01-27-1986 - Regular Meeting - MinutesM I N U T E S WEST COVINA CITY COUNCIL REGULAR MEETING • January 27, 1986 • The regular meeting of the City Council of West Covina was called to order at 7:30 PM by Mayor Tennant in the City Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by Mayor Pro Tem Shearer and the invocation was given by George Johnstone of the Salvation Army. Mayor Pro Tem Shearer abstained from voting due to conflict of interest. COMMUNITY SERVICES DIVISION OFFICE OF COMMUNITY SERVICES 1) TRANSITION OF SOLID WASTE DISPOSAL Council reviewed staff's report. Motion by Chappell, seconded by Manners, and unanimously carried to authorize the Mayor to send Transition of Solid Waste a letter to the California Waste Management Plan Disposal Committee notifying them of the landfill transition and requesting commencement of appropriate revision to the State and County Waste Management Plans. Mayor Pro Tem Shearer requested a copy of the lang- uage of the plan that is proposed for revision. BUILDING AND SAFETY DEPARTMENT 1) REAPPOINTMENT OF CIVIC CENTER AUTHORITY MEMBER Council reviewed staff's report. Civic Center Authority.Board - Motion by Shearer, seconded by Bacon, and reappointing 5th member unanimously carried to concur with the Civic Center Authority Governing Board approving Mr. Nordstrom. as the fifth member of the board. OPERATIONAL SERVICES DIVISION PERSONNEL SERVICES 1) MOU - UNITED FIRE FIGHTERS OF COVINA/WEST COVINA LOCAL 2415, AFL-CIO . Council reviewed staff's report. REDEVELOPMENT AGENCY MEETING Mayor Tennant recessed the City Council meeting at 7:50 PM to convene the Redevelopment Agency meeting. The City Council meeting 'reconvened at 7:53 PM. CITY MANAGER 1) LEGISLATION Council reviewed staff's report. Legislation Motion by Bacon, seconded by Chappell, and unani- mously carried to support AB 1963, and authorize the Mayor to communicate this position to the appropriate individuals. 2). LEGISLATIVE STATUS REPORT Council reviewed staff's report. Legislative Status Report Motion by Manners, seconded by Shearer, and unanimously carried to receive and file the status report. HEARINGS 1) ZONE CHANGE NO. 590 - 1104 S. WESCOVE AVENUE (Continued from January 13, 1986) Mayor Tennant clarified the purpose of the continued Zone Change No. 590 - hearing was to consider Zone Change No. 590 and -the • 1104 S. Wescove Avenue Negative Declaration of Environmental Impact therefor. The zone change would reclassify.a 0..55 acre site from.Single Family (r-a) and Office Professional (0-P.) Zones to Neighborhood Commercial (N-C)Zone. City Attorney Colin Lennard clarified the type of testimony that would .be .appr.opriat.`e ..for this con- tinued hearing. Mayor Pro Tem Shearer noted that he had reviewed all available material regarding the matter and was in a position to participate in the decision making process. Mayor Tennant opened the hearing and Planning Director Paul Curtis presented the staff report. The public portion of the hearing was closed and Mayor Tennant commenced Council discussion. Council Discussion Councilmember Chappell stated that he had re- evaluated the situation and would vote in favor of staff's recommendation to change the zoning of the property to N/C. Mayor Pro Tem ,Shear.er..coxicurred witt staff's recommendation. Mayor Tennant noted that he still had some reservations about the zone change to N/C, favoring O/P instead. City Attorney presented AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, AMENDING THE WEST COVINA Ordinance introduced - MUNICIPAL CODE BY AMENDING THE OFFICIAL ZONING MAP Zone Change No. 590 (Zone Change No. 590 - Consuelo Thyberg/Vance) Motion by Bacon, seconded by Chappell, and unanimously carried. to waive further reading of the ordinance. Motion'by Bacon, seconded by Manners to approve Zone Change No. 590 reclassifying the property to N/C by introducing the ordinance. HEARING 2) FREEWAY CORRIDOR MORATORIUM AMENDMENT (Continued from January 13, 1986) Mayor Tennant clarified the purpose of the continued hearing is to consider an amendment to the Freeway Corridor Moratorium (Interim Ordinance No. 1674) Freeway Corridor Moratorium relating to the inclusion of criteria for:the de - Amendment letion of parcels from the moratorium and the de7 letion of property located at 2329 West Garvey Avenue North (Stan Marr motel site). Mayor Tennant opened the hearing and Planning Director Paul Curtis presented the staff report. Mayor Tennant asked for .public testimony in favor Public_ Testimony of the proposed amendment and the following persons In Favor: addressed Council: Mayor White of Baldwin'Park Mayor White of Baldwin Park noted the benefits to the City of Baldwin and .West Covina to be derived from the proposed Baldwin,Park:Project, utilizing the Stan Marr motel.site. Mary Ann Harvey Mary Ann Harvey, president of the West Covina Chamber.of .Commerce,<,:encouraged Council to expedite the freeway corridor study for preliminary findings and to lift the moratorium per recommended criteria. John Glen John Glen, president -'.of the Baldwin Park Chamber of Commerce, urged support of the amendment. Frank Fitzgerald, 1st Vice-president of the - Baldwin Park, concurred with Mr. Glen's statement. In Opposition: Mayor Tennant asked for testimony in opposition None to the amendment and no one addressed the City Public_ Testimony Closed Council. Council reconvened at 8:42 PM. HEARING WEED ABATEMENT - 1986 Mayor Tennant clarified the purpose of the hearing was to consider protests or. objections against the Weed Abatement - 1986 abatement of weeds growing union and the removal of rubbish upon certain streets and private property in the City, as described in Resolution of Intention No. 7137. Public Testimony City Clerk Mooney verified the affidavit of mailing. Motion by Chappell, seconded by Bacon, and unanimously carried to receive and file the affidavit. None Fire Chief McClelland presented the staff report and Mayor Tennant opened the public portion of the hearing. City Clerk Mooney stated that no written protests had been received. Mayor Tennant asked for verbal Public -Testimony -Closed protests. Hearing none, Mayor Tennant asked for a motion to close the public hearing. Motion by Manners, seconded by Chappell, and unanimously carried to close the public portion.of the hearing. Motion by Chappell., seconded by Shearer, and Abatement of weeds & rubbish unanimously carried to order the abatement of weeds ordered and rubbish on those properties described in Resolu- tion of Intention No. 7173. APPROVAL OF DEMANDS Motion by Shearer,- seconded by Chappell to approve Demands totaling $1,631,732.49 as listed on check • registers FI 76331 through FI 76778. COUNCILMEMBERS' REPORTS Councilmember Bacon reported on a recent meeting with the Environmental Protection Agency in San Francisco Bacon regarding the BKK Landfill. Manners Councilmember Manners introduced Renee' Wallace, the new reporter from the Highlander and suggested a Cer- tificate of Recognition be approved for Carol Smithberg, who has taken another position at'the Highlander. Motion by Manners, seconded by Bacon, and unanimously carried to direct staff to prepare a Certificate of Recog- nition for Carol Smithberg. Chappell Councilmember Chappell reported on League of California Cities State Board legislative activities and noted that he would be supplying Council with written information in the near future. Shearer Mayor Pro Tem Shearer submitted information to the Council on the Covina/West Covina Fire Merger for review. ADJOURNMENT Motion by Manners, seconded by Shearer, and unanimously carried to adjourn the meeting at 9:14 PM to 6:30 PM on February 3, 1986, for a joint meeting with the Human Resources Commission at the Senior Citizens Center.
