Chester'Shearer, rather than being elected 'to the position. Katherine Castucci, 430 S. Pima Avenue, requested a clarification of: F-lb; changes in Personnel Rules. Beatrice Uribe, 1121 V. Greenville Drive, encouraged appropriate use of .sidewalk barrier removal projects. She also commented on freeway landscaping. Joe Castucci, 430 S. Pima Avenue, asked about insurance requirements for equipment lifts by helicopters.' Pearl Aiassa, 1120 S. Astell, complained about sight obstructions due to the parking of mobile homes parked on the streets. She submitted several letters on the same issue from her neighbors._ Royal Brown, 2153 Aroma Drive, complained about illegal dumping at the end of Galster Way. Mayor Manners directed staff to.report back at the next meeting on the parking of mobile homes and the dumping occurring at the end of Galster Way. She reminded the audience that Council will discuss the other concerns wi'ien the items come up on the Agenda. The amount of claim had not been determined at time of filing. On February 28, 1989, a claim for lost wages amounting to $215.00 was received by the CityoClerk's Office from Paul Devine. Item Removed from Consent The TUP item regarding the helicopter equipment lift Calendar was removed for separate consideration, as was the Traffic Committee item relating to No Fireworks in West Covina signage. Other notices have not been designed yet. Community Services Director clarified the requirements - of Temporary Use Permits, of which one is sufficient insurance coverage. The helicopter equipment lift was issued a TUP through the submittal of all requisite requirements. Mayor Manners commented on the sidewalk barrier removal program. Motion by Bacon; secbnded,by Tarozzi, and unanimously carried to approve the'two'outstanding items of the Consent Calendar. PUBLIC WORKS DIVISION PP 89203 -APPROVE PLANS AND SPECIFICATIONS - FREEWAY LANDSCAPE MODIFICATIONS PP 89203 - # Council reviewed the­staff'report. Freeway landscaping Motion by McFadden, and seconded by Tarozzi to hold decision held over over the item for more details. Motion carried with Bacon and Manners voting no. ". • COMMUNITY SERVICES DIVISION 1) CULTURAL CENTER STUDY,STATUS'REPORT Council reviewed the staff report.with embellishments by Community Services Director Miller: The consul- tant, Ken CamarellA), elaborated further on the Cultural Center Study,- findings.of the study. status report Motion'by Bacon,.seconded by McFadden, and unani- mously carried to approve the recommendation of the Cultural Study Committee to proceed with the con- sultant's work to develop a'facility plan and design an operations plan as specified'in the contract executed in January, 1989. 2) MAXIMUM LANDFILL DISPOSAL RATES Council reviewed the staff report with clarifications by Community Services Director Miller. BKK Landfill disposal rates - Councilmember McFadden offered an amendment to ' referred to staff the proposed resolution that would give Council ultimate authority over all charges imposed by BKK. City.Attorney Lenriard stated that the resolution . - currently.before.the City Council did not include Councilmember McFadden's proposal. However, adoption of the resolution would not prevent Council ' - - from taking action at a later date if, Council wished to do so and it were legally possible to impose that . control. He suggested the proposal'be referred to staff for a report back. Motion by McFadden, seconded by Tarozzi, to hold over the matter for two weeks to allow the City Attorney to provide an opinion as to whether or not the city can in fact' -implement ultimate control over all charges imposed by BKK and prepare an appropriate resolution. Page Seven ORAL COMMUNICATIONS Tom Lorincz, 1020 Sandy Hook, in relation to the upcoming item, Reorganization, felt.elevating Councilmember Lewis to Mayor Pro Tem would set a bad precedent as he was Tom Lorincz appointed to the1,Council rather than being elected by • - - - the .voters in'West Covina. Jack Stinson, 320 S. Citrus, disagreed with Mr. Lorincz' Jack Stinson comment and cited'several Vice Presidents of the United States that served as President. MAYOR'S REPORTS 1) COMMISSION APPOINTMENTS " Council reviewed the staff report. Council discussed possible mechanisms for appointing commissioners to upcoming position's in June. Motion by Tarozzi, seconded by Bacon to utilize 'the current list of. applicants.- Motion carried with McFadden voting no (desired readvertising). 2) PROCLAMATION Mayor Manners proclaimed BE KIND TO ANIMALS WEEK (5/7 through 5/13). "The motion carried with Robert,Bacon elected Councilmembers McFadden and Tarozzi voting no. Mayor of West'Covina Newly elected Mayor Bacon presented an outgoing Mayor's plaque to Na ncy_Manners for a job well.done. Immediate past Mayor Manners reviewed the past year's accomplish- ments under her leadership, of particular note, she mentioned The Lakes project was finally moving forward, signage for,the Auto Plaza was successfully resolved, the_Agenda/Council process had been streamlined; and the f W.C.U:S;D, and the City.Council-'were working closely l ;together tojcreate abetter'community for the students and their parents,. Mayor Bacon outlined three areas that he,plans'to con- centrate his efforts as Mayor: Recycling program,. Rekindling civic pride, and,R'evitalizing_the City. - 7 - CITY COUNCIL MINUTES April 24, 1989 Page Eight Designation of Alternate to Los Angeles County Sanitation District . Mayor Bacon explained that as Mayor he automatically becomes the City's delegate to the Sanitation District Board of Directors, but an alternate to function in his absence needed.to be.elected. He opened nominations for the alternate position. Council member Lewis nominated Bill Tarozzi, who Councilmember McFadden respectfully declined the post. Councilmember Manners elected alternate to nominated Richard Lewis', who also declined the post. Sanitation District Councilmember McFadden stated his interest in the Board of Directors position, and was nominated by Councilmember Tarozzi. Motion by Manners, seconded by Lewis, and unani- mously carried to elect Councilmember McFadden as alternate to the Sanitation District Board of Directors. Councilmembers Tarozzi and McFadden both made statements as to the dissenting votes for Mayor and Mayor Pro Tem, but looked forward to efforts in uniting the Council in the coming year.
