Garvey Avenue, West Covina, California. The Mayor led the Pledge of Allegiance and the invo- cation was given by George Johnston of the Salvation Army. INTRODUCTION Mayor Bacon introduced the new correspondent from the San Lee Garber, Tribune Gabriel Valley Tribune, Lee Garber, who replaced Joe Blackstock. Motion by Shearer, seconded by Manners, and unanimously carried to direct staff to prepare a Resolution of Commenda- Lion for Joe Blackstock. AGENDA COMMUNICATIONS No items were discussed.. SD 85118 Motion by Shearer, seconded by Manners, and unani- Harper Construction mously carried to accept the bid of Harper Construction, Running Springs, in the amount of $17,288 as presented at the bid opening of March 5, 1985, and authorize the Mayor and City Clerk to execute an agreement. PUBLIC WORKS DIVISION 1) SP 83120 - APPROVE PLANS AND SPECIFICATIONS - WEST COVINA PARKWAY AND AZUSA AVENUE IMPROVEMENTS Council reviewed Engineer's Report. SP 83120 - Motion by Manners, seconded by Shearer, and unani- Plans & specs approved', mously carried to approve the plans and specifications for City Project SP 83120 and authorize the City Engineer to call for bids. 2) PP 84203'- APPROVE PLANS AND SPECIFICATIONS - DEL NORTE PARK LANDSCAPE IMPROVEMENTS & TENNIS COURT LIGHTING Council .reviewed Engineer's Report. Upon questioning the City Attorney, Councilmember Service Agreement - Shearer was told he could vote on the matter without CalTrans violating conflict -of interest regulations. Motion passed by the following vote: AYES: Manners, Bacon NOES: None ABSENT: Chappell, Tennant ABSTAIN: Shearer 4) ASSESSMENT ENGINEERING SERVICES - RENEWAL OF AGREEMENT Council reviewed Engineer's Report. Motion .by Manners, seconded by Shearer, and unani- mously carried to authorize the Mayor and City Clerk to e-cecute an agreement with Patrick N. Rossetti for assessment engineering services in connection with Landscape Maintenance Districts 4, 6 and 7 and certain additional services.'for all City assessment districts. COMMUNITY SERVICES DIVISION COMMUNITY SERVICES DEPARTMENT 1) DISSOLUTION OF THE BKK LANDFILL HAZARDOUS WASTE -DISPOSAL TRANSITION TASK FORCE Council reviewed staff's report. Task Force dissolved Motion by Manners," seconded by Shearer, and unani- mously carried.to accept the recommendation of the Transition/Waste Management Commission to dissolve the task force, direct staff to prepare appropriate ordinance and resolution to effect the change, letters be sent to each task force participant in grateful: appreciation, and requesting their continued personal involvement at the Transition/Waste Management Commission. 2) RECOMMENDATION FROM THE TRANSITION/WASTE MANAGEMENT COMMISSION REGARDING A LETTER TO THE DEPARTMENT OF HEALTH SERVICES Council reviewed staff's report. Motion by Manners to support the commission's recom- Letter to DOHS denied mendation to send a letter to the Department of Health Services. The remainder of Council commented that the currently improved relations with the Department of Health Service could erode with an ill-timed letter. .They_ noi•nted our that'..DQHS would never respond .in absolute terms, as requested by the commission. In addition, remedial actions have been taken to correct problems. The motion died for lack of a second. Motion by Shearer, seconded by Manners to refer the item back to the commission with a staff summary outlining Council's reason for denial. The motion carried unani- mously and included the possibility of making the request at a later date. HEARINGS 1) CONTINUATION OF PUBLIC HEARING - DOUBLE JJ LIMOUSINE Double JJ Limousine This matter.was before the City Council on February 25, 1985, at which time it was continued with:the hearing open.until this evening. City Treasurer presented a recap of the staff report. - 3 - CITY COUNCIL MINUTES March 11, 1985 Page Four PublicTestimony Mayor Bacon asked for public testimony in favor of In_ Favor: the permit. Marge Martin I Marge Martin, applicant's representative, noted that this was the first t_me the company had'.applied for a permit in West- Covina. Council questions surrounding_ the company's fees revealed that the proposed. resolution for adoption did not accurately reflect the company's fees. Matter held over until 3/25 Motion by Shearer, seconded by Manners, and unani- mously carried to hold over the matter, with the hearing open,.0 til March 25, 1985, to give the applicant a chance to -work out the details with the City Treasurer. 