10-12-1987 - Regular Meeting - MinutesM I N U T E S WEST COVINA CITY COUNCIL REGULAR MEETING October 12, 1987 • The regular meeting of the City Council of West Covina was called to order by Mayor Chappell at 7:30 pm in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by Mayor Pro Tem Manners and the invocation was given by Rev. Lawrence Cole of Community Presbyterian. ROLL CALL Mayor Chappell, Mayor Pro Tem Manners; Councilmembers Bacon, Shearer, Tennant Others Present: Mooney, Fast, Lennard, Haley, Thomas, Eliot, Holmes, C. Johnson, Miller, Salazar, Wylie, Fry, Yoshizaki, Berry PRESENTATIONS_ Steve Millar of the West Covina Jaycees presented the Steve Millar `Mayor.:with`.'. a: `? Constitutional Bicentennial lapel pin.. Mayor Chappell presented a Mayor's Commendation to Marilyn Marilyn Cook Cook for winning the Ghiradelli's Great American Chocolate Cookie Contest at the Los Angeles County Fair. Mayor Chappell proclaimed the month of October as Toast - Edna Lumley masters Month and presented the proclamation to Edna Lumley. Mayor Chappell proclaimed October 25 through 31 as Red Ribbon Week and the month of October as Crime Prevention Week and presented both proclamations to Corporal Lor:12 e • Lor.i_Brockc".: Brock of the West Covina Police Department. Mayor Chappell proclaimed October 24, 1987, as United Nations Day and International Time Off for Women Day, and Kay Ragan the proclamations was presented to Kay Ragan of the Human Resources Commission. AGENDA COMMUNICATIONS Royal Brown, 2153 Aroma Drive; addressed Item D-3, rodent control at Galster Park. He encouraged Council to apply the pesticides in a balanced manner so as not to upset the Royal Brown balance of nature in the park. George Tracy, 808 S. Cajon, addressed B-1 noting that a previous request from Supervisor Pete Schabarum was referred to the Transition/Waste Management Commission. At that time it was determined that the City has no jurisdiction in restricting refuse from the City of Los Angeles being dumped at the BKK Landfill. In relation,•to Item J-3, he stated his opposition to the sunsetting of the Transition/ George -Tracy Waste Management Commission. Louis Gilbert, 428 Fernwood Street, concurred with Mr. Louis Gilbert Tracy's comments regarding the sunsetting of the commission. Dick Lewis, .1112 Cameron, also felt that sunsetting the commission was premature at this time due to the unfinished Dick Lewis projects that the commissioners were still working on. CONSENT CALENDAR Written Communications On September 30, 1987, the City received a letter from Pete Schabarum Supervisor Schabarum requesting the City Council to prohibit the deposit of refuse and sewage sludge from Los Angeles at the BKK Landfill. Items Removed from Consent Calendar City Manager Fast requested Ordinance No. 1755 removed Ordinance 1755 from consideration as PERS requires a longer waiting period between first and second reading. It would be appropriate to consider the ordinance for adoption at the next regular Council meeting. Mayor Chappell removed the written communication received Written Communications from Supervisor Pete Schabarum for consideration during the closed sessions scheduled for later in the meeting. Motion carried by roll call vote: AYES: Tennant, Shearer, Bacon, Manners, Shearer NOES: None HEARING 1) AMENDMENT NO. 210 - SECOND -UNIT ORDINANCE Mayor Chappell explained that the purpose of the City initiated amendment is to regulate--mihimum unit sizes Amendment No. 210 to avoid overbuilding a single-family lot when adding a second unit. City Clerk Mooney verified the affidavit of publication. Mayor Chappell opened the hearing and Planning Director Haley presented the staff report. Public_ Testimony Mayor Chappell asked for testimony -favoring the amend - In Favor: ment and the following individual addressed Council: Oliver Riggins Oliver Riggins, 1239 W. Rowland Avenue In Opposition: Mayor Chappell asked for testimony opposing the amend - None ment and no one addressed Council. The public portion Public -Testimony -closed of the hearing was then closed and council comments commenced. Council discussed the parameters of the proposed amend- ment and related issues such as second story windows Council discussion in second units and the intrusion of privacy by • buildings proposed for construction adjacent to lower existing buildings. HEARING 2) GENERAL PLAN AMENDMENT NO. 1987-1 ZONE CHANGE NO. 609 Garvey Investment Group Mayor Chappell explained the purpose of the hearing was General Plan Amend. 