The adjourned regular meeting of the West Covina City Council was called to order by Mayor Bacon at 6:00 PM in the City.Hall Council Chambers, 1444 W. Garvey Avenue, West Covina, California. • • ROLL CALL Mayor Bacon, Mayor Pro Tem Tennant, Council.members Shearer, Chappell, and Manners Others.Present: Fast, Lennard, Miller, Curtis, Yoshino, Volmert, Southard, Berry APPEAL OF PLANNING DIRECTOR'S MODIFICATION - BKK LANDFILL ELECTRICAL GENERATION PROPOSAL - UNCLASSIFIED USE PERMIT NO. 71, REVISION 5 (AMENDMENT) The hearing on this matter was held on October 8, 1984, at which time all public testimony had been heard and the public portion of the hearing was closed. The matter had then been continued until this meeting. Staff presentation` Community Services Division Manager Miller presented the staff report, explaining the revised conditions to the permit. Mayor Bacon noted that a response had been received from the BKK Corporation regarding the revised conditions. Discussion ensued regarding the procedures for the rest of the•mee'ting. Motion by Shearer, seconded by Chappell, and unanimously carried to discuss each condition with the BKK'Corporation representative`.presenting-his comments first, the,Homeowners Association second, and the City Council third.. A twenty -minute time limitation was placed on each discussion, Ron Gastelum William Whisenhunt Council discussion Conditions Ron Gastelum, General Counsel of BKK Corporation, discussed the concerns of BKK and suggested terminology changes. William T. Whisenhunt, Homeowner's Association repre- sen.tative', stated'he had not reviewed the'modifications and could not address the changes. - Council reviewed each condition and discussed the comments presented by BKK, Regarding the conditions, Council took the following actions: CONDITION 1. No change. CONDITION 2. Okay, as revised by staff. CONDITION 3, Motion by Manners, seconded by Bacon, and unanimously carried to clarify by adding "...unless the requirement is waived" and ''...unless inconsistent with or duplicative of the bonding requirement of the closure. plan." The condition termin- ology remained the same through the following vote: AYES: Chappell, Shearer, Tennant, Bacon NOES: Manners CONDITION 9.. Council felt part of.the terminology was redundant. Motion by Shearer; seconded by Tennant, and unanimously carried to delete the last sentence so that the condition.ended with "... the applicant must miti- gate and.correct the violation." .CONDITION 10. No change. CONDITION 11. No -change. CONDITION 12. No change. CONDITION 13. Council concurred with the need to clarif >revenue.s..-They changed the wording to "All revenues received.'by the`'appl'icant from the operation..." CONDITION 14. Council felt BKK's,objection to "recovery of resources." could be dropped. However, City Attorney Lennard'explained that the wording is exactly as stated in SB 501 and included the wording to be consistent.with it.' Council -concurred to make_ no changes. CONDITION'15. No change. -Council 'discussed the whole project and felt.it_should go forward'. Two items,"s,crubber.s and the site characterization .plan, were still of concern to members of the Council. How- ever they felt the language•.of the conditions addressed the items sufficiently. City Attorney presented RESOLUTION NO. 6944 - A RESOLUTION OF THE CITY.COUNCIL OF THE CITY OF WEST COVINA, CALIFORNIA, APPROVING A PLANNING DIRECTOR'S MODIFICATION.TO UNCLASSIFIED USE PERMIT NO. 71, REVISION 5 (AMENDMENT) AND CERTIFICATION OF .THE NEGATIVE DECLARATION Motion by Chappell, seconded by Shearer, and unanimously carried to waive further reading of the resolution and to adopt, subject to the.modifications.
