Garvey Avenue, West Covina, California. The Pledge of Allegiance was led by Councilmember Tennant and the invocation was given by Pastor Timothy Johnson, Christ Lutheran Church. Motion carriedby roll call vote: AYES: Bacon, Tennant, Shearer, Chappell, Tice NOES: None SB 501 Hearing request Mayor Tice began a council discussion on the possibilities • of requesting the State conduct a 501 hearing regarding the BKK Landfill. City Attorney Lennard briefed Council on the SB 501 statute providing the means for demanding the State to make a final determination as to whether there is any substantial endangerment to the public health and safety of the residents of West Covina. Council concurred on the necessity for demanding a 501 Hearing. It was pointed out that the DOHS Emission Study, the DOHS April 7th informational hearing, a letter read by Mayor Tice from Richard. Wilcox,(Acting Deputy Director of Toxic Substance Control Division), and the State's most recent action to pull the PAC report on three possible toxic waste landfill sites, all served to confuse the issue even -further. Council asked for a heading of a resolution to formally request the State to conduct a 501 Hearing. City Attorney presented: Resolution 6683 - RESOLUTION NO. 6683 - A RESOLUTION OF THE CITY COUNCIL OF Demanding a 501 Hearing THE CITY OF WEST COVINA, CALIFORNIA, DEMANDING THAT THE by DOHS STATE DEPARTMENT OF HEALTH SERVICES NOTICE AND HOLD A PUBLIC HEARING PURSUANT TO HEALTH AND SAFETY CODE SECTION 25149 Motion by Shearer, seconded by Bacon, and unanimously carried to waive further reading of the resolution and to adopt. Planning Commission • hearings held in Qity Attorney Lennard suggested Council suspend ongoiig Planning Commission hearings re possible amendments or abeyance additions to the Unclassified Use Permit regulating the landfill, pending the determinations from the 501 Hearing. Motion by Shearer, seconded by Chappell, and unanimously carried to support the recommendation of the City Attorney. Call to Order Introductory statements Council comments April 25, 1983 Page Three currently issued by the State to BKK; and further that the conditions, etc., be placed on the final permit to BKK by the State which is coming up in August of this year for public hearing by the State. 1) CONTINUED JOINT MEETING REGARDING OPA AND FINAL EIR - AZUSA AVENUE, BETWEEN WORKMAN AND ROWLAND AVENUES (WEST COVINA VILLAGE SITE) Interruption in pro- ceedings: Tom Parrington Special Counsel City Attorney Mayor Tice called the Redevelopment Agency to order for the purpose of holding a joint meeting between the Re- development Agency and the City Council. City Clerk Mooney noted that all Agency members were present. Mayor Tice noted that the purpose of the continued joint public hearing was to consider 1) the proposed sale of land in the Central Business District Rede- velopment Project Area as provided for in a proposed Participation Agreement between the R.A. and Dighton Incorporated, N.V., and 2) the Final Environmental Impact Report for the proposed Participation Agree- ment. He also noted that the hearing had been con- tinued in order for staff to respond to questions and comments received at the March 15, 1983 meeting and that the public testimony portion of the hearing was closed. Mr. Tom Parrington, attorney for David. Miller, tries to address Council regarding supplemental information to a report which he felt was not available for comment at the March 15 meeting. Special Counsel Weiser explained that the new inf.ormation::,tha"t council__ has is_ -.in regard to some side-issues'of whether or. -not Mr.: Miller. was accorded his rights.in:.given an opportunity to participate. City Attorney Lennard pointed out that all reports remain the same, the public testimony portion is closed and if Council wishes to hear Mr. Parrington on the side issues ,:^thatUwould',beLat='Council's discretion. ORAL-COI,.MUNICATIONS Rev..Juan Romero, Pastor of St. Martha's Church and parish, addressed Council regarding the number of spills on Azusa Rev. Juan Romero Avenue in front of the church and school. He expressed grave concern for the health and safety of the children attending the school. His recommendation to Council was to re-route the truck routes through West Covina. He presented the City Clerk with a letter stating more for- mally what he had addressed in his presentation. He submitted two pictures for Council's review and requested the ordinance be revised. Royall Brown Royal Brown, 2153 Aroma Drive, addressed Council on the speed limit on Azusa Avenue. He suggested the speed -limit for trucks be restricted to 25mph and that the drivers -be restri.cted'to the right lane only. Recess Mayor Tice called a recess at 9:18 PM. Council reconvened at 9:22 PM to comment on the remarks made under Oral Communications. Council comments Councilmember Shearer pointed out that only the State has Shearer the authority to take action on truck routes, but he would not be opposed to the City Attorney reviewing the matter. He felt effort should be made towards enforcement, higher fines for violations of malfunctioning trucks, and the industries should take internal actions to bring the trucks into proper operating conditions. Chappell Mayor Pro Tem Chappell noted that the Wilmington treat- ment plant has been held up in bureaucratic review for two years. The opening of the plant would decrease the number of toxic waste haulers traversing Azusa Avenue. Tennant Councilmember Tennant supported the City Attorney r.eviewing-:the matter of rerouting -trucks, and if the • determination is that the City has no authority in that regard then Council should request the State to address the issue in the 501 Hearing.