1987-1 to consider changing a land use designation from "Ser- Zone Change No. 609 vice and Nieghborhood Commercial" to "Medium Density Residential" and a zone change from I-P to MF-15„on property located at 2009-2013 West Garvey Avenue. City Clerk Mooney verified the affidavit of mailing and publication. Mayor Chappell opened the hearing and • Planning Director Haley presented the staff report. Council reconvened at 8:45 pm with all members present. • PUBLIC WORKS DIVISION 1) PP 88204--- SELECTION OF CONSULTANT FOR FREEWAY VISIBILITY IMPROVEMENT PROJECT Council reviewed staff's report. Motion by Bacon, seconded by Manners, and unani- PP 88204 - mously carried to a) establish PP 88204 and transfer Environmental Images $7,000 from unappropriated citywide landscape main - Landscape Architects tenance funds to PP 88204 (180-320-3818-7900) and b) accept the proposal of Environmental Images2 Landscape Architects, Anaheim, dated September 4, 1987, in the amount of $6,000 and authorize the Mayor and City Clerk to execute the agreement. 2) FREEWAY LANDSCAPING - MEMORANDUM OF UNDERSTANDING Council reviewed staff's report. MOU with Caltrans - Motion by Manners, seconded by Chappell to freeway landscaping authorize the City Manager to execute a Memorandum of Understanding with Caltrans for landscaping modifi- cations along the San Bernardino Freeway. Motion carried with Shearer abstaining. 3) AGREEMENT WITH L.:A. COUNTY AGRICULTURAL COMMISSIONER'S OFFICE TO PROVIDE FOR CONTROL OF INDESIRABLE RODENTS • AT GALSTER PARK Council reviewed staff's report. Dumping of toxic waste Motion by Manners, seconded by Shearer, and unani- mously carried to authorize an appropriation of $7,000 from the General Fund contingency to Account No. 110- 320-2230-6120 for the disposal of one truck load of toxic waste (actually storm drain sump pumps and catch basin debris). COMMUNITY SERVICES DIVISION HUMAN SERVICES DEPARTMENT • 1) ANNUAL HOUSING ASSISTANCE PLAN Council reviewed staff's report. 87/88 Housing Assistance Plan Motion by Shearer, seconded by Manners, and unani- mously carried to approve the 1987/88 Annual Housing Assistance Plan and direct staff to submit the plan to the U.S. Department of Housing and Urban Development. - 5 - CITY COUNCIL MINUTES October 12, 1987 Page Six OPERATIONAL SERVICES DIVISION PERSONNEL SERVICES • 1) ISSUANCE OF SUBPOENAS BY LEGISLATIVE BODY Subpoenas for Personnel Council reviewed staff's report. Services Motion by Shearer, seconded by Manners, and unani- mously carried to approve the issuance of five sub- poenas and direct the Mayor and City Clerk to executes them. PUBLIC SAFETY DIVISION POLICE DEPARTMENT 1) REPLICA FIREARMS ORDINANCE Council reviewed staff's report. Motion by Manners, seconded by Bacon, and unani- m o usly carried to receive and file the report. REDEVELOPMENT AGENCY Mayor Chappell recessed the City Council meeting at 8:53 pm to conduct the Redevelopment Agency meeting. The City Council meeting reconvened at 8:55 pm with all members present. CITY MANAGER 1) WORKERS' COMPENSATION ADMINISTRATION AGREEMENT Council reviewed;-1-staff's report. • Workers' Comp. Administration - Motion by Shearer, seconded by Manners, and unani- Colen and Lee mously carried to approve the agreement for workers' compensation administration with Colen and Lee. 2) "SURPLUS SCHOOL SITES Council reviewed staff's report. W.C.U.S.D. hearings re Motion by Manners, seconded by Shearer, and unani- two surplus school sites mously carried to authorize participation and testimony at the West Covina Unified School District Board's hearing regarding G-s, intention to sell two surplus school sites. 