2) PRECISE PLAN NO. 606, REVISION 1, SOUTH SIDE OF GARVEY AVENUE, EAST OF AZUSA AVENUE .Deputy City Clerk Berry verified. the affidavit of Precise Plan 606, Rev. 1 mailing and publication. Mayor Bacon opened the hearing and Planning Director Curtis presented the staff report. Public Mayor Bacon opened the public portion of the hearing —Testimony In Favor: and asked for comments favoring the revision. Tim Valles Tim Valles, general manager of Datsun, spoke in favor of the precise plan revision. In Opposition: Mayor Bacon asked for public testimony opposing the Steve Yuhas revision and the following individuals addressed Council: Dave Griffith Steve Yuhas, 1813 Norma Holly Griffith Dave Griffith, 1845 E. Norma Robert Gonzales Holly Griffith, 1845 E. Norma, with slides of offending lighting, temporary buildings, loud speakers, employee cars parked on -street Robert Gonzales, 1849 Norma In Rebuttal: Mayor Bacon allowed.comments under rebuttal and Tim Tim Valles Valles responded to questions of Council. The public Public_ Testimony Closed portion of the hearing was closed and Council discussed the matter. Mr. Valles agreed.to remove the temporary. buildings and loud speakers, maintain all activities within designated service areas.and keep the recently re -aimed lights Horizontal at all times. Council concurred that the proposed resolution approving the precise plan.revision must be amended to include the following before adoption: 1) Temporary buildings be removed 2) Loud speakers be removed 3) All servicing.of automobiles to be done in designated service bays as indicated on.the precise p.lan City Attorney presented: Resolution 6985 - RESOLUTION NO. 6985 - A RESOLUTION OF THE CITY Precise Plan 606, Rev. l COUNCIL OF THE.CITY OF WEST COVINA, CALIFORNIA, APPROVING as amended PRECISE PLAN NO. 606, REVISION 1, AND CERTIFYING THE NEGATIVE DECLARATION OF ENVIRONMENTAL IMPACT THEREFORE, AS AMENDED BY. Recess_ Mayor Bacon called a recess at 9:31 PM. Council reconvened at 9:41 PM with Mayor -Pro Tem. Tennant remaining absent. REDEVELOPMENT AGENCY MEETING Mayor Bacon recessed the City Council meeting at 9:31 PM in order to convene the Redevelopment Agency meeting. The City Council was reconvened at 10:55 PM and was PARI:ING AUTHORITY MEETING. immediately recessed to convene the Parking Authority r meeting. Legislation Motion by Chappell, seconded by Shearer, and unani- mously carried to support AB 139 and AB 216 and authorize the Mayor to communicate these positions to the appropriate legislators. APPROVAL OF DEMANDS Motion by Shearer, seconded by Chappell to approve Demands totaling $1,284,094.67 as listed on check registers FI 68287 through 93553. Motion carried.by roll call vote: AYES: Manners, Chappell, Shearer, Bacon NOES: None ABSENT: Tennant ORAL COMMUNICATIONS Mable Tronsgard, 1334 Glenmere, submitted a list of questions to the City Manager for the City Attorney to answer regarding Falcon Cable entering her property to install cable television Mable Tronsgard She noted thei hazard still exists.on her property and she stated that she will not allow Falcon to -correct it. Oliver Riggins Oliver Riggins, 1329 Rowland Avenue, commented on the Arbor Day celebration held at Cameron Park. Council comments Mayor Bacon closed Oral Communications and the following comments were offered by the City Council. Councilmember Shearer explained that the City Attorney can only respond to questions relating to the City. Councilmember Chappell noted that Falcon has offered to correct the hazard, but Mrs. Tronsgard will not agree to let them on the property to fix it. MAYOR'S REPORTS 1) FUTURE OF THE SMALL BUSINESS ADMINISTRATION Council reviewed staff's report. Mayor Bacon explained his support of Congressman Small Business Administration Torres' request. Other council comments suggested the council stay out of partisan national politics. Motion by Bacon to support Torres' opposition to the elimination.of. the SBA. Motion died for lack of a second. 2) MENTALLY.ILL HOMELESS -.IN WEST COVINA Council reviewed staff's report. Mentally ill homeless For the same reasons offered above, Council noted they would support the concept suggested by Santa Monica, but not a specific legislative bill. Motion by Bacon, seconded by Chappell, and unani- mously.carried to support in principle the concept of addressing mentally ill homeless 'individuals. • . Closed Session City Attorney Lennard recommended the City Council recess to close session pursuant to Government Code Section 54956.9 (a) to confer with its city attorney regarding pending liti- gation which has been initiated formally and to which the City is a party. The title of the litigation is West Covina vs. Cricks. He further recommended that the Council recess to close session pursuant to Government Code Section 54956.(b)1 to discuss a matter whether a significant exposure to litigation Motion by Shearer, seconded by Bacon, and unanimously carried to accept the City Attorney's recommendation to conduct a closed session. Mayor Bacon recessed the City Council at 11:25 PM for closed session. Council reconvened at 11:55 PM and took the following action: Motion by Manners, seconded by Shearer, and unanimously carried to approve the settlement of West Covina vs. Cricks in the amount of $13,500.
