06-10-1985 - Regular Meeting - MinutesM I N U T E S REGULAR MEETING WEST COVINA CITY COUNCIL June 10, 1985 The regular meeting of the City Council of the City of West Covina was called to order by Mayor Tennant at 7:30 Pal in the City Hall Council Chambers, 1444 W. Gar- vey Avenue, West Covina, California. The Pledge of Allegiance was led by Council - member Manners and the invocation was given by Bob Bradley, Faith Community_ Church. POLL CALL Mayor Tennant, Mayor Pro Tem Shearer (arrived 7:55 P11), Councilmembers Chappell, Manners, Bacon Others Present: Mooney, Lennard, Fast, Thomas. Miller, Eliot, Meacham, Heaton, Volmert, Salazar, Roger, Dawson, Keating, Berry APPROVAL OF MINUTES Motion by Chappell, seconded by Bacon., and unanimously carried to approve the minutes for tle following meetings: Adjourned regular meeting of May 20, 1985 Regular meeting of 'lay 28, 1985 PRESENTATIONS Mayor Tennant presented Certificates of Recognition to the captains of the Girls South Hills Swim Tears in honor of South Hills Swim Team their capturing the CIF Championship. Mayor Tennant presented Charlie White, a member of the Rental Mediation Board West Covina Rental Mediation Board, a Certificate of Recognition. Mr. W'irlte accepted in behalf of the Mediation Board. Mayor Tennant presented a permaplaqued Resolution of Gideon Young Commendation to Gideon Young for his outstanding programs offered to the citizens of West Covina in his role as Recreation Services Fee and Charge Program Coordinator. AGENDA COMMUNICATIONS Louis Gilbert, 428 Fernwood Street, addressed Council con- cerning Agenda Items Ka and Kb, both related to the BKK Louis Gilbert Landfill. He felt as a member of the Transition/Waste Management Commission, the commission members should have reviewed both items and recommended actions to Council. Royal Brown, 2153 Aroma Drive, addressed the same two items as above and felt they should be referred to the Royal Brown Planning Commission and other commissions for recommenda- tions. He also stated that lie could not find the Agenda " packet at the library, contrary to usual custom. Fred Landsberg, 1121 S. Coronado, also addressed the same Fred Landsberg two items, referring to the task force"s goals. He also felt the present action is a change in policy. Oliver Riggins, 1239 W. Rowland, in regards to the same two Oliver Riggins items, noted that governmental agencies are still undecided about adding Class II materials to Class I materials at the landfill. • George Trace, 808 S. Cajon, asked several questions regarding the two items: 1) Fow high is 800 feet? 2) If you change George Tracy the business license foT, BKK, can you change the business licenses for others. 3) Is.the.City proposing to charge an appropriate interest rate. On March 25, 1985, a claim for damages amounting to $80 was received by the City Clerk's Office from Bob Manley. On April 8, 1985, a claim for personal injuries amounting to $750,000 was received by the City Clerk's Office from Bradley and Lois Yoakum. On April 19, 1985, a claim for damages amounting to $284.42 was received by the City Clerk's Office from Robert Szepvolgyi On April 23, 1985, a claim for ecuitable apportionment and idemnity was received by the City Clerk's Office from Motley Crue, Richard Fisher, Nikki Six, Vince Neil, Mick Mars, and Tommy Lee. On May 13, 1985, a claim for personal injuries amounting to $10,000 was received by the City Clerk's Office from Alberto Castro. On May 15, 1985, a claim for personal injuries was received by the City Clerk's Office from Doris Issa. Mayor Tennant opened the hearing and the staff report was presented by Community Ser- vices Director Mike Miller. Mayor Tennant opened the public testimony portion of the hearing and asked for comments favoring the zone change. No one addressed Council and he asked for comments opposing.the zone change. Again no one addressed Council and Mayor Tennant closed the public portion of the hearing. Council asked for the reading of the ordinance. Yeager) Zone Change 586 City Clerk Mooney verified the affidavits of mailing, and publication. Mayor Tennant opened the hearing and Community Services Director Mike Miller presented the staff report. PublicTestimony Mayor Tennant opened -the public testimony portion In Fa_vor: of the hearing and asked for comments favoring the Charles Koeller zone change. Mr. Charles Koeller, representing