3) SUNSET OF CITY COMMISSION Council reviewed staff's'report. Councilmembers Bacon and Manners felt that sun=_-` setting the Transition/Waste Management Commission Sunsetting the Transition/ would be premature at this point in time and favored Waste Management Commission a --postponement of the sunsetting..,-Councilmember Ten - tabled nant stated he had initially favored the sunsetting due to the inappropriate political actions taken by the commission but felt the City needed an environ- mental commission. He stated his preference to hold over the matter for thirty days. Councilmember Shearer and Mayor Chappell favored the sunsetting, but would support holding over the matter in deference to • Councilmember:.:Tennant's comments. Councilmember Bacon commenced a brief discussion on simply ----tabling the matter. Motion by Bacon, seconded by Manners, and unani- mously carried to table the issue. Motion carried by roll call vote: AYES: Tennant, Shearer, Bacon, Manners, Chappell NOES: None ORAL COMMUNICATIONS Royal Brown, 2.153 Aroma Drive, spoke about the fleas and ground squirrels at Galster Park. He felt the City staff should have informed the neighborLr_r�citizens of the Royal Brown plague carrying fleas. MAYOR'S REPORTS 1) SUPPORT FOR THE RAIDERS' MOVE TO IR.WINDALE Mayor Chappell felt that the Raiders' move to Irwindale would bring good publicity to the East San Gabriel Raiders' move to Irwindale Valley and sought Council's concurrence in welcoming the Raiders. Council was generally supportive of welcoming the Raiders; however, Councilmember Shearer it would be more appropriate to wait and see before taking any action one way or the other. Motion by Bacon, seconded by Manners to support the Raiders' move to Irwindale by sending a letter to the City of Irwindale and a letter to the Raiders. The motion carried with Shearer abstaining. 2) CITY MANAGER COMPENSATION REVIEW • Mayor Chappell explained that this item would be addressed after the closed session. . 3) PROCLAMATIONS Mayor Chappell proclaimed the following: WHITE CANE SAFETY DAY-'- 10/15/87 Proclamations NATIONAL LUPUS AWARENESS MONTH - 10/87 NATIONAL HIGHER EDUCATION WEEK - 10/24 - .10/31 ESCROW MONTH - 10/87 COUNCILMEMBERS' REPORTS Councilmember Bacon reported on the successful conclusion of a study to produce a comprehensive statewide water policy statement, Such a policy was adopted by the League of Statewide Water Policy California Cities wherein all 444 cities in California Statement have agreed to it. Councilmember Bacon was the co-chair on the committee that developed the policy statement. City representation Mayor Pro Tem Manners noted that four West Covina officials at League conference participated in the various sessions offered at the annual League conference in San Francisco. Mayor Chappell reported that the League's annual Putnam Helen Putnam Award Award given to a city that has accomplished a major feat was presented to the City of Fairfield for proyi"ding • financial management _assistance_to the City of Rio Vista. Closed Session City Attorney_ Lennard recommended the'City Council move to adjourn to a closed session to consider potential litigation pursuant to Government Code Section 59569.6 and receive advice from its City Attorney, and to consider personnel matters as well. Motion by Shearer, seconded by Bacon, and unanimously carried to recess the City Council for a closed session at 9:4.1 pm. The City Council reconvened at 10:35 pm. - 7 - CITY COUNCIL MINUTES October 12, 1987 Page Eight Mayor Chappell reported that Council had discussed the City Manager's evaluation during closed session but requested the City Manager's compensation review to • be placed on the next Council agenda for consideration at that time. Mayor Chappell explained that the letter from Supervisor Schabarum was also discussed and the position has not changed since his last letter. Motion by Shearer; seconded by Tennant, and unani- mously carried to authorize the Mayor to send a letter to Supervisor Schabarum stating the .Counc_l�s position.
