REGULAR MEETING OF THE CITY COUNCIL
CITY OF WEST COVINA, CALIF.
June 13, 1983
The regular meeting of the City Council of the City of West Covina was called to
order at 7:30 PM by Mayor Chappell in the City Hall Council Chambers, 1444 W.
Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by
Councilmember Tice and the invocation was given by Stuart York, West Covina
Church of Christ.

APPROVAL OF MINUTES Motion by Tice, seconded by Bacon, and unanimously carried to
approve the minutes of the adjourned regular meeting, May 16,
1983, the regular meeting of May 23, 1983, and the adjourned
regular meeting of May 31, 1983.
PRESENTATIONS Mayor Chappell proclaimed June 14 through July 4, 1983 as
HONOR AMERICA and presented the proclamation to Mary Bright -
well, president of the Historical Society of West Covina.
Mayor Chappell presented a Resolution of Commendation to
Beatrice H. de Uribe for her outstanding dedicated service
to the community.

1) RENEWAL OF ANNUAL RADIO MAINTENANCE CONTRACT

renewal the renewal of the Radio Maintenance Agreement with GLEN -

the height of the tower from 150 feet to 100 feet.

Mayor Chappell then asked for testimony from those in
Patrick Graves
opposition to the appeal.
Oliver Riggins
Mr. Patrick Graves, representing Crestview Cadillac,
spoke in opposition to the facility being proposed by AMPS.
Mr. Oliver Riggins, 1239 W. Rowland, suggested the theme
tower at -Eastland Shopping Center as a possible alternate
site.
Rebuttal
Mayor Chappell asked for comments in rebuttal.

Mr. North addressed the remarks made'in opposition to
the proposed facility.
Council Discussion
Mayor Chappell closed the public portion of the hearing
and commenced council discussion. Council felt that AMPS
hadn't,fully explored all the other possible sites in West
Covina to -,locate the'receiving station. Council supported
•
the Planning Commission's decision to deny the unclassified
use permit.

Royall Brown the landscape stating that the.district hadn't been main-
tained properly against weeds and fire hazards.(referring
to the west end of the maintenance district).

SENIOR CITIZEN HOUSING
INTERIM ORDINANCE NO. 1588 (Urgency Measure)
Senior Citizen Housing
City Clerk Mooney verified the affidavit of publication.
Urgency Measure
Mayor Chappell opened the hearing and the staff report
was presented by Environmental Services Director Miller.
The mayor asked for public testimony first in favor of
the urgency measure and no one addressed Council. He
then asked for testimony in opposition to the urgency.

Royall Brown
Royall Brown, 2153 Aroma Drive, spoke in opposition to
the urgency measure stating that it wasn't fair to senior
citizens.
Councilmember Shearer clarified the intent of the
ordinance which is to make senior citizen housing available
in the future.
As there was no.one else interested in addressing
Council, Mayor Chappell closed the public portion of the
hearing.

Mayor Chappell opened the hearing and City Engineer
Thomas presented the staff report with slides.
City Clerk Mooney stated that two letters,had been
received in the matter: one from Richard Angarola, Deputy
Superintendent of Rowland Unified School District and one
from Mr. and.Mrs. Alexander Sanchez, adjacent property
owners.
Testimony_
Mayor Chappell noted that the two affected property
owners had submitted written requests to testify at the

'hearing and that they could address Council on the followinc
issues:
1. Whether the public interest and necessity require
the project..
2. Whether the project is planned and located in the
manner that is most compatible with the most public
good and least private injury.
3. Whether the property sought to be acquired is nec-
essary for the project.
The issue of compensation may not be addressed at this
hearing.
Mrs. Alexander Sanchez
Mrs. Alexander Sanchez, 3031 Kimberly Drive, stressed
her neighborhood's desire to close Gemini to through traf-
fic and she submitted a petition signed by 68.residents.
Doug Ellwell
Doug'Ellwe]1, Deputy County Counsel, representing the
Rowland Unified School District, spoke in opposition and
suggested a re-examination of traffic control devices to --
solve the traffic problem and avoid litigation. He also
informed Council of state laws regarding eminent domain
�rwhen two public agencies are involved.
Richard Angarola
Richard Angarola, Deputy Superintendent of Rowland
Unified School'District, felt that access to the public
school was a great public need. He also suggested traffic
controls, rather than street closure, to solve the problem.
Motion by Shearer, seconded by Bacon, and unanimously

carried to close the public portion of the hearing.

REDEVELOPMENT AGENCY MEETING Mayor Chappell halted the City Council meeting at 9:50PM
to convene the Redevelopment Agency meeting. Council
reconvened at 9:53 PM.

Council reviewed staff's report.
Motion by Tice, seconded by Bacon, and unanimously car -
Legislation ried to support HR 2175, HR 2544, and HR 1036 and authorize
the Mayor and staff to communicate the Council's position
to appropriate persons and agencies.
APPROVAL OF DEMANDS Motion by Bacon, seconded by Shearer to approve Demands totaling
$1,016,784.42 as listed on check registers FI 52821 through
FI.53186. Motion carried by roll call vote:

ORAL COMMUNICATIONS Royall Brown, 2153 Aroma Drive, hadn't heard answers to questions
he asked a couple of council meetings ago„re truck -speeds.
Royal Brown Oliver Riggins, 1239 W. Rowland Avenue, addressed Council re
Oliver Riggins the condemnation procedure under one of the public hearings.
City Attorney reminded the audience that truck speeds are set
by the State, and therefore preempts any action .by local govern-
ments.
Council mentioned that Assemblywoman Tanner would be
carrying legislation.allowing"local agencies the authority
to enforce truck speeds on highways.
Staff was instructed to send- the; sta:f!f-,;rep*o�rt.-jre sewer
availability charges to Royal Brown.

Mayor Chappell recessed the City Council meeting at 10:13 PM
to conduct a closed session to discuss litigation matters.