the applicant, requested approval of the zone change. In Opposition: Mayor Tennant asked for comments opposing the zone Jaynee Salen change and Jaynee Salen, 1815 E. Pioneer, noted her opposition to the zone change. She also stated that In Rebuttal: she had filed an appeal to the related precise plan. Charles Koeller Mayor Tennant allowed Mr. Koeller to address the comments under opposition. Following rebuttal the public portion of the hearing was closed and Council Public Testimony Closed discussion commenced. Council discussion Council concluded that the opposition was in fact-. to the precise plan and did not pertain the the zone change. With the City Attorney's concurrence, Council asked for the reading of the ordinance and noted that they would address Mrs. Salen's concerns at the appeal hearing. Noting that the continued until 6/24/85 information had not been available at the library either, Shearer motioned and Manners seconded to hold over the matter until the next regular Council meeting of June 24, 1985. The motion carried unanimously. The hearing, having been opened, was continued to June 24, 1985. Staff was directed to place a com- plete packet at the library for public --review. Motion by Bacon, seconded by Shearer, and unanimously carried to receive and file the affidavit. Mayor Tennant opened the hearing and City Engineer Harry Thomas presented the staff report. City Clerk Mooney stated that no written protests or objections had been received. Mayor Tennant asked for oral comments or objec-tions. No one addressed Council and Mayor Tennant closed the public portion of the hearing. CITY ATTORNEY No items scheduled for this meeting. REDEVELOPMENT AGENCY MEETING Mayor Tennant recessed the City Council meeting at 9:00 PM to convene the Redevelopment Agency meeting. The City Council meeting was reconvened at 9:05 PM. CITY MANAGER Schedule of payment - BKK Landfill 1) SCHEDULE FOR PAYMENT OF BUSINESS LICENSE TAXES City Manager Fast reviewed the staff report and answered the comments and questions expressed during Agenda Communications. After lengthy discussion, Council - member Bacon summarized the key points: 1) The council'is the -only body to determine whether or not to collect taxes in this case. 2) It is.debatable whether the Transition/Waste Management Commission should have provided sug- 'gestions:'regarding a written statement of intent. 3) Both the.Transition/Waste Mangement.Commission and the Planning Commission will coordinate. in.the development of transition. land uses of the landfill site and make recommendations to the.Council. Claim settlement Motion by Chappell, seconded by Shearer, and Auto Club (Viteri) unanimously carried that the claim for property damages he settled in the amount of $8,39.7.50 and payment be'authorized subject to the standard con- dions. 4) LEGISLATION Council reviewed staff's report. Legislation Motion by Manners, seconded by Bacon, and unani- mously carried to oppose SB .1174, AB 796, SB 276, AB 564, AB 140, AB 242, AB 763, and AB 854; support AB 902, AB 164, SB 951, SB 228, SB 17, AB 200, AB 300, SB 1371, and AB 1209; and authorize the Mayor to communicate these positions to the appropriate individuals. APPROVAL OF DEMANDS Motion by Shearer, seconded by Chappell to approve demands totaling $1,458,418.21 as listed on check registers FI 70566 through 70866. Motion carried by roll call vote: AYES: Bacon, Manners, Chappell, Shearer, Bacon NOES: None ORAL COMMUNICATIONS Holly Griffith, 1845 E.,Norma, stated the Datsun dealership continues to use the public address system, and is"still detailing cars by the property lines. She noted the Holly Griffith lighting problem has been solved satisfactorily. Staff -was directed to investigate and report back. - 7 - CITY COUNCIL MINUTES June 10, 1985 Page Eight MAYOR'S_ REPORTS Mayor Tennant postponed proclaiming Selective Service Registration Awarness Month until the June 24 meeting • when a representative of the Draft Board would be present to recieve the proclamation. • COUNCILMEMBERS' REPORTS Councilmember- Manners requested staff to review and report Manners back on Supervisor Schabarum'.s transportation zone. Mayor -Pro Tem Shearer commenced a discussion on the inter- viewing and appointing process for new commissioners. Staff.was directed to supply Council with a list of all the applicants and a copy of each application.
