Garvey Avenue, West Covina, California. Project TS 83108 . Four Simon, Inc. Mayor Chappell presented ARBOR DAY proclamation to Beatrice de Ur be_of West Covina Beautiful proclaiming March 7, 1984, as Arbor .Day. Mr. Joe Johnson presented a Tree City USA Award to Mayor Chappell, who accepted in behalf of the City of West Covina. The awards included a plaque and a Tree City flag. Mr. Johnson represented the Arbor Day Foundation, National Organ- ization of Forestry. Mr. Herb Spitzer of'the California Ur -ban Forest Council also commended Council for the City's outstanding urban* forestry program. SP 84102 & SP 84106 Excel Paving Company PUBLIC WORKS DIVISION Resolution 6829 - Vacating & abandoning a portion of Holt Ave. 2) SP 84102 AND SP 84106 - STREET RESTORATION 1) Council reviewed staff's report. Motion by Shearer, seconded by Bacon, and unanimously carried to accept the bid of EXCEL PAVING COMPANY, Long Beach, in -the amount of $202,945.35 and authorize the Mayor and City Clerk to execute an agreement, subject to HUD approval. HOLT AVENUE - STREET VACATION Location: Intersection of Holt and East Garvey Avenue South, approximately 1500 feet east of Barranca Council reviewed Engineer's Report. City Attorney presented: RESOLUTION NO. 6829 -'A RESOLUTION OF THE CITY COUNCIL"OF.THF=.CITY OF WEST COVINA, CALIFORNIA, VACATING AND ABANDONING A PORTION OF A STREET WHICH HAS BEEN SUPERSEDED BY REALIGNMENT (Holt Avenue) Motion by Bacon, seconded by Shearer, and unani- mously carried to waive further reading of the reso- lution and to adopt. 2). Motion by Shearer, seconded by Bacon, and unanimously carried to deny the request for bingo at.the Senior Citizen's Center. 1) APPEAL OF VARIANCE NO. 844 (COURTNEY BUILDING DESIGN) City Clerk Mooney verified the affidavits of mailing and publication. Mayor Chappell opened the hearing and the staff report was presented by Planning Director Curtis. Mayor Chappell opened the hearing for -comments favoring the appeal. The following persons addressed Council: Margaret Courtney of Courtney Building Design Mrs. Anwar, owner of the proposed house Dr. Anwar,'owner of the proposed house Herman Wescamp, 3034 Larkwood Oliver Riggins,, 1239 W. Rowland Mayor Chappell asked for comments in opposition to the appeal. No one addressed Council and the Mayor closed the public portion .of the hearing. Council discussed ensued.regarding the findings for a•variance and their interpretations of those conditions. After opinions.were expressed Tice moved and Chappell seconded to approve the appeal of Variance No: 844 and directed.^staff and' City.Attorney to prepare the proper respl'ution_for adoption. Mayor Chappell opened the hearing and the staff report was presented by City Treasurer Calmes. Public Testimony Mayor.Chappell opened the hearing for public com- ments favoring the application. Victor Strauss, owner of.Classic Limousine Service Mayor Chappell asked for public comment opposing the application. No one addressed Council and the Public_Testimony Closed — — public portion of the hearing was closed. Council commented on ,the applicant's proposed rate increases, the addition of two more limousines, and proposed rates.during the Olympics. Council objected to the $50 an hour rate during the Olympic Games. Staff was directed to amend the resolution to, reflect Council'.s denial of the special rate during the Olympic Games. 3) AMENDMENT NO..188 - :INOPERABLE VEHICLES City Clerk Mooney verified the affidavit of publication. Mayor Chappell opened.the hearing and Planning Director Curtis presented the staff report. Mayor Chappell stated that public comments were to 'address the definition of inoperable vehicle and the amortization period. The following person spoke in favor of -the amendment: Oliver Riggins, 1239 W. Rowland Avenue, asked for a clarification of an incident whereby a property owner has an operable vehicle but chooses to.let it stand without driving it. Planning Director Curtis stated that if a vehicle is operable, it is not.affected by the ordinance. Those speaking in opposition were: Louis Gilbert, 428 Fernwood Street Beatrice de Uribe, 1121 E. Greenville Drive Public_ Testimony Closed Royall Brown, 2153 Aroma Drive. C6uncil discussed the purpose of the ordinance and the types of problems encountered that the City has been unable to do anything about. Motion by Tice, seconded by Bacon, and unanimously carried to authorize.the purchase of twelve 1984 Ford LTD Crown Victoria "S" Special Services vehicles from the State of California,. with delivery after July 1, 1984, in the amount of.$130,486.54, including tax and State processing fees. FIRE DEPARTMENT 1) ANNUAL REPORT - 1983 Council reviewed staff's report. Councilmember Tice commended the.Fire Department with particular praise for the Paramedic Division. Council reconvened at� 9:21 PM. LEGISLATION' Council reviewed staff's report. It was noted that the Mayor and .Mayor Pro Tem"would be.traveling to Sacramento to lobby for permanent financing for local agencies. Motion by Shearer, seconded by Tice, and unanimously carried,to support SB 1333, AB 2271, AB 2228, AB 2229, AB 2285 (if amended), SB .1363 and legislation as recommended by the•Assembly report on infrastructure, oppose the new FEMA regulations regarding disaster declaration information and communicate these positions to the appropriate individuals. Mr. Quezada • The matter was referred'to staff. His complaint regarding stolen mail from his mail box does not.fall within the jurisdiction of the City Council and it was suggested he contact the Postmaster. — Louis Gilbert.. Louis Gilbert, 428 Fernwood Street, invited the candidates to a forum' -scheduled for March 24, 1984 at 9:00 AM at the Senior Citizen's.Center on'Cortez Avenue. Mayon Chappell noted that three candidate forums have been scheduled,by the following organizations: West Covina Committee on Aging (presented above) , Chamber of Commerce, and the League of,Women Voters. Jean Arneson 'Jean Arneson, 1116 Donna. Beth, read a statement regarding • hazardous waste and alleged radioactive waste drums being disposed of at the BKK Landfill. MAYOR`S REPORTS No reports offered at this"meeting. COUNCILMEMBERS'•REPORTS Councilmember Tice thanked everyone for the flowers and letters he received during his illness. Tice He also commended the City Attorney,.' City:* staffand the paramedics.' :. Mayor Pro Tem Bacon requested staff to investigate the Bacon • lack of handicapped spaces at the Country Club Center, as inentioned in a letter published in the Tribune. He also..mentioned that a Southern California Edison '.hearing would beheld on,March 16 at 2:00 PM in Long Beach.
